09-19-1991 o C) o y r I rY'CAJ1 J CITY OF EDGEWATER CITIZENS CODE ENFORCEMENT BOARD REGULAR MEETING SEPTEMBER 19, 1991 COMMUNITY CENTER, CITY HALL 7:00 P. M. CALL TO ORDER: Chairman George Cowan called to order the regular meeting of the Citizens Code Enforcement Board at 7:00 P.M., Thursday September 19, 1991. ROLL CALL: Members present were Chairman George Cowan, Mrs. Cucanich, Mrs. Borner, Mrs. Strong, Mr. Christian, Mr. Munson and Mr. Bennington. Also present were Char lane Runge, Code Enforcement/Safety Director, Beverly A. Kinney, Code Enforcement Officer, Tonya Elliott, Secretary, Krista Storey, City Attorney and Mark P. Karet, Director of Planning and Zoning. Chairman George Cowan introduced Mr. Bennington as the new member to the board. APPROVAL OF MINUTES: Mrs. Cucanich made a motion to approve the minutes of August 15, 1991. Seconded by Mr. Christian. Motion CARRIED 6-1. Mrs. Strong voted no since she was excused from the meeting. UNFINISHED BUSINESS: CASE #91-CC-101 - Thomas Foster - Discarded truck topper, auto parts, generator and building material by garage, Section 717. Ms. Runge stated a fence had been put up, therefore she was signing the case in compliance. Ms. Runge reported that this case had been held over from the meeting of August 15, 1991 because Mr. Foster had stated he did not own the property, but upon further investigation it was determined that Mr. Foster was the owner. Ms. Runge recommended a fine of One hundred dollars ($100.00) for the violation. Mr. Foster stated the Judge took the property away from him upon his divorce. Chairman George Cowan requested the case be held over for further investigation. Mr. Karet stated the property ownership had been investigated and the board needed to decide the case. Ms. Storey stated it was not legally relevant who was the property owner, but who was the violator. Mrs. Strong made a motion to fine Thomas foster One hundred dollars ($100.00) for the violation. Seconded by Mrs. Borner. Motion CARRIED 7-0. CASE #91-CC-107 - Servair Heating & AC - Large pile of propane tanks, building material, metal parts, large air conditioners and (.) o Citizens Code Enforcement Board September 19, 1991 Page -2- ice machines rear of business, section 717. this case had come in compliance. Ms. Runge reported Mrs. Strong compliance. made a motion to accept Seconded by Mrs. Cucanich. case #91-CC-107 as Motion CARRIED 7-0. in CASE #91-CC-113 - Greg Cunningham - No number on house, section 15-1(b). Ms. Kinney reported there has been no contacted with the violator since the citation was issued. Ms. Kinney recommended a Twenty-five dollar ($25.00) fine for the violation. Mr. Bennington made a motion to fine Greg Cunningham Twenty-five dollars ($25.00) a day until in compliance. Seconded by Mrs. Strong. Motion CARRIED 7-0. CASE #91-CC-116 - Kopec Assoc. - Fence in need of repair, section 200.00. Code Enforcement Officer Beverly Kinney passed photos to the board dated September 19, 1991. Ms. Kinney stated the fence needed to be repaired or taken down. Mr. Bennington stated section 200.00 was a definition. Mr. Karet withdrew the case at this time and said the citation would be re-issued. Mr. Kopec requested the board move along to Case #91-CC-130. Chairman George Cowan stated that case would be heard under New Business. CASE #91-CC-119 - Lutes C/O Lutes - Pool with no fence, Section 7- 325. Ms. Runge reported a fence permit had been issued and this case was now in compliance. NEW BUSINESS: Code Enforcement Officer Charlane Runge reported the following cases withdrawn and signed in compliance: Case #91-CC-128 Case #91-CC-129 T. Karty (.) o Citizens Code Enforcement Board September 19, 1991 Page -3- Mr. Bennington made a motion to accept case numbers 91-CC-120 thru 91-CC-122, 91-CC-124, 91-CC-125, 91-CC-128, 91-CC-129, 91-CC-131, 91-CC-132, 91-CC-136 and 91-CC-137 as in compliance. Seconded by Mr. Munson. Motion CARRIED 7-0. Code Enforcement Officer Char lane Runge requested the following cases be held over until the meeting of October 17, 1991 pending proper notification: Case #91-CC-123 Case #91-CC-126 David Wray Nancy J. Verduzco Code Enforcement Officer Beverly A. Kinney requested the following cases be held over until the meeting of October 17, 1991 pending proper notification: Case #91-CC-133 Case #91-CC-134 Case #91-CC-135 Case #91-CC-138 Larry Yarchuck Nancy Ridner Donald Williams Don Taylor Mrs. Strong made a motion to continue cases 91-CC-123, 91-CC-126, 91-CC-133 thru 91-CC-135 and 91-CC-138 until the meeting of October 17, 1991. CASE #91-CC-130 Joseph Kopec Sign located in visibility triangle, Chapter 3. Mr. Karet stated this case was being withdrawn at this time and the citation would be re-issued. DISCUSSION ITEMS: Mrs. Storey briefly discussed her back ground and functions as the attroney for the board. Ms. Storey recommended a special workshop be held to discuss Code Enforcement procedures. Mr. Karet asked the to board set a date prior to the October 17, 1991 meeting. The board tentatively sei October 3, 1991 for the special meeting. CODE ENFORCEMENT OFFER COMMENTS: None at this time.
