CITIZENS CODE ENFORCEMENT BOARD
REGULAR MEETING

CALL TO ORDER:
Chairman George Cowan called to order the regular meeting of the
Citizens Code Enforcement Board at 7:00 p.m., Thursday, March 19,
1992.
ROLL CALL:
Members present were Chairman George Cowan, Mr, Bennington, Mr.
Munson, Mr. Christian, Mrs. Strong, Mrs. Borner and Mrs. Cucanich.
Also present were Beverly A. Kinney, Code Enforcement Officer, Mark
P. Karet, Director of Community Development, Krista Storey, City
Attorney and Tonya Elliott, Secretary.
APPROVAL OF MINUTES:
Mrs. Cucanich made a motion to approve the minutes of February 20,
1992. Seconded by Mrs. Borner. Motion CARRIED 4-0. Mr.
Bennington, Mr. Christian and Mrs. Strong abstained as they were
excused from the February 20, 1992 meeting.
CASES IN COMPLIANCE:
Code Enforcement officer Beverly A. Kinney reported the following
cases withdrawn or signed in compliance:
Case # 91-CE-2527 - Jimmy Owens - in compliance
Case # 92-CE-0212 - Miguel A. Retaca - in compliance
Case # 92-CE-0277 - John Depew - in compliance
UNFINISHED BUSINESS:
None at this time.
NEW BUSINESS:
Chairman George Cowan requested Code Enforcement Officer Beverly
A. Kinney, and anyone else with statements or comments pertaining
to any of the cases stand and be sworn in.
CASE # 91-CE-2374 - Jimmy Owens - Weeds in excess of two (2) feet.
Section 10-43. Various items discarded on property. Section
717.03. Code Enforcement Officer Beverly Kinney reported the
violations were first observed on June 27, 1991 and to be corrected
by December 6, 1991. Upon reinspect ion of the property on December

6, 1991, Ms. Kinney found that no corrective action had been taken.
Ms. Kinney passed photographs to the board dated September II, 1991
and March 19, 1992. Ms. Kinney stated that on March 19, 1992, a
second inspection was performed and the weeds had died and were now
in compliance. Ms. Kinney recommended the violator be given until
Monday, April 6, 1992 to remove the discarded items from the
property or a fine of thirty dollars ($30.00) a day be imposed.
Mrs. Borner, after hearing the testimony presented and the
recommendation of Staff, moved in reference to Case Number 91-CE-
2374 that a violation of Section 717.03 of the Edgewater Zoning
Ordinances does exist and the alleged violator has committed the
violation. After considering the gravity of the violation, any
actions taken by the violator to correct the violation, and any
previous violations committed by the violator, further moved that
the violator be given until April 6, 1992 to correct the violation
and that a fine of fifteen dollars ($15.00) a day be imposed for
each day the violation continues past that date. Mrs. Strong
seconded the motion, amending the fine amount of fifteen dollars
($15.00) a day to thirty dollars ($30.00) a day. Amendment
seconded by Mrs. Borner. Motion CARRIED 7-0. Amendment CARRIED
7-0.
CASE # 91-CE-2375 - Jimmy Owens C/O Elenora Thompson - Weeds in
excess of two (2) feet. Section 10-43. Code Enforcement Officer
Beverly Kinney reported the violation was first observed on
September 3, 1991 and was to be corrected by December 6, 1991.
Upon reinspection of the property on December 6, 1991, Ms. Kinney
found that no corrective action had been taken. Ms. Kinney passed
photographs to the board dated September 3, 1991 and March 19,
1992. Ms Kinney stated she has had no contact with the owner of
the property and recommended the violator be given until Monday,
April 6, 1992 to cut the weeds on the property or a fine of fifteen
dollars ($15.00) a day be imposed.
Mr. Christian, after hearing the testimony presented and the
recommendation of Staff, moved in reference to Case Number 91-CE-
2375 that a violation of Section 10-43 of the Edgewater Code of
Ordinances does exist and the alleged violator has committed the
violation. After considering the gravity of the violation, any
actions taken by the violator to correct the violation, and any
previous violations committed by the violator, further moved that
the violator be given until April 6, 1992 to correct the violation
and that a fine of fifteen dollars ($15.00) a day be imposed for
each day the violation continues past that date. Mrs. Strong
seconded the motion, amending the fine amount of fifteen dollars
($15.00) a day to twenty-five dollars ($25.00) a day. Amendment
seconded by Mr. Munson. Motion CARRIED 6-1. Amendment CARRIED 7-0.

pertaining to case #92-CE-0183 stand and be sworn in.
CASE # 92-CE-0183 - Joseph A. Kopec - Blue Sedan with no tag.
Section 10-64. Code Enforcement Officer Beverly Kinney reported
the violation was first observed on January 29, 1992 and was to be
corrected by February 9, 1992. Upon reinspection of the property
on February 10, 1992, Ms. Kinney found that no corrective action
had been taken. Ms. Kinney passed photographs to the Board dated
January 22, 1992 and March 19, 1992. Ms. Kinney stated she has had
no contact with the property owner during this time. Ms. Kinney
recommended the violator be given until April 6, 1992 to correct
the violation by obtaining a current license plate or remove the
vehicle from the property, or a fine of thirty dollars ($30.00) a
day be imposed. Mr. Kopec, 1107 Live Oak Street, New Smyrna Beach,
Florida, began by attempting to bring his previous cases before the
Board. Mr. Karet informed Mr. Kopec that pervious cases could not
be heard at this meeting and recommended that Mr. Kopec submit in
writing, a request for the cases to be placed on the next agenda.
Mr. Kopec then stated the blue sedan was on the property for
repairs. There was discussion among the Board and Mr. Kopec on how
long the repairs would take.
Mr. Bennington, after hearing the testimony and recommendation of
Staff, moved that the blue sedan has been on the property for over
30 days with no tag and that a violation of Section 10-64 of the
Edgewater Code of Ordinances does exist and further moved that the
violator be given until April 6, 1992 to correct the violation or
a fine of thirty dollars ($30.00) a day be imposed for each day the
violation continues past that date. Seconded by Mrs. Strong.
Motion CARRIED 7-0.
CASE # 92-CE-0202 - Jimmy Owens - Discarded tires, furniture, and
other unknown items on property. Section 717.03. Code Enforcement
Officer Beverly Kinney reported the violation was first observed
on January 28, 1992 and was to be corrected by February 14, 1992.
Upon reinspection of the property on February 15, 1992, Ms. Kinney
found that no corrective action had been taken. Ms. Kinney passed
photographs to the Board dated March 12, 1992 and March 19, 1992.
Ms. Kinney stated the property owner made no attempt to contact the
office and recommended the violator be given until April 6, 1992
to remove the tires, furniture and other items from the property
or a fine of twenty-five ($25.00) a day be imposed.
Mr. Munson, after hearing the testimony presented and the
recommendation of Staff, moved in reference to Case Number 92-CE-
0202 that a violation of Section 717.03 of the Edgewater Zoning
Ordinances does exist and the alleged violator has committed the
violation. After considering the gravity of the violation, any

actions taken by the violator to correct the violation, and any
previous violations committed by the violator, further moved that
the violator be given until April 6, 1992 to correct the violation

seconded the motion, amending the fine amount of twenty-five
dollars ($25.00) a day to thirty dollars ($30.00) a day. Amendment
seconded by Mr. Munson. Motion CARRIED 7-0. Amendment CARRIED 7-0.
CASE # 92-CE-0270 - Curtis and patricia Williams, Sr. - Stacks of
tires on property. Section 717.03. Code Enforcement Officer
Beverly Kinney reported the violation was first observed on
February 12, 1992 and was to be corrected by February 24, 1992.
Upon reinspection of the property on February 24, 1992, Ms. Kinney
found that no corrective action had been taken. Ms. Kinney passed
photographs to the Board dated February 12, 1992, March 13, 1992
and March 19, 1992. Ms. Kinney reported that Mr. Williams
contacted the office on March 13, 1992 and stated the tires were
not on his property, but were on FEC' s property. Ms. Kinney
contacted FEC on March 13, 1992 and they removed all but four (4)
tires, which they stated were in fact on Mr. Williams property.
Ms. Kinney stated she then spoke with Mr. William's son, who said
the tires would be removed and that his father had gone out-of-
town. Mrs. Kinney recommended the violator be given until April
6, 1992 to remove the remaining tires from the property or a fine
of thirty dollars ($30.00) a day be imposed.
Mrs. Cucanich, after hearing the testimony presented and the
recommendation of Staff, moved in reference to Case Number 92-CE-
0270 that a violation of Section 717.03 of the Edgewater Zoning
ordinances does exist and the alleged violator has committed the
violation. After considering the gravity of the violation, any
actions taken by the violator to correct the violation, and any
previous violations committed by the violator, further moved that
the violator be given until April 6, 1992 to correct the violation
and that a fine of thirty dollars ($30.00) a day be imposed for
each day the violation continues past that date. Seconded by Mrs.
Strong. Motion CARRIED 7-0.
DISCUSSION ITEMS:
Mr. Bennington said he would be unable to attend at least the next
three (3) meetings and therefore was rendering his resignation from
the Citizens Code Enforcement Board.
Mr. Karet informed the Board that due to Council action, Code
Enforcement was on a complaint system and would be handled by one
(1) Code Enforcement Officer. Mr. Karet said that Charlane Runge
was now the full-time Safety Officer.

None at this time.
ADJOURNMENT:
There being no further business to come before the Board, a motion
was made and accepted to adjourn. The meeting adjourned at 8:04
p.m.
