1. CALL TO ORDER, ROLL CALL, PLEDGE OF ALLEGIANCE AND INVOCATION
Mayor Depew called the meeting to order at 6pm.
Present: 5 - Mayor Diezel DePew, Councilwoman Charlotte Gillis, Councilwoman Gigi Bennington,
Councilwoman Debbie Dolbow, and Councilman Jonah Powers
Also Present: 4 - City Attorney Aaron Wolfe, City Manager Glenn Irby, City Clerk Bonnie Zlotnik, and

a. Proclamation - Safe Boating Week
5. CITIZEN COMMENTS
Michael Hosmer, 630 Portside Lane, spoke about golf carts being allowed on the sidewalks near
Edgewater Landings.
David Murdock, 1910 Myrtlebrooke Drive, discussed issues with the grading and development in the
Glenbrooke subdivision.
Daniel Lewis, 111 Lewis Street, discussed issues with a former City employee.
Tom Carter, 1914 Hollybrooke Road, had concerns about retention ponds in the Glenbrooke
subdivision.
Dan McCormack, 2351 S Ridgewood Avenue, expressed concerns about a diesel pump being used in
Pyramid Park to power a lift station.
Carol Jones, 317 Hart Avenue, invited City Council to a disability event at the Elks Lodge.
Debbie Phillips, 1203 Needle Palm Drive, had concerns about an oak tree on Park Avenue being cut

6. CITY COUNCIL REPORTS
May 6, 2024
Councilwoman Dolbow had attended the Earth Day event; a ribbon cutting for the Butterfly Garden
at Hawks Park and the Tipsy Unicorn Brewery; the Earth Day event at the Atlantic Center for the
Arts; the New Smyrna Beach Business Expo and the pack walk for the Animal Shelter. She plans on
attending the Yappy Hour event and shared some community events that are coming up. She
explained an adoption program that the Animal Shelter is doing in collaboration with the Bissell Pet
Foundation.
As prompted by Councilwoman Dolbow, Samantha Bergeron, Development Services Director,
explained the criteria the City must meet to obtain a Tree City USA recognition.
Councilman Powers had nothing at this time.
Councilwoman Bennington had attended the Pack Walk for the Animal Shelter and asked for
Councils consensus to pay the Animal Shelters water bill for the month; Fire Chief Jeff Lariscy
clarified that the City, is already paying the water bill, it may be the electric bill they need help with.
Council discussed different ways they could help the Animal Shelter in the future and gave consensus
to pay what they needed help with, whether it be the water bill or the electric bill.
Councilwoman Gillis had attended ribbon cuttings for the Habitat for Humanity house on Pine Tree
Drive, the City's Butterfly Garden and Tipsy Unicorn Brewery; the Volusia Forward workshop for
understanding risks and vulnerabilities, a dog training class at the Animal Shelter; a Citizens
Academy class; Oak Hill's Community Garden and Earth Month celebration; the Southeast Volusia
Manufacturing and Technology Coalitions job fair; the Edgewater Police Department Awards
Banquet; Volusia County Schools Our Story meeting; a canine policy update meeting; A PTA and
SAC meeting at New Smyrna Beach Middle School; the Edgewater Fitness Challenge halfway point
meeting; Budd's Bus Shops grand opening; the Womens Expo at the Brannon Center; the Edgewater
Firefighter fundraiser at Tailgatorz; a River to Sea TPO meeting; the Volusia County PTA Annual
Gala; the Earth Day Festival and the Chamber of Commerce Business Expo.
She commended Officer
Sammy Epitropoulus; Officer Hilton;

Manager Dicy Hall and
City Clerk Bonnie Zlotnik for various
accolades.
She had participated in ride
alongs with Edgewater
Police and Fire Departments and

Deputy Director Jeff Thurman; Code Enforcement,- and City Manager
Irby.
Councilwoman Gillis asked for Council consensus to put a small portion of money aside in the
general fund for the upcoming budget to start a program to help residents if they are unable to afford
to.fix their Code Enforcement violations. Council gave consensus to workshop the idea further.

Mayor Depew had attended a Southeast Volusia Ambassador meeting; a Southeast Volusia YMCA
board meeting; ribbon cuttings for a Southeast Volusia Habitat for Humanity home and Tipsy
Unicorn Brewery; a vulnerability assessment meeting; a Volusia Legislation update; an Advent
Health Foundation board meeting; Habitat for Humanity's Earth Day celebration; a National Day of
Prayer celebration; the Southeast Volusia Business Expo; an event at the Crimson House for the
Kentucky Derby and the Police Department Awards Banquet. He met with Congressman Mills;
Former Volusia County Chair Ed Kelly; City Manager Irby; the City Manager and Mayor of New
Smyrna Beach and Mayor Gibson of Oak Hill.
Council discussed the upcoming workshop agenda.
7. CONSENT AGENDA
A motion was made by Councilman Powers, second by Councilwoman Dolbow, to approve
the Consent Agenda. The MOTION was APPROVED by the following vote:

a. Request to award and to authorize the City Manager to execute a contract to Five 12
Painting and Remodeling for the Base Bid and Bid Alternate No. 1 in the amount of
$160,635.00 for Painting Services at the Alan R. Thomas Water Treatment Plant.

b. Request to authorize the City Manager to enter into negotiations beginning with the
top ranked firm(s) (Wharton -Smith, Inc) and execute the Part A Pre -Construction
Services contract for Professional Construction Management/General Contracting
Services (CMAR) for a New Public Works Facility, per Terms and Conditions set
forth in RFQ 24 -ES -01
C. Request to authorize staff to dispose of surplus asset/non-asset items in accordance
with FS Chapter 274.

8. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS
a. 2nd Reading - Ordinance No. 2024-0-10: Request to update Article II, Definitions,

Article III, Permitted, Conditional, Accessory and Prohibited Uses, Article VI, Sign
Regulations, and Article XX, Ridgewood Avenue Corridor Design Regulations.
City Attorney Wolfe read the Ordinance into the record.
There was no staff report as this was a second reading.
Mayor Depew opened the public hearing.
Michelle Rivera, 2944 Juniper Drive, owner of Tipsy Unicorn Brewery, spoke in support of the
feather flags.
Councilwoman Gillis asked if changes could be made or added to the Ordinance; City Manager Irby
said that they could continue it to a date certain. Councilman Powers felt that they should get the
program off the ground first as they could always amend the Ordinance. City Clerk Zlotnik pointed
out that this was only for 90 days.
Ryan Solstice, Development Services Director, explained that the program will be codified in the
Land Development Code and as discussed at a workshop, he will have a repeal ready if Council gave
direction to make changes.
Further discussion ensued on the timeline for being able to make changes to the Ordinance.
Mayor Depew closed the public hearing.
A motion was made by Councilman Powers, second by Councilwoman Bennington, to
approve Ordinance No. 2024-0-10. The MOTION was APPROVED by the following vote:

b. 2nd Reading - Ordinance No. 2024-0-38: Request to amend Chapter 10 of the City
of Edgewater's Code of Ordinances to regulate Food Trucks.

A motion was made by Councilman Powers, second by Councilwoman Gillis, to approve
Ordinance No. 2024-0-12. The MOTION was APPROVED by the following vote:

d. 2nd Reading - Ordinance No. 2024-0-13: Request for a rezoning from B-3,

A motion was made by Councilwoman Dolbow, second by Councilwoman Bennington, to
approve Ordinance No. 2024-0-13. The MOTION was APPROVED by the following vote:

e. 1st Reading - Ordinance 2024-0-18 Calling for Referendum to be held November 5,
2024 on the question to renew the Economic Development Ad Valorem Tax

City Manager Irby provided a staff report and recommendation.
Mayor Depew opened the public hearing.
Councilwoman Dolbow asked if businesses had to come back every year to prove that they have met
the criteria; City Manager Irby said no but the businesses must have their reporting to Finance in a
timely manner or per certain State requirement, they don't get the funds.
Mayor Depew felt that this was a good way to attract economic business.
Councilwoman Bennington received clarification that this was coming before Council because it is
expiring; if they approve the renewal it will be good for 10 years. Councilman Powers added that in
2014 this was approved on the ballot by voters, all Council is doing is agreeing to put it on the ballot

Mayor Depew closed the public hearing.
A motion was made by Councilman Powers, second by Councilwoman Bennington, to
approve Ordinance No. 2024-0-18. The MOTION was APPROVED by the following vote:

f. Resolution No. 2024-R-03: Agreement between the City of Edgewater, Florida, and
the State of Florida Division of Emergency Management to provide or receive
assistance in the event of a disaster or emergency.
City Attorney Wolfe read the Resolution into the record.
City Manager Irby provided a staff report and recommendation.

A motion was made by Councilwoman Bennington, second by Councilwoman Dolbow, to
approve Resolution No. 2024-R-003. The MOTION was APPROVED by the following vote:

g. Resolution 2024-R-04 Authorizing Acceptance of a Volusia ECHO 2024
Grants -in -Aid Grant: Entering into a Restrictive Covenant; Providing for Transmittal of
the ECHO Grant Acceptance Agreement
City Attorney Wolfe read the Resolution into the record.
City Manager Irby provided a staff report and recommendation.
Mayor Depew opened the public hearing.
Mayor Depew, Councilman Powers and Councilwoman Gillis thanked Parks and Recreation Director
Samantha Bergeron and Grant Writer Sandy Camp for their hard work. Councilman Powers felt that
this was a phenomenal asset to the community.

approve Resolution No. 2024-R-04. The MOTION was APPROVED by the following vote:

10. OTHER BUSINESS
May 6, 2024
a. Request to reclassify one (1) Combination Building Inspector Position for one (1)
Building Permit Technician.
City Manager Irby provided a staff report and recommendation.
Mayor Depew opened the public hearing.
Councilwoman Bennington asked for further clarification on the reclassified position; Mr. Irby and
Councilman Powers explained that they are taking the unfilled inspector position and reclassifying it
as a permit technician in an effort to fill that position. In the next fiscal year, they will possibly
approve the position for the combination building inspector.
Councilwoman Dolbow.felt this was needed in order to keep things moving.
Mayor Depew closed the public hearing.
A motion was made by Councilwoman Dolbow, second by Councilwoman Gillis, to approve
Other Business Item No. AR -2024-785. The MOTION was APPROVED by the following
vote:

b. City Hall Site Conceptual Plan and Programming
City Manager Irby provided a staff report and recommendation.
Mayor Depew opened the public hearing.
Councilwoman Dolbow asked if ' they were going to put information received from citizens via the
visioning workshops towards this or is it going to be conceptual. City Manager Irby explained that
there will be a space needs analysis done on the survey of the property, they then size the buildings
based on how many employees will be needed over a certain number of years and then determine if
everything will fit on the site.
Councilman Powers felt that this would ensure that the City is being productive with the space that
they have.
Councilwoman Bennington felt that for what they are planning on doing the price is good.

approve Other Business Item No. AR -2024-788. The MOTION was APPROVED by the

11. OFFICER REPORTS
a. City Clerk
City Clerk Zlotnik informed Council that she would be on vacation the following week and would be
appointing her assistant Monique as Acting City Clerk. She went over the upcoming workshops and
told Council that she would sending out calendar invites when, everything is confirmed.
Ms. Zlotnik received Council consensus regarding a resident who would like to be put on the agenda;
Mr. Irby asked to have conversations with Council prior to that happening.
b. City Attorney
City Attorney Wolfe provided litigation updates for the Hatcher, Lawrence Garrett and the Ingles
cases.
c. City Manager
City Manager Irby had nothing at this time.
12. CITIZEN COMMENTS
Mike Hosmer, 630 Portside Lane, received clarification regarding a possible future agenda item.
Daniel Lewis, 100 Lewis Street, discussed meeting with Council and City Manager Irby.
13. ADJOURN
There being no further business to discuss, Mayor Depew adjourned the meeting at 7:18pm.
