RESOLUTION NO. 2003-R-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA; APPROVING AN OVERALL TREE REMOVAL PERMIT FOR PARKTOWNE INDUSTRIAL CENTER AND AUTHORIZING THE CITY MANAGER TO MITIGATE REMOV ALIRE PLACEMENT OF TREES IF NECESSARY; REPEALING RESOLUTIONS IN CONFLICT HEREWITH AND EST ABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Edgewater, Florida, has made the following determinations: 1. On February 3,2003, City Council approved the Zoning Agreement for ParkTowne Industrial Center; and 2. Section 10 - Development Requirements, Paragraph "D" (Tree Requirements) stipulate that removal of specimen trees require mitigation of trees in a location approved by the City and that if the City determines that replacement trees would not benefit the area, the owner would pay into a mitigation bank the amount determined by the City; and 3. City Council feels that it would be in the best interest for development of the ParkTowne Industrial Center to issue an overall tree removal permit with authorization for the City Manager to mitigate any removal/replacement of specimen and/or historic trees. NOW, THEREFORE, be it resolved by the City Council ofthe City of Edge water, Florida: Section 1. Pursuant to Section 10 - Development Requirements, Paragraph "D" (Tree Requirements) of the Development Agreement for ParkTowne Industrial Center, the City Council hereby determines and approves that any specimen tree that needs to be removed for development of a site or installation of supporting infrastructure within the Center shall be replaced within the fifty foot (50') landscape buffer or perimeter of the property. If City staff determines that 2003-R-08 1 ~ ....", replacement trees would not benefit the stipulated areas, the City Manager may authorize another form of mitigation. Section 2. City Council also agrees that if removal of a historical tree is required for development of a site within ParkT owne, said mitigation for removal/replacement of said tree shall be determined by the City Manager in accordance with the City's Land Development Code. Section 3. City Council hereby agrees and authorizes permission of a tree removal permit for the ParkTowne Industrial Center for development of any site or necessary infrastructure within the Center with approval for the City Manager to mitigate any removal/replacement of any trees. Tree Requirements Notwithstanding other landscaping requirements, no minimum number of trees are required on individual parcels with the exception of the following: 1) Any development proposing the removal of specimen trees shall require the mitigation of said trees in a location approved by the City. 2) . If it is determined by the City that replacement trees (to mitigate removal of specimen trees) would not benefit a particular lot or area, the Owner(s) shall pay into a mitigation bank, an amount determined by the City. The proceeds may only be used for replacement of trees as approved by the City. E. Landscape Buffer 1) There shall be a minimum fifty (50') foot landscape buffer "conservation easement" consisting of natural tree/vegetation along the Park's northern and western perimeter boundary except those bounded by the FEC railroad and spurline. 9 ParkTowne Development Agreement
