BUILDING CODE BOARD REGULAR MEETING
August 19, 1980
Chairman Pilch called the regular meeting of the Building Code to
order on August 19, 1980 in the City Clerk's office.

APPROVAL OF MINUTES
Mr. Harris made a motion to accept the minutes of the regular meet-
ing of July 15, 1980. Mr. Cole seconded the motion. Motion CARRIED
4-0.
COMMUNICATIONS
The memo from the City Clerk to the City Council on reviewing of
the tape recording of the July 15, 1980 Building Code Board meeting
was read by the board. Information only.
The letter to the Council for the Building Code Board concerning the
appointing of Mr. Pilch as Chairman and Mr. Troutner as Vice Chair-
man of the Board. Information only.
The letter to the City Council concerning the Building Official from
the Building Code was read by the board. Information only.
Chairman Pilch stated that we must elect a secretary from the Board.
The by-laws call for a secretary. Mr. Cole made a motion to have
Mr. Hall act as secretary for the Building Code Board. Mr. Harris
seconded the motion. Motion CARRIED 4-0. Mr. Hall will act as
secretary of this board.
REPORTS
None
OLD BUSINESS
There was much discussion on the progress report on the Corbett
Smith property. The board asked to have the City Attorney give a
report to when the agreement took place and when the 90 days will
be up. A letter is to go to Judson woods on this.
NEW BUSINESS
Chairman Pilch brought to the attention of the board that there is
an apparent discrepency between the Southern Standard Building Code
and our City Charter on the Quorum. On pages 1-13 of the Southern
Standard Building Code Section 111.3 Quorum, three (3) members of
the board shall constitute a quorum. In verifji'ngl the application
of any provisions of this code or in modifying an order of the
Building Official, affirmative votes of the majority present, but
not less than three (3) affirmative votes shall be required. A
board member shall not act in a case in which he has a personal in-
terest.
In the Edgewater Code of Ordinances it reads, page 479 Section 7-5,
SAME organization quorum.
The Board of Adjustments and appeals shall desi9nate of elect one

of its members to act as secretary, to file copies of the minutes
of the meeting with the office of the City Clerk. Four (4) members
of said board shall constitute a quorum. Affirmative vote of major-
ity of said board present at a meeting shall be necessary to adopt
any ruling. A letter to this affect will go to the Attorney. Mr.
Cole made a motion that a letter go to the Council bringing this to
their attention. Mr. Hall seconded the motion. Motion CARRIED 4-0.
Chairman Pilch brought up the licenses of various trades people.
Mr. Hall is getting information from Broward County on this.
Chairman Pilch asked Mr. Murphy how do we go about getting to know
that the people are licensed by the City are qualified to do the job.
Mr. Murphy stated that there is no way of knowing carpenters or dry-
wall. Mr. Murphy stated that plumbers, electricians, air condition-
ing people we do have an accuate check on them through their employ-
ers. We require the Masters to have cards and the Journeyman have
cards. We have not had any problems with this. The carpenters are
in and out. We do not requirer a carpenter to have cards. Mr. Harris
stated that he thinks what Mr. Pilch is thinking about is that we
have had a couple of complaints about you come in to take out a
permit and you put down a certian contractor and then they do not
know their name is on their. Then they get someone that may not
even have a license to do the work and Frank's name is put on there
and as far as the City knows Frank is doing the work. Mr. Murphy
stated he had found a couple of contractors we found out that they
were legitiment. Mr. Holahah stated that sometimes we run into a
problem where we have Frank as the plumber and we try and get Frank
out there and he doesn't get there so we call Walton Piser to come
in and do the job. This is after the permit is taken. There was
some discussion on this.
Chairman Pilch asked what exams were required for this. Mr. Murphy
stated that mainly block. In air conditioning there is none. Taking
certified exams or plumbing is block the elect is block the State is
just getting into plumbing registeration and certification. The
Block exam is the main one.
Mr. Harris asked if he had a license to build in Edgewater and there
are builders that don't have a license, how many of them can I buy
permits for? How many companies can I legally buy for? Mr. Murphy
stated that as long as you are running their work it does not make
any difference. You can be qualified for two companies. A person
who builds a house is not a contractor unless he has a license.
Mr. Hall stated that the State Inspector stated that you can regis-
ter two companies, you can take permits out in one name and one
corporation or two corporations.
Mr. Hall made a motion to adjourn. Mr. Cole seconded the motion.

SUBJECT: Discrepency between Southern Standard Buiding
Code and the Edgewater Code of Ordinances
At the regular meeting of August 19, 1980. There was
a discussion on the discrepency between the Southern

Re: Corbitt Smith - Marion Street Property
Dear Ed:
As you may remember, Mr. Smith represented to our Building Code
Board of Adjustments on June 18, 1980 that he would take action
to correct the conditions existing on his property at Marion St.,
which conditions do not meet the standards of our Building Code.
For your information I am enclosing a copy of. those minutes.
As you can see, certain action was to be taken within thirty
days, specifically the razing of Building .B and the correction
of other unsafe conditions on the other buildings. You. will
note that all work was to be completed within ninety days. . As
I compute it, the ninety days will expire September 16,1980.
I would like for you to send me a full report of what action has
been taken by Mr. Smith to correct these deficiencies so that I
may report same to the Building Official and to the Building Code
Board of Adjustments. If all deficiencies are not corrected by
the above stated date, that is September 16, 1980, please be ad-
vised that it will be necessary to take legal action against
Mr. Smith.

Memo from: Building Code Board
Subject: Corbett Smith
At the regular meeting of the Building Code Board held
on August 19, 1980. The Board members decided to ask
the City Council to find out the progress of the Corbett
Smith case from the City Attorney.
We would also like to know when the agreement with Mr.
Smith took place and when will be the completion date
of this job.
