04-30-1990 Public Hearing/Special Meeting , ~ o CITY OF EDGEWATER LAND DEVELOPMENT AND REGULATORY AGENCY PUBLIC HEARING/SPECIAL MEETING MONDAY, APRIL 30, 1990 6:30 P.M. COMMUNITY CENTER Chairman C. Peter Hellsten called to order a public hearing/special meeting of the Land Development and Regulatory Agency regarding the comprehensive plan, Monday, April 30, 1990, at 6:30 p.m., in the Community Center. ROLL CALL: Members present were Mr. Bennington, Mrs. Blazi, Mr. Fazzone, Mr. Garthwaite, Mr. Hellsten, Mr. Klein, and Mr. Hildenbrandt. Also present were Mark P. Karet, Planning and Zoning Director, and Beverly Kinney, Secretary. Mr. Karet stated that the Planning and Zoning Department had received the Department of Community Affair's (DCA) objection, recommendation and comments (ORC) report on February 12th, and it was approximately ninety-three pages. Mr. Karet stated that in regard to internal consistency, DCA commented that the Future Land Use Map was inconsistent with the land suitability analysis. This was .addressed by providing additional information and clarifications. He stated the land use regulations for the P.I.D. district, located in the northwest corner of the city, will have to be rewritten to cover a hardwood hammock area. Ecotone marsh and mangrove areas will have to be noted as conservation. The School Board property (Mango Tree Drive) will be noted as medium density residential and the county owned property (Mango Tree Drive) will be noted as public/semi-public. Churches will be classified as public/semi-public to allow for more flexibility, because commercial designations are causing problems. Friendly Shores Mobile Home Park was designated low density residential/highway commercial. It is to be designated as medium density residential. Property on Carol-Ann Drive has been designated medium density, because a request for annexation has.been received by the city which the Agency will be hearing at the next meeting. Mr. Karet stated the intensity and density of commercial and industrial property in the Future Land Use Element, the annexation policy in the Housing Element, and the capital improvements projects, are addressed in the response document. Mr. Karet also discussed the adoption process, and the provisions for vesting of rights. Mrs. Blazi asked what will happen to the Code of Ordinances once the Comprehensive Plan is adopted. Mr. Karet stated that the Comprehensive Plan will take precedent. In regards to land development there was discussion about using land use designations in lieu of zoning districts. There was also discussion about the prohibition of septic tanks in new developments and the dispersement of septic tanks within Florida Shores. The members discussed the fact that they did not have enough time to review the response document prior this public hearing. There was further discussion about the short amount of time the members were given to review the response document. Mr. Fazzone asked what action the Agency was required to take. Mr. Karet stated that this public hearing was not required, and that the only public hearings required were at the Council level. The members asked to have their displeasure with the document and the rush to review it known to Council. Mrs. Blazi moved to continue this to another date so the members could have an opportunity to review the response document before making a decision. The motion was seconded by Mr. Fazzone. After some discussion, Mr. Klein moved to continue until the first meeting in May, seconded by Mr. Bennington. After further discussion Mr. Klein withdrew his motion and Mr. Bennington withdrew his second. Mr. Klein then moved to combine the May meeting and the continuance of this public hearing which will be held on May 9th beginning at 5:45 p.m.. Mr. Bennington seconded. Motion Carried 7-0.
