WHEREAS, on or about May 16, 2025, the City of Edgewater submitted its
application to Florida Commerce for a Small Cities Community Development Block
Grant (CDBG) seeking funding in the amount of $1,389,000 for Sewer Line
Replacement activities and Water Line Replacement activities; and
WHEREAS, on or about August 21, 2025, the Executive Office of Governor Ron
DeSantis issued a press release announcing the awards for CDBG grants to 19 small
and rural Florida communities; and
WHEREAS, the City of Edgewater's application was excluded from the grant
awards, despite demonstrating an application score within the "fundable range" for all
applications; and
WHEREAS, the City wishes to appeal the decision of Florida Commerce to
exclude the City's application from CDBG grant funding.
OF EDGEWATER, FLORIDA, as follows:
Section 1. The City Council of The City of Edgewater directs the City Attorney
to file a petition for administrative appeal and formal administrative hearing against Florida
Department of Commerce requesting funding reconsideration.
Section 2. The City Attorney, Mayor, and/or City staff, as necessary, are
authorized and directed to provide additional information in a timely manner as may be
required during the administrative appeal process.
Section 3. All resolutions or parts of resolutions in conflict herewith are hereby
repealed.
Section 4. If any portion of this Resolution is for any reason held or declared to
be unconstitutional, inoperative, or void, such holding shall not affect the remaining
portions of this Resolution. If this Resolution or any provisions thereof shall be held to
be inapplicable to any person, property, or circumstances, such holding shall not affect
its applicability to any other .person, property, or circumstance.
Section 5. This Resolution shall take place immediately upon its passage.
