CALL TO OJ:!DER: Chairwoman, Maureen Borner called to order the regular meeting of the Citizens Code Enforcement Board at 7:00 p.m., Thursday, September 20, 1990. ROLL CALL: Members present were Mr. Christian, Mr. Lange, Mr. Cowan, Mrs. Cucanich, Mrs. Strong, Mrs. Borner. Mr. Kozlowski was excused. Also present were Pat DiLeva, Code Enforcement/Safety Director, Frank Conrey, Electrical Inspector, Rhonda Schindler, Animal Control Officer and Sondra Meager-Pengov, Secretary. APPROVAL OF MINUTES: Mrs. Strong made a motion to approve the minutes of August 16, 1990. Seconded by Mrs. Cucanich. Motion CARRIED 4-0. Mr. Christian not voting as he was absent from the meeting. Mr. Lange had not arrived as yet. UNFINISHED BUSINESS: Mr. DiLeva reported Case Numbers 90-CC-097 and 90-CC-082 as being in compliance. Mrs. Cucanich made a motion to accept these cases as in compliance. Seconded by Mr. Cowan. Motion CARRIED 5-0. NEW BUSINESS: Case Numbers reported as Business: 90-CC-100, 90-CC-102 and 90-CC-103 were also being in compliance with the cases under Unfinished Mr. Lange arrived at this time (approximately 7:20 p.m.). CASE # 90-CC-099 - Rodd M. Garrison - Animal creating nuisance. Rhonda Schindler, Animal Control Officer reported on the filed complaint of Mr. Prater and Mrs. Reimer concerning Mr. Garrison's barking dog. Ms. Schindler reported being called to Mr. Garrison's residence twice before, but heard no barking at that time. The Board asked Mr. Prater if the dog barking had improved since the complaint had been made, and he replied yes. There were several neighbors of Mr. Garrison's present, that stated the dog has not been a disturbance to them. Mrs. Strong made a motion to fine Mr. Garrison $50.00 for causing the nuisance of the barking dog. If this re-occurs in the future an immediate ticket is to be issued. Seconded by Mr. Cowan. Motion CARRIED 6-0. CASE # 90-CC-101 - Elwood Sides owner of Sides Used Cars & Trucks - Vehicle with no tag. There was no one present to represent Mr. Sides. Mr. DiLeva explained to the Board that the vehicle had been parked on the property since his original inspection of August 2, 1990. Mr. Lange made a motion for Mr. Sides to pay an immediate fine of one hundred dollars ($100.00) and to correct the violation within seven (7) days from date of receipt of Findings of Fact Conclusion of Law and Order, or be fined one hundred dollars ($100.00) per day thereafter. Seconded by Mr. Christian. Motion CARRIED 6-0. u o CITIZENS CODE ENFORCEMENT BOARD SEPTEMBER 20, 1990 PAGE -2- CASEM 90-CC-104 - Susan Hounsam - Semi parked in residentially zoned area. Mr. DiLeva passed pictures to the Board of the semi. The Board then questioned Ms. Hounsam (owner of the property) and Ms. Pam DeWitt (renter of the property). Ms. Hounsam stated that the original citation had been sent to the past owner of the property, not to her. She stated, if she had received a citation she would have been able to correct the violation. The Board agreed that the citation should be sent to Ms. Hounsam and then if not brought into compliance a subpoena should be served. Mrs. Strong made a motion to re-issue a citation to Ms. Hounsam (new property owner) and a copy to Ms. DeWitt (renter) then follow standard procedures. Seconded by Mr. Christian. Motion CARRIED 6-0. CASE M 90-CC-105 - Peter Olive owner of Fat Bob's Restaurant- Electrical violations. Mr. Conrey, Electrical Inspector, reported that of the seventeen original violations, as of this date six still remain. Mr. Conrey considers these remaining violations as being very unsafe. The owner, Peter Olivo and his father of Fat Bob's Restaurant brought a survey of the building showing that they had believed the electric to be the required 200 amperage rather than the 150 amperage that is in the building. Because of this problem there is more to correct than originally believed. They have contracted with an electrician and requested that the Board give them additional time to comply. Mrs. Strong made a motion to give Fat Bob's Restaurant an extension of thirty (30) days to bring the six remaining violations into compliance. (Outstanding violations are number's 1,2,6,9,13 & 16 - see attached.) Seconded by Mr. Cowan. Motion CARRIED 5-1. Mr. Lange voted no. DISCUSSION ITEMS: Mr. DiLeva reported that Case M 90-CC-082, Perry Barrett - Gas Stop and Case #90-CC-008, Smoak Enterprises, Inc. - Huntley Jiffy Stores have been notified by letter of the amount of their fines. ADJOURNMENT: There being no further business to come before the Board a motion was made and accepted to adjourn.
