04-14-1981 Special ~ u ~ THE BUILDING CODE SPECIAL MEETING APRIL 14, 1981 EDWIN HALL 513 N. RIVERSIDE DRIVE Chairman Austin called the special meeting of the Edgewater Building Code to order at 3:04 P.M. in the board room at City Hall. ROLL CALL . Rocky Bouchard Ronnie Austin Fred Vanzin Joseph Troutner Frank Hall Present Present Present Present Present City Attorney Henderson stated that the purpose of this meeting was to hear all parties on the stop work order that was placed on the house under construction at 513 N. Riverside, Mr. Edwin Hall is the owner. Mr. E. Hall has appealed the Building Official's stop work order and he has the right to appear before this board according tb the Edgewater Code of Ordinances. City Attorney Henderson stated that the position of the board at this time is to hear reasons for the order as given by Mr. Murphy, the Building Official and to take testimony of the relevant damaged individule and any other interested parties. After hearing such. testimony, the Board would have the authority to reverse the order or to make such variation or modification of the code as it would deem possible. He read from the section of the Southern Standard Building Code the variations and modifications. City Attorney Henderson stated at this time Chairman Austin should ask for the Building OfficiaYs testimony. Building Official Charles Murphy told the board he had received several complaints for Edgewater citizens ~hat this house was b~ing built too high. He went on to say that he was not sure it was too high ,and Mr. E. Hall was asked to supply him with a letter stating the average height of the building. Mr. Murphy has not received this yet;however he does believe that Mr. E. Hall has had this done. Mr. Murphy went on to say that he had put a red sticker (a stop order) on the construction of this house. Mr. Murphy stated that the Edgewater Code is the same as the Southern Standard Building COde. The Edgewater Code Section 200.00 reads as follows: BUILDING HEIGHT The vertical distance measured from the average elevation of the proposed finished grade along the front of the building to the highest point of a flat roof, or to the deck line of a mansard roof, or to the average height level between eaves and ridge for gable, hip, and gambrel roofs. The Southern Standard Building Code page 2-5 HEIGHT reads as follows: .as applied to a buildi~g, means the vertical distance from grade to the highest finished roof surface in the case of flat roofs or to a point at the average height of roofs having a pitch of more than one (1) foot in four and one-half (4~) feet; HEIGHT of a building in stories does not include basements and cellers, except as specifically provided otherwise. At this point Mr. E. Hall was asked to give his testimony. Mr. E. Hall stated that he did not feel this necessary, however he told the board that he was issued a building permit by the Building Official afer he submitted a set of plans. .., Page 2 0 Special Building C~ April 14, 1981 Q Mr. Murphy stated that the height of the building in question is 21.68 feet above the crown of the road and that is less then the 22 feet requirement. There was some discussion on the plans after Mr. E. Hall presented them. Chairman Austin asked Mr. E. Hall if he was a certified surveyor? Mr. E. Hall stated that he is. Mr. Bouchard asked Mr. E. Hall if all the prints and specifications were brought in when he applied for the permit. Mr. E. Hall stated that they were. Chairman Austin asked Mr. Murphy if he had approved these plans. Mr. Murphy stated that he did. Chairman Austin asked if anyone else approved the plans. Mr. Murphy stated that he was the only one who approved the plans. Mr. E. Hall stated that the Council voted on the plans also. City Attorney Henderson explained that the City Council voted on the construction of a two story house. This house was constructed pursuant to a zoning amendment passed by the previuos council which allowed two story construction in the R-I-A zoning district; East of Riverside Drive. Mr. E. Hall was infact the last person to walk into the office with a set of plans Lor a two story house, prior to the adoption of the amendment to the zoning ordinance by the present council. The Council voted to allow Mr. E. Hall to build a two story home. Mr. Bouchard stated that Mr. E. Hall was issued a building permit to construct this house and the house is up. He stated that he does not think we can ask the man to tear it down. Mr. Bouchard made a motion to let Mr. E. Hall finish his house. He went on to say that the next time this happens the board should be given the prints to study before the permit is issued. City Attorney Henderson stated that we are locked into procedures which we must follow. Your motion would be to reverse the decision of the Building Official in regards to the stop order that was placed on the building. Then approve the plans as submitted to the board and allow Mr. E. Hall to continue construction of the house under the supervision of the Building Official to make sure that all standards are met. Mr. Bouchard made a motion to that effect, being seconded by Mr. F. Hall. Chairman Austin asked if there was any more testimony on this subject? Mr. F. Hall stated that he thinks we should ask Mr. Murphy if he agrees with Mr. E, Hall on the way they came up with the height. Mr. Murphy stated that this house consists of several roofs and we have to go by an average; you can't go by the one at the top. Mr. Murphy stated that he did not feel there was any problem from the start. Mr. Murphy stated that when the Zoning Board goes through the zoning ordinance to bring it up to date this should be cleared up. Chairman Austin made a recommendation that this be sent to the Zoning Board for their consideration. The board felt that it would be good to discuss this at the next regular meeting and then send it to the Zoning Board. City Attorney Henderson stated that before we go any further we have a main motion on the floor ana we should consider any more public comments pertaining to that motion. ~ ~ Q Page 3 Special Building Code Meeting April 14, 1981 Chairman Austin asked that the motion be repeated. Mr. Bouchard stated his motion; that we allow Mr. E. Hall to continue with hi~ building and let him finish it under the supervision of the Building Official. Mr. F. Hall made the second. Upon roll call vote CARRIED 5-0. City Attorney Henderson announced thei establishment of the Code Enforcement Board. The council is asking interested citizens to submit resumes. There was a brief discussion with a gentleman from Bayview Plumbing in regards to the Building OfficiaTs inspection procedures. Chairman Austin suggested that the gentleman get with Mr. Murphy and see if they could come to an understanding on the way the inspections are being handled. Chairman Austin told the man if he still had problems to attend the next board's regular meeting. There was no more business and the meeting was adjourned.
