ORDINANCE NO. 90-0-24
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE-
WATER, FLORIDA, AMENDING THE CHARTER OF THE CITY OF
EDGEWATER, FLORIDA, BEING CHAPTER 27532, LAWS OF
FLORIDA, SPECIAL ACTS OF 1951, AS AMENDED, SO AS TO
CLARIFY THE CITY'S POWER TO ISSUE BONDS UNDER GENERAL
STATE LAW IN LIEU OF SPECIFIC PROVISIONS OF ITS
CHARTER; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Edgewater, Flo-
rida, has determined that it is in its best interest to insure
its lawful authority to issue bonds under general state law for
various purposes as permitted from time to time by law; and
WHEREAS, the Charter of the City of Edgewater, Florida,
being Chapter 27532, Laws of Florida, Special Acts of 1951, as
amended, includes various provisions relating to bonds which are
more restrictive than the general laws of the State of Florida
applicable to municipalities.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. The City shall have the power to issue bonds
and other evidences of indebtedness pursuant to the general laws
of the State of Florida.
SECTION 2.
The following provisions of Chapter 27532,
Laws of Florida, Special Acts of 1951, as amended, are hereby
repealed:
(a) Section 102, relating to issuance of bonds; and
(b) Section 103, relating to sale of bonds.
SECTION 3.
Section 74 of Chapter 27532, Laws of Florida,-
Special Acts of 1951, as amended, is amended to read as follows:
"Section 74. SPECIAL TAX LEVIES. In addition to the fore-
going levy of not exceeding 30 mills, said City Council of said
municipal corporation may annually levy and collect a special tax
for permanent improvements and the adornment, paving and improve-
ment of the streets and public grounds of the City, and the pro-
perty of the municipality beyond the limits of the City, which
levy shall not exceed 10 mills on the assessed value of the tax-
able property of the City. Said municipality shall also levy and
collect annually upon its taxable property aforesaid such sums as

may be necessary; (1) to pay interest upon the indebtedness of
the City; and (2) for the maintenance and repairs of its proper-

(3) to pay the bonds of the City which may be issued in accor-
dance with law and to pay any judgment against the City and any
such sums as may be commanded to be levied by any mandamus legal-
ly issued against the City.
SECTION 4. This Ordinance is enacted pursuant to authori-
ty granted in Section 166.021, Florida statutes, and ~rticle
VIII, Section 2(b), Florida Constitution of 1968, as amended.
The foregoing provisions of the Special Acts of the State of Flo-
rida described in Sections 2 and 3 having becoming an ordinance
of the City of Edgewater on July 1, 1973, such provisions in Sec-
tion 2 are and shall be repealed, and such provisions in Section
3 are and shall be amended as provided herein, all upon the effec-
tive date of this Ordinance.
SECTION 5. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 6. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 7. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

This Ordinance was read on first reading and passed by a
vote of the City Council of the City of Edgewater, Florida, and
approval as provided by law, at a Regular meeting of
said Council held on the 21 day of May , 1990.
The second reading of this Ordinance to be at a Regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the
