ORDINANCE NO. 90-0-26
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE-
WATER, FLORIDA, PROHIBITING THE THEFT OF RECYCLING
CONTAINERS AND ANY MATERIALS DESIGNATED AS RECYCLABLE
BY THE CITY OF EDGEWATER; PROVIDING FOR DEFINITION OF
RECYCLABLE MATERIALS; PROVIDING FOR PENALTIES;
CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Edgewater must comply with the Solid
Waste Management Act of 1988, and in particular the implementa-
tion and operation of a recycling program of certain recyclable
materials; and
WHEREAS, the monies received for the recyclable materials
recovered substantially reduce the City of Edgewater's cost of
operating the recycling program all to the benefit of the tax-
payers; and
WHEREAS, theft of recycling containers provided by the
City of Edgewater or theft of the recyclable materials results in
increased costs all to the detriment of the taxpayers.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. DEFINITIONS
For the purpose of this ordinance, the following terms shall
have the meanings indicated in this section.
"Recycling containers" shall mean the receptacles purchased
and distributed by or on behalf of the City of Edgewater to city
residents for the intended use of R--yclable Materials.
"Recyclable Materials" shall mean those materials which are
capable of being recycled and which would otherwise be processed
or disposed of as solid waste including newspapers, glass and
plastic containers, aluminum cans, and such other materials as
designated by resolution of the City Council.
SECTION 2. UNAUTHORIZED COLLECTION
No person, firm or corporation shall be permitted to collect
or remove either R-ycling Containers or R cyclable Materials
placed in or near the Recycling Containers or designated collec-
tion location unless previously authorized by the City of Edge-
water.
SECTION 3. PENALTIES FOR UNAUTHORIZED COLLECTION

Penalties for unauthorized collection of Recycling Contain-
ers or Recyclable Materials shall be to the extent permitted by
law.
SECTION 4.
That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 5.
If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 6.
This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.
