2025-R-25 - SB 784RESOLUTION NO. 2025-R-25 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA, DESIGNATING THE ADMINISTRATIVE AUTHORITY TO REVIEW, PROCESS, AND ADMINISTER PLATS AND REPLATS IN ACCORDANCE WITH SENATE BILL 784; AUTHORIZING RECORDING; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND APPLICABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on June 20"', 2025, Governor Ron DeSantis signed Senate Bill 784, which amends Florida Statute section 177.071; WHEREAS, Senate Bill 784 takes effect on July I't, 2025; and WHEREAS, Senate Bill 784 requires that final plats and replats be administratively approved with no further action by certain entities; and WHEREAS, Senate Bill 784 requires the governing body of a municipality to designate by ordinance or resolution, an administrative authority to receive, review, and process the plat or replat submittal, including designating an administrative official responsible for approving, approving with conditions, or denying the proposed plat or replat; and WHEREAS, Senate Bill 784 defines that the administrative officer should be either the City Manager or a Department Director with direct or indirect oversight responsibility for the city's land development, housing, utilities, or public works programs; and WHEREAS, the City Council of the City of Edgewater in compliance with Senate Bill 784 hereby designates the Development Services Director as the administrative authority to approve, approve with conditions, or deny a proposed plat or replat. NOW THERE, FORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: 2025-R-25 SECTION I. AUTHORITY The City Council of the City of Edgewater has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes, Chapter 177.101(5), and Article IX (Application Procedures) of Chapter 21 (Land Development Code) of the City of Edgewater. SECTION 2. RECORDING A certified copy of this Resolution shall be filed with the Volusia County Property Appraiser and duly recorded into the Public Records of Volusia County, Florida, by the Volusia County Clerk of Court. SECTION 3. CONFLICTING PROVISIONS All resolutions or parts of resolutions in conflict herewith are hereby repealed. SECTION 4. SEVERABILITY AND APPLICABILITY If any portion of this resolution is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this resolution. If this resolution or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance.
