05-16-1991 o o o\~~~ CITY OF EDGEWATER CITIZENS CODE ENFORCEMENT BOARD REGULAR MEETING MAY 16, 1991 COMMUNITY CENTER, CITY HALL 7:00 P.M. CALL TO ORDER: Vice Chairwoman, Joan Strong called to order the regular meeting of the Citizens Code Enforcement Board at 7:00 p.m., Thursday, May 16, 1991. ROLL CALL: Members present were Mr. Christian, Mr. Lange, Mr. Cowan, Mrs. Cucanich, and Mrs. Strong. Mr. Kozlowski and Chairwoman Borner were excused. Also present were Char lane Runge, Code Enforcement/Safety Director, Beverly Kinney, newly hired Code Enforcement Officer, Tonya Elliott, Secretary and Sondra Meager- Pengov, Secretary. APPROVAL OF MINUTES: Mr. Cowan made a motion to approve the minutes of April 18, 1991. Seconded by Mrs. Cucanich. Motion CARRIED 4-0. Vice Chairwoman Strong abstained as she had been excused from the meeting. Mrs. Cucanich moved to approve the minutes of the Special meeting of May 2, 1991. Seconded by Mr. Christian. Motion CARRIED 4-0. Vice Chairman Strong abstained as she had been excused from the meeting. Vice Chairwoman Strong welcomed Beverly Kinney as the "new>> Code Enforcement Officer and Tonya Elliott the >>new" secretary to the Board. UNFINISHED BUSINESS: Case #91-CC-038 - Ms. Runge reported this case came in compliance on May 9, 1991. Mr. Christian made a motion to accept the case in compliance. Seconded by Mrs. Cucanich. Motion CARRIED 5-0. NEW BUSINESS: Case #91-CC-039 - Piggy's of Edgewater (Fat Bob's) - Broken fence and other building material on north and rear sides. Section 717.00. Ms. Runge passed pictures dated March 22, 1991 to the Board. Ms. Runge explained to the Board there has been no change since the citation was issued. Ms. Runge recommended a fine of fifty dollars (S50.00) per day until in compliance. Mr. Christian agreed the recommended fine was in line with the (.) o Citizens Code Enforcement Board May 16, 1991 Page -2- violation. Mr. Lange made a two-hundred-fifty dollars (S50.00) Findings of Fact, Cucanich. Motion motion to fine Piggy's of Edgewater (Fat Bob's) dollars (S250.00) per day until Conclusion of Law CARRIED 5-0. for the violation and fifty in compliance upon receiving and Order. Seconded by Mrs. Case #91-CC-Q4Q - Fishers Auction, Ray Fisher - Placing driveway without required permit. Section 15-3(b)(e). Ms. Runge reported to the Board she would like to hold this case until the next meeting, she feels she should take additional photographs to clarify the violation and possibly others. Mr. Christian made a motion to continue this case to the meeting of June 20, 1991. Seconded by Mrs. Cucanich. Motion CARRIED 4- O. Mr. Lange voted no. Case #91-CC-Q49 Kathleen Giaccone Plastic containers, building materials and old garage door on side of residence. Section 717.00. Ms. Runge recommended, since there has been no response from Ms. Giaccone, a twenty dollar <S20.00) per day fine be imposed. Mr. Lange made a motion to fine Ms. Giaccone fifty dollars <S50.00) for the violation and twenty dollars <S20.00) per day until in compliance upon receiving Findings of Fact, Conclusion of Law and Order. Seconded by Mr. Christian. Motion CARRIED 5-0. DISCUSSION ITEMS: Ms. Runge read the monthly report of violations for April: Citations Issued 235 Citations in Compliance 124 Citations Unclaimedl 20 Returned The Board briefly discussed the excused meetings of Mr. due to his illness. The Board felt another member appointed because of their concern of having a quorum. Kozlowski should be Mrs. Cucanich made a motion to Kozloswki requesting his resignation. Motion CARRIED 5-0. have a letter sent to Mr. Seconded by Mr. Christian. CODE ENFORCEMENT OFFICER COMMENTS: ADJOURNMENT: There being no further business to come before the Board, a motion was made and accepted to adjourn.
