SPECIAL MEETING
TUESDAY, 3ANUARY 16, 1990
CONFERENCE ROOtI, CITY HALL.
Chairman, Harry Jones called to order a special meeting of the
Merit Board at 7:30 p.m., Tuesday, January 16, 1990 in the
Con'Ference Room of City Hall.

Also present were Elly Johnson, City Manager, Charles Chamberlin~
Michael Tenney, Assistant Public Works Director, Carl Overstreet,
Director of Public Works and Sondra Meager-Pengov, Secretary.

Mr. Jones requested the witnesses fOl- Mr. Chamberli~o be sworn
in. After considerable discussion regarding swearing in of
witnesses, Mr. Johnson stated that he, Mr. Overstreet and Mr.
Tenney will not be sworn in until he has a written opinion from
the City Attorney regarding this issue.
Mr. Jones asked that the records show, that Mr. Johnson, Mr.
Overstreet and Mr. Tenney refused to be sworn in.
Mr. Johnson said, let the records also show, that he didn't
refuse to be sworn in, he is not a witness in the first place.

Mr. Chamberlin's anniversary date is October 1, 1989. Mr.
Overstreet stated the reason the evaluation for Mr. Chamberlin
was done late, was because he was waiting for the Cody &
Associates, Inc. report, but was then told to go ahead and do the
evaluation.
Both Mr. Overstreet and Mr. Tenney feel the evaluation given to
Mr. Chamberlin was fair and accurate. Mr. Tenney stated he
feels Mr. Chamberlin is capable of doing a better job than he has
done.
Mr. Jones stated that the Merit Board is not in a position to
change a rating of an employee. Mrs. Grasberger stated she is
satisfied with the evaluation as it stands.
After a considerable amount of discussion, Mrs. Young made a
motion to leave Mr. Chamberlin's evaluation as it has been
presented. Seconded by Mrs. Grasberger. Mrs. Young and Mrs.
Grasberger voted YES, Mrs. stevens and Mr. Jones voting NO.
Motion FAILED 2-2. It was the concensus of the Board that the

Ordinance 89-0-39
After discussion of Ordinance 89-0-39 Mrs. Stevens made a motion
recommending the acceptance of Ordinance 89-0-39 as presented.
Seconded by Mrs. Grasberger. Mrs. Grasberger, Mrs. Stevens and
Mrs. Young voted YES. Mr. Jones voted NO. Motion CARRIED 3-1.
There being no further business to come before the Board Mrs.
Grasberger moved to adjourn. Meeting adjourned at 9:35 p.m.

ORDINANCE NO. 89-0-39
AN ORDINANCE OF TBE CITY COUNCIL OF THE CITY OF EDGE-
WATER, FLORIDA, AMENDING SECTION 13-29 OF THE CODE OF
ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY
ADOPTING A NEW MERIT SYSTEM POLICY; A CITY OF EDGEWATER
PAY PLAN; A CLASSIFICATION AND PAY PLAN AND CLASS
DESCRIPTIONS; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on February 6, 1989 the City Council authorized a
Wage and Classification Study, and
WHEREAS, the above Study was presented to and reviewed by
the Merit Board on December 6, 1989.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That Section 13-29 of the Code of Ordinances
of the City of Edgewater, Florida, is hereby amended by adopting
a new Merit System Policy; a City of Edgewater Pay Plan; a Classi-
fication and Pay Plan and Class Descriptions, attached hereto as
Exhibit -A- and by reference incorporated herein with full force
and effect as if fully set forth.
SECTION 2. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 3. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 4. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

I WOULD LIKE TO MEET WITH THE MERIT BOARD TO DISCUSS MY 1989 YEARLY
EVALUATION. I HAVE BEEN TO MR. JOHNSON, CITY MANAGER, HIS COMMENT
WAS TO COME TO YOU. I FEEL I WAS MISTREATED FOR SOME THINGS THAT
HAPPENED SOME TIME AFTER NOVEMBER, AFTER MY OCTOBER 1st EVALUATION.
I WAS ALSO TOLD BY ANOTHER EMPLOYEE WHO HAD DONE SOME WORK IN MR. OVERSTREET'S
OFFICE THAT THEY SAW MY EVALUATION ON HIS DESK AND IT WAS A SCORE OF
89 POINTS, THAT WAS THE FIRST WEEK IN OCTOBER. IN LATE NOVEMBER WHEN
I RECEIVED MY EVALUATION I WAS GIVEN A SCORE OF 84 POINTS. AFTER
TALKING TO MR. OVERSTREET ABOUT IT SOME OF THE REASONS HE~AVE ME HAPPENED
AFTER NOVEMBER SO THEREFOR I BELIEVE THAT MY EVALUATION WAS CHANGED. WHEN
I TOLD HIM THAT I THOUGHT IT WAS HE NEVER SAID THAT IT WASN'T. IF I COULD
MEET WITH YOUR BOARD ON SOME TUESDAY TO TALK TO YOU ABOUT IT I WOULD
APPRECIATE IT.

comments with Carl Overstreet. Carl stated that your
evaluation was not changed and he felt that the
evaluation was fair.
Sorry it took so long to get back to you but with all of
the other acti vi ties, there never seems to be enough
time.
As per my comments to you, the next step would be the
Merit Board.
