Building Code Board
September 21, 1983
Minutes
Mr. Fred Vanzin, Secretary, called the special meeting to order at 7:05 p.m.
in the Community Center.
Members present: Messrs. Cole, Hall, Troutner and Vanzin. Excused: Mr.
Howard. Also present: Joan Taylor, Secretary, and Lorin Coppock.
APPROVAL OF MINUTES
A motion was made by Mr. Hall and seconded by Mr. Cole to approve the minutes
of the July 21, 1983 meeting. The motion CARRIED 4-0.
OLD BUSINESS
Floor height of buildings
The secretary explained that at the April 21st meeting ,---the members discussed the
Building Official's recommendation that an additional paragraph be added to
the Board's request to Council that floor elevatiornbe lowered. This would
read, "to show a flow plan for the water run-off with the application for
the building permit, or a plot plan that must show an acceptable water flow
plan." The Board had approved adding this to their motion which was to be
taken care of at the July 21 meeting, after the Board had time to study the
issue further. At the July '21 meeting, the motion reo floor elevations was
made, but the recommendation of the Building Official was not included in
the motion. This meeting tonight was called to reconsider the motion and to
clarify it and the reasons for it when making the recommendation to Council.
The members discussed this recommendation of the Building Official. Mr. Cole
felt that this requirement would create problems for the builder, and the
other members generally agreed. They believed it would be difficult to know
which way the water would flow at the time they applied for a building permit.
They felt this could be misintrepreted to mean that an engineer would have to
lay it out. The Vanzin pointed out that the Health Department wants the houses
up because of the septic tanks. They agreed the drainage is a problem, but
they felt putting this in the Code would create problems also. Mr. Vanzin
noted that the property owner is responsible for the water on his property.
The members felt that this should not be included in their motion.
Mr. Hall motioned to delete the additional paragraph to the motion on the
floor height of buildings which had been recommended by the Building Official.
The motion was seconded by Mr. Troutner and CARRIED 4-0.
Approval by a State certified subcontractor for work prepared by the owner
There was a lengthy discussion of the recommendation that owner/builder's work
be approved by a State certified or registered subcontractor. They commented
that the owner/builder often thinks he is ready for an inspection, when he is
not and the building inspector must return again and again for an inspection.
The Coppock commented that he felt it would be difficult to get a certified
contractor to sign off on a job which he had not been following. The members
discussed the responsibility of the certified subcontractors and if this would
open them up for lawsuits. Mr. Coppock remarked that an owner/builder could
not do their own electrical work in New Smyrna Beach. They generally agreed
that if the building inspector was thorough there should be no need for a
certified subcontractor to sign off. Mr. Troutner said he would not be
inclined to jeopardize his license by signing off on a job he had not done.
They agreed that if this recommendation went into ordinance form, they would
have to document for the building office that they had inspected it. It was
brought out that it was Mr. Charlie Murphy's recommendation, as he did not feel
the building inspector could be an expert in all three fields: electrical,
mechanical and plumbing. Mr. Vanzin commented that in a court of law, he
felt the man who inspected the work for the home owner would be held responsible.
The members felt that the electrical was the most important. They suggested
getting a copy of the New Smyrna Beach ordinance governing electrical work.

Mr. Hall made a motion to table this matter until the next meeting, and to
obtain a copy of the New Smyrna Beach ordinance referred to by Mr. Coppock.
The motion was seconded by Mr. Troutner, and CARRIED 4-0. Mr. Coppock said
he would pick up a copy of the ordinance and see that Mr. Howard gets it.
MISCELLANEOUS
The members discussed the procedure for hiring a Building Official. Mr. Hall
said that it was his understanding that if people have a problem with the
Building Official that they should appeal to the Building Code Board; he
thought it was part of the Board's duties. Mr. Cole commented that perhaps
the Council should have referred complaints to the Board; the Board could
have talked to the Building Official to see what the problems were. They
referred to the Southern Standard Building Code.
The meeting was adjourned at 8:35 p.m.
