01-15-1987 ~ o 0 CITY OF EDGEWATER BUILDING TRADES REGULATORY AND APPEALS BOARD January 15, 1987 Minutes - Regular. Meeting Chairman Howard called the regular meeting to order at 7:05 p.m. in the Community Center. ROLL CALL Members present: Messrs. Hall, Ogram, Cole and Howard. Also present: Mr. Fischer, Building Official and Beth Beeco, Secretary. APPROVAL OF MINUTES Mr. Howard asked the members if they had reviewed the minutes from the April 17, 1986 regular meeting. Mr. Cole made a motion to accept the minutes and Mr. Hall seconded. The motion was approved 4-0. ELECTION OF OFFICERS - Chairman and Vice Chairman Mr. Howard said before we begin with the election of officers he wanted to make it known to the Board members that Mr. Fred Vanzin had resigned effective January 14, 1987. He then read a letter from himself to the Board resigning his position effective January 16, 1987. Mr. Ogram wondered if we couldn't put off the election until after the Board vacancies were filled, but it was then noted we could not conduct business until after we had at least four members. After a brief discussion about filling vacancies and the election of temporary officers the board decided to elect permanent officers. A motion was made by Mr. Cole to nominate Les Ogram to the chairman position and was seconded by Frank Hall. There were no other nominations and the motion carried 4-0. Frank Hall nominated Doug Cole to the position of vice chairman and that motion was seconded by Robert Howard and carried 4-0. OLD BUSINESS - None NEW BUSINESS By-Laws Mr. Fischer spoke about item six of the by-laws concerning meeting dates and times and wondered if another day of the week or another time of day might not be more convenient because of the conflict with the Rotary Club meeting dates. The Board discussed it and the Rotary members stated that they had no problem making the meetings as the Board did not meet that often. Doug Cole made a motion to accept the by-laws as written and Les Ogram seconded. Motion passed 4-0. Procedures for filling vacancies The board reviewed the Council's recommendations for the procedure of filling vacancies. Review of applications for Board Membership and recommendation to fill vacancies The Board reviewed the application of Norman (Butch) Cox first. The Board members all were in agreement that Mr. Cox would be an ideal member. They then reviewed Mike Coleman's application and no one knew him personally. The Board. decided to review the other applicants before voting on Mr. Coleman. The Board reviewed the applications of the others and none of the members were familiar with the applicants. Mr. Cole said we really could make a better decision if we could talk to the applicants befor.e making recommendations to the Council. Mr. Howard called for a five minute recess at this time. The meeting was called back to session by Chairman Howard at 7:40. Mr. Cole made a motion that Norman Cox be immediately recommended for appointment to the Board. Les Ogram seconded. Motion carried 4-0. The Board decided that they should interview before appointing anyone else. Les Ogram made the motion that the city re-advertise for positions on the Board and the applicants be interviewed personally before the vacancies are filled. Frank Hall seconded. A discussion followed about the length of time it would take to advertise and they decided to set up a special meeting to be held 30-45 days from tonight. Mr. Ogram added to his motion that the Board would meet in a special meeting within 45 days. Motion passed 4-0. ~ o o Upcoming expiration of Board members terms - Les Ogram and Robert Howard Mr. Howard noted that he had resigned as of tomorrow so his term expiration was taken care of. He then stated it would give him great pleasure to nominate Les for another term. Doug Cole seconded the recommendation and all voted in favor of sending a letter of recommendation to the City Council for reappointment. MISCELLANEOUS - None ADJOURNMENT Mr. Hall motioned that the meeting be adjourned. Mr. Cole seconded. Meeting was adjourned at 7:49 p.m. (4-0). Minutes submitted by Beth Beeco -2- Building Trades Regulatory & Appeals Board Minutes - January 15, 1987 ~ 6 ~ BY-LAWS BUILDING TRADES REGULATORY AND APPEALS BOARD 1. The purpose and intent of these rules is to set forth procedures whereby the Building Trades Regulatory and Appeals Board may elect officers, conduct meetings and hearings. See Article 1 of the Edgewater Code. 2. All members shall take the oath of office. 3. The Chairman shall serve as presiding officer at all meetings and hearings. The Chairman shall be elected by a majority of the membership and the term of office shall be one year. The Chairman shall be eligible for reelection. The Chairman shall transmit reports, plans and recommendations of the Board to the City Council and in general shall act as spokesman for the Board. 4. The Vice Chairman shall be elected by a majority of the members in the same manner as the Chairman and shall be eligible for reelection. The Vice Chairman shall serve as acting Chairman in the absence of the Chairman and at such times shall have the same powers and duties as the Chairman. In the event of the death or resignation of the Chairman, the Vice Chairman shall become Chairman for the unexpired term, and the Board shall elect a new Vice Chairman for the remainder of the term. 5. The secretary shall be assigned to the Building Trades Regulatory and Appeals Board from among appropriate personnel at City Hall. It shall be the duty of the secretary to see that all correspondence, approved minutes, files, tapes and records are properly kept. The duties of the office shall include the preparation of agendas, preparation and sending out of minutes, and to coordinate contacts between the Building Official, applicants, other Boards and the Building Trades Regulatory and Appeals Board, and such other duties as the Board may assign. 6. Meetings - At the call of the Chairman, regular meetings will be held quarterly at 7:00 p.m. on the third Thursday in January, April, July and October in the Community Center. The Chairman may also call special meetings, workshop meetings, recess meetings, reconvene, or adjourn meetings and hearings required by time or circumstance. A. Notice of Special or Workshop meetings: Special meetings may be called at any time by the written request of any two (2) members of the Board. Three days notice of the time and place of any special meetings shall be given to each member of the Board, the City Clerk, Department Heads, Council Members, press and others who are required to attend the Board meetings. B. Continued meetings: If all of the business of a regular or special meeting or hearing cannot be conducted on the advertised date, no further public notice shall be necessary for resuming such meetings, provided the time, date and place of resumption is stated at the time of the continuance. C. Cancellation of meetings: Whenever there is no business for the Board, or whenever a majority of the members notify the secretary of inability to attend a meeting, the Chairman may dispense with the regular meeting or hearing by having the secretary give written or oral notice to all members not less than twenty-four (24) hours prior to the time set for the meeting or hearing. Said notice shall be posted in a conspicuous place within or at the scheduled meeting chambers and the press shall be notified of the cancellation. 7. Absences - Since members are unpaid volunteers, contributing their time and efforts, it is essential that all share equally in the consideration and decision of matters before the Board. Absences put an unfair burden on the remaining members, as well as lessening the hearing rights of the applicants, and indicating a lack of interest or inability to attend on the part of the absent member. Therefore, it is the policy of this Board to consider it an automatic resignation for a member to be absent without prior notification for three successive regular meetings. Page Two By-Laws Building y .1. U Trades Regulatory and Appeals Board 8. Quorum - Four members shall constitute a quorum for the conduction of business. 9. Voting - It shall require a majority vote of the quorum to take any action that is within the jurisdiction of the Board. 10. Membership - The Board shall consist of seven (7) members, whenever possible, composed of: one general contractor at large, one journeyman or master electrician, one plumber and gas installer, one architect, one mechanical installer, one engineer and one at large from the construction trade. 11. Vacancies - Whenever a vacancy occurs on the Board by way of the terms of a member expiring, the Board shall make one or more recommendations as to nominations for the positions to be filled. Said recommendations shall be in written form and shall be turned in to the City Clerk at least sixty (60) days prior to the vacancy. Whenever a vacancy occurs not due to expiration of a term, said Board shall make its recommendations within forty-five (45) days after being notified of said vacancy. 12. The Building Trades Regulatory and Appeals Board shall perform the following duties: A. Hear appeals and apply adjustments to any ruling or order of the Chief Building Official. The decision of the Board upon any such appeal shall be final, subject, however, to such remedy as any aggrieved party might have in law or in equity. B. To determine that applicants for certificates of competency or certificates of registration have the requisite qualifications, and to revoke or rescind certificates of competency or registration where that person is found to be incompetent. C. To satisfy itself as to the character and integrity of each applicant for a certificate of competency or a certificate of registration and to require such pertinent information as it may deem necessary. D. To recommend amendments to the various codes and regulatory standards that have been adopted by the City Council that bear upon the construction industry and building trades in general. E. Said Board reserves the right to satisfy itself as to the character, integrity and experience of any person or persons applying for the position of Building Official prior to being interviewed and/or hired by the City Council, and reserves the right to make recommendations on said person prior to hiring.
