2008-R-08 RESOLUTION NO. 2008-R-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEW A TER, FLORIDA, ADOPTING THE ENVIRONMENT AL CORE OVERLA Y (ECO) MAP (FORMALLY KNOWN AS MAP "A") AS PRESENTED AND ACCEPTED BY THE VOLUSIA COUNCIL OF GOVERNMENT ("VCOG") SMART GROWTH COMMITTEE AS ENVIRONMENT ALL Y SENSITIVE LANDS TO BE CONSERVED FOR FUTURE GENERATIONS; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: WHEREAS, the City of Edgewater believes in the conservation of environmentally sensitive lands within the County of V olusia; and WHEREAS, the City also supports unique walkable communities, towns and cities within V olusia County; and WHEREAS, the Volusia Council of Governments ("VCOG") Smart Growth Committee has recommended conservation of lands designated within the final Environmental Core Overlay (ECO) Map (formally known as Map "A") areas; and WHEREAS, the City of Edgewater is a member of "V COG" and is committed to the use of acceptable smart growth tools to conserve Environmental Core Overlay (ECO) lands that promote economic vitality and allow flexibility for each community's future. NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater, Florida: Section 1. The City Council of the City of Edgewater joins the County of V olusia in adopting a resolution to conserve all lands contained in the Environmental Core Overlay (ECO) Map (which is attached hereto and incorporated herein) using agreed upon smart growth tools. 2008-R-08 Section 2. If any section, subsection, sentence, clause, phrase, or portion of this Resolution, or application hereof, is for any reason held invalid or unconstitutional by any Court, such portion of application shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions or application hereof. Section 3. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 4. This resolution shall take effect immediately upon its adoption.
