Chairman Nancy Blazi called to order a special meeting of the
Land Development and Regulatory Agency at 7:00 p.m., Monday,
August 28, 1989, in the Community Center.
The members met to discuss Section 606.01(d)(2)
Stores - Retail Sale of Gasoline.

Members Present were Mr. Bennington~ Mrs. Blazi, Mr. Garthwaite,
Mrs. Glover, Mr. Hellsten, Mr. Klein and Mrs. Martin. Also
present were Lynne Plaskett, Acting Planning and Zoning Director,
and Beverly Kinney, Administrative Secretary.
The members wanted to know who had requested the meeting be

called. Mrs. Plaskett stated she had spoken with the City
Attorney and the City Manager. She was asked to have the members
meet to discuss possibly amending Section 606.01(d)(2). This
section states "All requirements of Section 713.00 shall be
complied with". In Mrs. Plaskett's opinion, not all of the
requirements in Section 713.00 through Section 713.10.
(Automotive Services) pertain to convenience stores in
conjunction with the retail sale of gasoline. She wanted the
Agency to consider replacing the word shall with may so that each
request could be handled on a case by case basis. She added that
she had been unable to reach the Chairman, so the Vice-Chairman
was contacted to call the special meeting.
The members discussed the 750' required between the nearest
points on any two lots occupied for type A or B automotive
services at great length. The members reviewed possible reasons
for the requirement in the B-2 district such as fire safety and
the lack of adequate water to combat a fire in the area, and the
current traffic problems in the vicinity which will get worse as
the area is developed. It was also noted that there is only 700'
of B-2 zoning on S.R. 442 which would restrict the number of
businesses to sell gasoline.
