THIS CAUSE came on for a Violation Hearing before the City of Edge water Citizen Code
Enforcement Board on September 21, 1995, after due notice to the Violator, Jack R. Sparks, and the
Board having heard testimony under oath, received evidence, and heard arguments of counsel (if any),
thereupon issues its Findings of Fact, Conclusion of Law, and Order as follows:
A. FINDINGS OF FACT: Based on the testimony of the Code Enforcement Officer
and the presentation of pictures of the property, the Citizen Code Enforcement Board has determined
that a boat and boat trailer with no tag are located on the front property described as Lots 11195 to
11199 Inc Blk 360 Florida Shores No 15 which is located in the R-2B, Single-Family Residential
District.
B. CONCLUSION OF LAW: Section 18-4 of the Code of Ordinances, Edgewater,
Florida, provides that boats and boat trailers or utility trailers of any type, make or model may be
parked at the owner's home in any residential area of the city only in or on the back or side yard of
said home; provided however, said boat, trailer or utility trailer does not exceed twenty-six (26) feet
in length or eight (8) feet in width. A property owner may be excused from strict compliance with
this section if there is not ample space between his lot line and dwelling to enable him to park any of
the above mentioned items in his side or backyard. Since the Violator has stored a boat and boat
trailer in the front property described above, Section 18-4 of the Code of Ordinances, Edgewater,
Florida, has been violated.
Section 10-64 of the Code of Ordinances, Edgewater, Florida, provides that it shall be
unlawful for any person whether as owner, occupant, lessee, agent, tenant, or otherwise, to keep,
maintain, store or deposit, or cause or permit to be kept, maintained, stored or deposited any
abandoned, junked or discarded motor vehicle, household appliances or machinery, upon private or
public property within the city. Pursuant to Section 10-66 of the Code of Ordinances, Edgewater,
Florida, an abandoned, junked or discarded motor vehicle shall mean one on which a valid license
plate is not displayed. Since the Violator has kept a boat trailer with no tag on the property described
above, Section 10-64 of the Code of Ordinances, Edgewater, Florida, has been violated.
C. ORDER: Based on the findings of fact and conclusion of law set out above, this
Board determines that the Violator must abate the violation by storing the boat and boat trailer behind
the front dwelling line or rear yard, and obtaining a current tag or removing the boat trailer from the
property described above by October L 1995 . Unless the violation is properly abated
by October L 1995 , a fine of fifty and 00/100 dollars ($ 50.00 ) per day is hereby
imposed for each day the violation continues past that date.

THIS CAUSE came on for a Violation Hearing before the City ofEdgewater Citizen Code
Enforcement Board on September 21, 1995, after due notice to the Violator, lack R Sparks, and the
Board having heard testimony under oath, received evidence, and heard arguments of counsel (if any),
thereupon issues its rmdings of Fact, Conclusion of Law, and Order as foUows:
A. FINDINGS OF FACf: Based on the testimony of the Code Enforcement Officer
and the presentatioo of pictures of the property, the Citizen Code Enforcement Board has detennined
that a boat and boat trailer with no tag are located on the front property described as Lots 11195 to
11199 Inc Blk 360 Florida Shores No 15 which is located in the R-2B, Single-Family Residential
District.
B. CONCLUSION OF LAW: Section 18-4 of the Code of Ordinances, Edgewater,
Florida, provides that boats and boat trailers or utility trailers of any type, make or model may be
parked at the owner's home in any residential area of the city only in or on the back or side yard of
said home; provided however, said boat, trailer or utility trailer does not exceed twenty-six (26) feet
in length or eight (8) feet in width. A property owner may be excused from strict compliance with
this section if there is not ample space between his lot line and dwelling to enable him to park any of
the above mentiooed items in' his side or backyard. Since the Violator has stored a boat and boat
trailer in the from property described above, Section 18-4 of the Code of Ordinances, Edgewater,
Florida, has been violated.
Section 10-54 of the Code of Ordinances, Edgewater, Florida, provides that it shaD be
unlawful for any person whether as owner, occupant, lessee, agent, tenant, or otherwise, to keep,
maintain, store or c!eposit, or cause or pennit to be kept, maintained. stored or deposited any
abandoned, junked or discarded motor vehicle, household appliances or machinery, upon private or
public property within the city. Pursuant to Section 10-66 of the Code of Ordinances, Edgewater,
Florida, an abandoned, junked or discarded motor vehicle shaD mean one on which a valid license
plate is not displayed. Since the Violator has kept a boat trailer with no tag on the property dcscnbed
above, Section 10-64 of the Code of Ordinances, Edgewater, Florida, has been violated.
C. ORDER: Based on the findings of fact and concl~on oflaw set out above, this
Board determines that the Violator must abate the violation by storing the boat and boat trailer behind
the front dweUing line or rear yard, and obtaining a current tag or removing the boat trailer from the
property described above by October I 1995 . Unless the violation is properly abated
by October I 1995 . a fine of fifty and 00/100 doUars (S2Q.QQ.j per day is hereby
imposed for each day the violation continues past that date.
