CITIZENS CODE ENFORCEMENT BOARD
SPECIAL WORKSHOP
OCTOBER 3, 1991

7:00 P. M.
CALL TO ORDER:
Chairman George Cowan called to order the special workshop of the
Citizens Code Enforcement Board at 7:03 P. M., Thursday October 3,
1991.
ROLL CALL:
Members present were Chairman George Cowan, Mr. Bennington, Mr.
Munson, Mrs. Strong, Mrs. Borner and Mrs. Cucanich. Also present
were Charlane Runge, Code Enforcement/Safety Director, Beverly A.
Kinney, Code Enforcement, Tonya Elliott, Secretary, Krista Storey,
City Attorney and Mark P. Karet, Director of Planning and Zoning.
Mr. Christian was excused.
Chairman George Cowan turned the meeting over to Krista Storey,
City Attorney.
A. AUTHORITY OF CODE ENFORCEMENT BOARD - Ms. Storey explained the
authority of the Code Enforcement Board as described in Chapter 162
of the Florida Statues. Ms. Storey stated this is basically the
cans and can't of Code Enforcement.
B. HISTORY/PURPOSE OF CODE ENFORCEMENT BOARD - Ms. Storey briefly
discussed the history of Code Enforcement. Ms. Storey also
discussed several methods of enforcing codes.
C. ROLE OF THE BOARD - Ms. Storey explained that Code Enforcement
Boards are considered Quasi Judicial Boards. The board has the
power to negotiate fines, work with people and therefore, are
sitting in the role of a Judge. Ms. Storey also stated the Board
is to come into the meetings with an open mind. There was a brief
discussion on when a Board member should not vote if they have
personal interest in a case.
D. ROLE OF STAFF - Ms. Storey said the role of the Code Enforcement
Officer is to initiate the case and to determine a reasonable
amount of time for the violator to come in compliance. There was
discussion on what was considered a reasonable amount of time.
E. ROLE OF CITY ATTORNEY - Ms. Storey said the Florida Statue
162.05 states that the Local Government determines if the City
Attorney will represent the Board or the Staff. The Edgewater City
Council has determined that the City Attorney will serve the Board.
Ms. Storey discussed her role and responsibilites as the Attorney
for the Code Enforcement Board.

F. REVISED ENFORCEMENT PROCEDURES - Ms. Storey explained the
revised Violation and Notice of Violation Hearing forms that will
be used by Code Enforcement.
The Board discussed the procedures for repeat violators. Mr. Karet
stated that a repeat violator would be issued a Notice to Appear.
Ms. Storey recommended the orders the Board issue include the
automatic recording of the fine with public records if the violator
does not comply.
G. CONDUCT OF HEARING - Ms. Storey stated that the procedures for
hearings are in the Boards hands to decide. Ms. Storey said it is
important for the Board to remain in control and to give all cases
a fair hearing.
Ms. Storey recommended that at the beginning of a meeting the
secretary or Code Enforcement officer read the cases that have come
in compliance or are being held over until the next meeting.
H. FINES/LIENS/FORECLOSURES - Ms. Storey said as was previously
discussed, the orders would be wrapped up into one package.
I. QUESTIONS/COMMENTS There was discussion on when a Code
Enforcement Officer could go on private property.
The Board also discussed getting name plates, which would allow
the violator to challenge a member.
ADJOUNMENT:
There being no further business, a motion was made and accepted to
adjourn. The meeting adjouned at 8:45 P. M.
