LAND DEVELOPMENT AND REGULATORY AGENCY
REGULAR MEETING
THURSDAY, JANUARY 10, 1991
6:30 P.M.
COMMUNITY CENTER
Chairman C. Peter Hellsten called to order a regular meeting of
the Land Development and Regulatory Agency at 6:30 p.m.,
Thursday, January 10, 1991, in the Community Center.
ROLL CALL: Members present were Mr. Masso, Mrs. Blazi, Mr.
Fazzone, Mr. Hellsten, Mr. Klein, and Mr. Hildenbrand. Mr.
Garthwaite was excused. Also present were Mark P. Karet,
Planning and Zoning Director, and Beverly Kinney, Secretary.
NEW BUSINESS:
AN-0390 5.41 Acres: Mr. Karet stated that the property is
located on the west side of South Ridgewood Avenue, south of the
Silver Ridge Subdivision and north of Carter's Motel. Mr. Karet
added that the property is currently an enclave containing 5.41
acres with a land use designation in the county of urban low
intensity, and the property will maintain that designation until
a land use plan amendment is done within the city. Mr. Karet
stated that staff recommends approval of the annexation, and is
asking for a favorable recommendation to the City Council.
Mr. James Mackie. Hardin Place stated that the Utilities
Department was against the annexation. Mr. Karet stated that the
Utilities Department commented that servicing the site may be
difficult if the use is intense, but does not oppose the
annexation.
After some discussion the members agreed that they would like to
see a land use designation of commercial when the land use
amendment is done. Mr. Karet stated that once an agreement on
the comprehensive plan had been reached with DCA, amendments
could be made.
Mrs. Blazi moved to send the re~ommendation to the City Council
to approve the annexation request, seconded by Mr. Fazzone.
James Mackie. Hardin Place asked why the Agency and Planning and
Zoning Director kept referencing Volusia County. Mr. Karet
repeated that until a land use plan amendment is completed,
county regulations take precedent. Mr. Karet explained that this
is in accordance with state regulations.
Motion Carried 6-0.

Chairman's Reports: Mr. Hellsten reported that the Sign Ad Hoc
Committee is making progress, and they are currently reviewing
the APA and DCA model ordinances, and Boca Raton's sign
ordinance.
Mr. Hellsten stated he will not be able to attend the January
23rd meeting, because he will be in Orlando.

Aqency Member Reports: Mr. Fazzone discussed the lawsuit of
Marwin vs. the City of Edgewater. He stated that the federal
courts dismissed the case against the individuals with prejudice
and dismissal with immunity. Mr. Karet added that the case
against the city still stands, but the individuals are no longer
involved.
Mrs. Blazi stated that she realizes that people can get confused
by all the new state regulations regarding the city's growth
imposed by authorities who know nothing about this city, and have
probably never been here. Mr. Hellsten agreed there are problems
the state must face, but that is because small cities haven't
managed growth.
There being no further business, Mrs. Blazi moved to adjourn,
seconded by Mr. Hildenbrand. The meeting adjourned at
approximately 7:12 p.m..
