LAND DEVELOPMENT AND REGULATORY AGENCY
SPECIAL MEETING
TUESDAY, JULY 19, 1988
9:00 A.M.
CONFERENCE ROOM, CITY HALL
Chairman Nancy B1azi called to order a special meeting of the
Land Development and Regulatory Agency at 9:05 a.m., Tuesday,
July 19, 1988, in the conference room of City Hall.
ROLL CALL:
Members present were Mr. Bennington, Mrs. Blazi, Mrs. Glover, and
Mrs. Martin. Also present were Mrs. Plaskett, Planning Assistant/
Grant Administrator, Dennis Kelly, Interim City Manager, and Beverly
Kinney, Secretary.
APPROVAL OF MINUTES:
Mr. Bennington moved to approve the minutes of May 12, 1988, seconded
by Mrs. Glover. Motion Carried 5-0.
Mr. Klein arrived at the meeting at approximately 9:06 a.m.
OLD BUSINESS:
Code Enforcement: The Board agreed to moved this item further down
on the agenda, as the City Attorney was not yet present.
By-Laws: Mr. Bennington moved to approve as written, seconded by
Mrs. Martin. Motion carried 6-0.
Mr. Alvarez, City Attorney, arrived at the meeting at approximately
9:10 a.m.
Rezoning Request Edward Mull Tabled from July 14, 1988 Regular
Meeting: The Board discussed this item with Mr. Mull, Mr. Alvarez,
and Mr. Kelly. Mr. Bennington moved to deny the request based on
the fact that within the next year, hopefully, the Board would be
in the process of updating the City's ~and use plan. The Board would
consider the request as part of the overall rezoning at that time.
Mrs. Martin seconded the motion. Motion Carried 6-0.
Sheds on Commercial Lots: The Board discussed this item with Mr.
Geil, Mr. Alvarez and Mr. Kelly. Mrs. Martin moved that a shed
is a structure, submittal of site plans where applicable (zoning
district) will be required, and the applicant must state the use
of the shed. Mrs. Glover seconded. Motion Carried 6-0.
Belmont Plaza Injunction SP-8809 Luis Geil B-5: This item was
discussed with Mr. Katz, attorney for Mr. J.C. Carder, the City
Attorney, Mr. Kelly and the Board. Mr. Bennington moved to table
this while Mr. Alvarez pursued the matter regarding the City's
position, and to table any action on the site plan until the next
meeting. Mrs. Martin seconded. Motion Carried 5-0. Mr. Hardester
abstained and filed a conflict of interest form.
Off-Street Loading Zones: The Board discussed this lssue with Mr.
Alvarez and the Mr. Kelly.
SP-88l0 Metal Building Luis Geil 2018 Guava Drive B-2: Mr.
Bennington moved to approve the site plan pending the landscaping.
Mrs. Glover seconded. Motion Carried 6-0.
The Board took a recess beginning at 10:50 a.m. The meeting resumed
at 11:03 a.m.
The Board agreed to discuss height contradictions and lighting ln
commercial districts at a later date.

OLD BUSINESS continued:
Code Enforcement: There was a discussion regarding code enforcement
violations with the Board members, Mr. Alvarez and Mr. Kelly.
Two Meetings Per Month: The Board discussed holding two (2) meetings
per month, and agreed to set up a regular time and date at their
next meeting.
There being no further business to corne before the Board, Mr. Klein
moved to adjourn, seconded by Mrs. Martin. The meeting adjourned
at approximate 12:00 Noon.

to his special private gain. Each local officer also is prohibited from knowingly voting on a measure which inures to the special
gain of a principal (other than a government agency) by whom he is retained.
In either case, you should disclose the conflict:
PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on
which you are abstaining from voting; and
WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the person responsible for recording
the minutes of the meeting, who should incorporate the form in the minutes.
APPOINTED OFFICERS:
A person holding appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which
inures to his special private gain. Each local officer also is prohibited from knowingly voting on a measure which inures to the
special gain of a principal (other than a government agency) by whom he is retained.
A person holding an appointive local office otherwise may participate in a matter in which he has a conflict of interest, but must
disclose the nature of the conflict before making any attempt to influence the decision by oral or written communication, whether
made by the officer or at his direction.
