CITY OF EDGEWATER CITIZENS CODE ENFORCEMENT BOARD REGULAR MEETING JANUARY 16, 1992 COMMUNITY CENTER, CITY HALL 7:00 PM CALL TO ORDER: Chairman George Cowan called to order the regular meeting of the Citizens Code Enforcement Board at 7:00 p.m., Thursday January 16, 1992. ROLL CALL: Members present were Chairman George Cowan, Mr. Bennington, Mr. Munson, Mr. Christian, Mrs. strong, Mrs. Borner and Mrs. Cucanich. Also present were Char lane Runge, Code Enforcement/Safety Director, Beverly A. Kinney, Code Enforcement Officer, Mark P. Karet, Director of Community Development, Krista Storey, City Attorney and Tonya Elliott, Secretary. APPROVAL OF MINUTES: Mrs. Cucanich made a motion to approve the minutes of November 21, 1991. Seconded by Mrs. Borner. Motion CARRIED 7-0. Chairman George Cowan requested anyone with statements or comments pertaining to a case stand and be sworn in. Code Enforcement Officer Charlane Runge reported the following cases withdrawn or signed in compliance: Case # 91-CE-2388 - Ponderosa Homes - in compliance Code Enforcement Officer Beverly A. Citizens Code Enforcement Board January 16, 1992 Page -2- NEW BUSINESS: CASE # 91-CE-2020 - Pheobe & Zora pyevac Lambert - Mattresses, hot water heater , furniture and other discarded items. Section 717.03. Code Enforcement Officer Beverly Kinney reported the violation was first observed on May 28, 1991 and was to be corrected by November 4, 1991. Upon reinspection of the property on November 5, 1991, Ms. Kinney found that no corrective action had been taken. Ms. Kinney passed photographs to the board dated May 29, 1991 and January 16, 1992. Ms. Kinney reported that on January 16, 1992, the owners nephew, Steve Campbell, came to see her and said he would have the violation corrected by January 20, 1992. Ms. Kinney recommended the violator be given until Friday, January 24, 1992 to correct the violation or a fine of thirty dollars ($30.00) a day be imposed. Mr. Bennington, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 91-CE- 2020 that a violation of section 717.03 of the Edgewater Code of Ordinances does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until January 24, 1992 to correct the violation and that a fine of thirty dollars ($30.00) be imposed for each day the violation continues past that date. Seconded by Mr. Christian. Motion CARRIED 7-0. CASE # 91-CE-2056 - Jimmy Owens c/o Hershal Morris - Weeds in excess of two (2) feet. section 10-43. Code Enforcement Officer Char lane Runge reported the violation was first observed on October 8, 1991 and was to be corrected by October 26, 1991. Ms. Runge passed photographs to the board dated October 26, 1991. Ms. Runge reported that on January 12, 1992 she spoke with the tenants who stated they would attempt to cut the grass before January 16, 1992. Upon reinspection of the property on January 16, 1992, Ms. Runge found no corrective action had been taken. Ms. Runge recommended the violator be given until Friday, January 24, 1992 to correct the violation or a fine of twenty-five dollars ($25.00) a day be imposed starting January 25, 1992. Mrs. Borner, after hearing the testimony presented and the recommendation of staff, moved in reference to Case Number 91-CE- 2056 that a violation of section 10-43 of the Edgewater Code of Ordinances does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until January 24, 1992 to correct the violation and that a fine of twenty-five dollars ($25.00) be o o o o Citizens Code Enforcement Board January 16, 1992 Page -3- imposed for each day the violation continues past that date. Seconded by Mrs. Strong. Motion CARRIED 7-0. CASE # 91-CE-2061 - George & Lori King, III - Black Thunderbird inoperable and no tag. section 10-64. No visible house number on property. Section 15-1 (b) . Discarded tires. Section 717.03. Code Enforcement Officer Beverly Kinney reported the violations were first observed on August 26, 1991 and to be corrected by October 26, 1991. Upon reinspected the property on January 16, 1992, Ms. Kinney found the house numbers had been displayed and the tires removed. Ms. Kinney passed photographs dated October 9, 1991 and January 16, 1992 to the board. Ms. Kinney stated she spoke with Mr. King and he said he would tag the vehicle and repair the tire by Friday, January 17. 1992. Ms. Kinney recommended the violator be given until Tuesday, January 21, 1992 to correct the violation or a fine of thirty dollars ($30.00) a day be imposed. Mrs. Cucanich, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 91-CE- 2061 that a violation of Section 10-64 of the Edgewater Code of Ordinance does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until January 21, 1992 to correct the violation and that a fine of twenty-five dollars ($25.00) be imposed for each day the violation continues past that date. Seconded by Mr. Munson. Motion CARRIED 7-0. CASE # 91-CE-2131 - Elwood & Frances Sides - Inoperable white truck (flat tire). section 10-64. Code Enforcement Officer Beverly Kinney reported the violation was first observed on October 17, 1991 and was to be corrected by November 5, 1991. Ms. Kinney reinspected the property on November 6, 1991 and found no corrective action had been taken. Ms. Kinney passed photographs dated October 29, 1991 and January 16, 1992 to the board. Ms. Kinney reported there has been no contact with the property owner and recommended the violator be given until Tuesday, January 21, 1992 to correct the violation or a fine of thirty dollars ($30.00) a day be imposed. Mr. Christian, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 91-CE- 2131 that a violation of Section 10-64 of the Edgewater Code of Ordinances does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until January 21, 1992 to correct the () o o Q Citizens Code Enforcement Board January 16, 1992 Page -4- violation and that a fine of twenty-five dollars ($25.00) be imposed for each day the violation continues past that date. Seconded by Mrs. Borner. Motion CARRIED 7-0. CASE # 91-CE-2412 - Zora pyevac & Pheobe Lambert - Weeds in excess of two (2) feet at west and north side of property. section 10- 43. Code Enforcement Officer Beverly Kinney reported the violation was first observed on November 22, 1991 and was to be corrected by December 12, 1991. Upon reinspection on December 12, 1991, Ms. Kinney found that no corrective action had been taken. Ms. Kinney passed photographs to the board dated November 12, 1991 and January 16, 1992. Ms. Kinney stated that on January 16, 1992, the property owners nephew, Steve Campbell, came into the office and said he would have the weeds cut by Monday, January 20, 1992. Ms. Kinney recommended the violator be given until January 21, 1992 to correct the violation or a fine of twenty-five dollars ($25.00) be imposed. Mr. Munson, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 91-CE- 2412 that a violation of Section 10-43 of the Edgewater Code of Ordinance does exist and the alleged violator has committed the violation. After considering the gravity .of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until January 21, 1992 to correct the violation and that a fine of twenty-five dollars ($25.00) be imposed for each day the violation continues past that date. Seconded by Mrs. Borner. Motion CARRIED 7-0. DISCUSSION ITEMS: None at this time. CODE ENFORCEMENT OFFICER COMMENTS: None at this time.
