2008-O-11 o o ORDINANCE 2008-0-11 AN ORDINANCE OF THE CITY OF EDGEW A TER, VOLUSIA COUNTY, FLORIDA, SETTING THE FINAL MILLAGE RATES FOR THE CITY FOR FISCAL YEAR 2008- 2009; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Statutes, including Chapter 200.065(2)( e) 1., provide that the City Council shall adopt a final millage rate prior to the adoption of a final budget; and, WHEREAS, the V olusia County Property Appraiser has certified a rolled-back rate of $6.43899 per $1,000 of taxable value for the City of Edgewater; and, WHEREAS, October 1, 2008 is the commencement of the fiscal year for the City of Edgewater; and, WHEREAS, on September 8, 2008, a public hearing was held on the tentative millage rate and all persons desiring to voice objection or make comment upon said millage rate were given an opportunity to do so; and, WHEREAS, on September 22, 2008, a public hearing was held on the final millage and all persons desiring to voice objections or to make comment upon said millage were given an opportunity to do so. NOW, THEREFORE, BE IT ENACTED by the City of Edgewater, Florida as follows: SECTION 1: That the City Council of the City of Edge water, Florida, deems it necessary to levy and does hereby levy a tax of $5.9000 mills upon all real and personal property, railroads, telegraph and telephone lines within the City of Edgewater for operational purposes and $0.033047 mills for Voted Debt Service. SECTION 2: The operating levy of$5.9 mills represents a (9.1)% change from the rolled- back rate. SECTION 3: The Voted Debt Service levy of $0.033047 mills based on the sale of the Limited General Obligation Note Payable in 2007. Struck through passages are deleted. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 5. This Ordinance shall become effective immediately upon passage and adoption. After motion to approve by Councilwoman Bennington and second by Councilman Cooper, the vote on the first reading of this ordinance held on September 8, 2008, was as follows: AYE NAY Mayor Michael Thomas x Councilwoman Debra J.
