90-O-22 /. w ""'" ORDINANCE NO. 90-0-22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE- WATER, FLORIDA, AMENDING CHAPTER 11, ARTICLE II. MISCELLANEOUS TAXES AND REGULATIONS, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY DECREASING THE EXCISE TAX ON THE GROSS AMOUNT OF PREMIUMS ON MUNICIPALITIES POLICE RETIREMENT FUNDS FROM ONE (1%) PERCENT TO .85 PERCENT; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 185, Florida statutes, was amended by reducing the excise tax on the gross amount of premiums on munci- palities Police Retirement Funds from 1% to .85%, and WHEREAS, Section 11.20 of the Code of Ordinances of the City of Edgewater, Florida, must be amended to comply with the new amendment to the State statute. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Chapter 11, Article II, Miscellaneous Taxes and Regulations, of the Code of Ordinances of the City of Edgewater, Florida, be amended as follows:* CHAPTER 11 OCCUPATIONAL LICENSES, TAXES AND REGULATIONS ARTICLE II. MISCELLANEOUS TAXES AND REGULATIONS Section 11-20. Excise tax on insurance companies. (a) There is hereby assessed, imposed and levied on every insurance company, corporation or other insurer now engaging in or carrying on, or which shall hereafter engage in or carryon the business of insuring with respect to casualty risks, as shown by the records of the insurance commissioner of the state, an excise tax in addition to any license tax or excise tax now lev- ied by the city, which said tax shall be in the amount of efte ~e~ eeft~ .85 per cent of the gross amount of receipts of pre- miums from policyholders on all premiums collected on casualty insurance policies, covering property within the city. *Deleted language has been ~~fted ~A~e~~A and new language underscored. 1 , , . ~ .""" SECTION 2. That all ordinances or parts of ordinances and all resolutions in conflict herewith, be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. SECTION 4. This Ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
