04-17-1986 ~ ~ , CITY OF EDGEWATER BUILDING CODE BOARD April 17, 1986 Minutes - Regular Meeting Vice Chairman Les Ogram called the regular meeting to order at 7:00 p.m. in the Community Center ROLL CALL Members present: Douglas Cole, Fred Vanzin, Les Ogram. Also present: Mr. Fischer, Building Official and Beth Beeco, Secretary. Mr. Howard was absent. APPROVAL OF MINUTES Mr. Ogram asked the members if they had reviewed the minutes from the January 16, 1986 regular meeting. Mr. Vanzin made a motion to accept the minutes as submitted. Mr. Cole seconded and the motion was approved 3-0. OLD BUSINESS Review of Code Board's duties and responsibilities Ordinance - Mr. Ogram asked how involved the members wanted to get in reviewing the ordinance. Mr. Cole said we had already gone over the ordinance and discussed it previously. Mr. Fischer asked if the Surity Bond was in the ordinance because this was on the agenda for new business. It was noted that this issue was addressed on Page 11 of the ordinance. Mr. Cole stated that we had discussed dropping the surity bond requirement and decided to keep it. It only pertains to damaging the sidewalks, etc., and although it isn't much it would help if something was torn up. It was discussed that we were one of the only cities that still required the surity bond, and it costs the contractors about $50.00 per year. The Home Builders Association had asked that it be removed last year and Giles Electric was on the agenda tonight asking for the same. Mr. Ogram stated at a previous meeting we decided to keep it, so there is no real need to discuss it. The secretary mentioned that at the last meeting we had discussed removing from Sect. 7-348 Unlawful Activities (8) Failure to fulfill contractual obligation through inability to pay creditors for material furnished or work or services performed in the operation of his business for which he is licensed hereunder. A motion was made by Doug Cole to strike that and was seconded by Fred Vanzin. Motion passed 3-0. Section 7-352 Certificate of Registration was discussed. Mr. Fischer stated he was pleased to have this in the ordinance because it requires the subcontractors to be insured as well as registered. Mr. Vanzin stated that you can lose your state license as a contractor if you hire un-insured sub-contractors. Mr. Vanzin made a motion to forward the ordinance as amended to the City Attorney and the motion was seconded by Les Ogram. Motion passed 3-0. NEW BUSINESS Review of Ordinance 86-0-10 Noise from construction equipment - It was noted that the ordinance was changed a bit from the way it was submitted. Also a letter was received from Mrs. Vann and it was noted that she was disturbed by what was done. The members said they were suprised that the traffic on the Boulevard was not a complaint by her, as that noise and traffic goes on all day and night. She has no more building lots near her home and she was the only person who complained about construction noises. The board also noted that the council put the hour up one hour from 7:00 am to 6:00 am. The board asked the secretary to send a memo to the council thanking them for their efforts on this ordinance. Building Code Board April 17, 1986 Minutes-Regular Page Two ~ Meeting ~ NEW BUSINESS (Continued) Letter from Giles Electric - Mr. Ogram said we discussed and reviewed this in the earlier part of the meeting and we decided to continue with the bond. A memo was to be sent to them thanking them for their interest but stating the board would be continuing with the surity bond. MISCELLANEOUS Mr. Cole asked about new members and when would we go to seven members. Mr. Fischer said with this adoption we need a Mechanical person and another at large member. It was noted that this would only be after the second reading of the ordinance. Mr. Ogram brought up a question he has had about licensed contractors (particularly electrical) using and leaving unlicensed personel to do the work. Also about people in business that are not qualified to be in business. An example was a father who had retired and left the son in charge and then had no further interest in the business other than the license being in his name. Mr. Ogram stated he was required to hire journeyman electricians and if the other companies are hiring laborers at $4.50 an hour this presents an unfair advantage to the other companies. Mr. Ogram said that things were getting better in Edgewater and he just wanted to mention this problem. Mr. Fischer said he would write and ask for a clarification of this matter.
