90-O-13 , . .....,. ...., ORDINANCE NO. 90-0-13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE- WATER, FLORIDA, AMENDING CHAPTER 16, TAXATION, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY ADDING FUEL OIL AS A TAXABLE ITEM AND BY ESTABLISH- ING A TEN PERCENT (10%) UTILITY TAX. CONTAINING A RE- PEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Chapter 16, Taxation, of the Code of Ordi- nances of the City of Edgewater, Florida, be amended as follows:* CHAPTER 16 TAXATION Sec. 16-1. Electricity, cable television, metered or bottled gas, fuel oil, local telephone and tele- graph tax--LevYi exemption of political sub- divisions. (a) There is hereby levied by the city on each purchase within the city, of electricity, cable television service, meter- ed or bottled gas (natural, liquefied petroleum or manufactured), fuel oil and local telephone and telegraph service a tax equal to ten (l 0) per c e n t 0 f -t-he -f-i-r~- -t.-wan-t.~ ~1-1-a-r~ -(-$-2-O-.-().O..)....p.J..us.. ...f-;i..1.~ -(-5-)- -per- ""'Ce1rt -cl- -at'rT -sum- -i-n- -e-xee-~s - o-f- -twe-n-t::y -d oi i 1'1-r-t]- -(-72-& ~ e e ~ --o-f each payment received by the seller of such utility service from the purchaser of such utility service, which tax shall in every case be collected from the purchaser and paid by such purchaser for the use of the city to the seller of such utility service at the time of the purchaser's paying to the seller the charge made by the seller for such utility service, but not less often than monthly. SECTION 2. That all ordinances or parts of ordinances and all resolutions in conflict herewith, be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. *Deleted language has been underscored. lined through and new language 1 SECTION 4.
