CITIZEN CODE ENFORCEMENT BOARD
REGULAR MEETING
THURSDAY, JUNE 29, 1989
CONFERENCE ROOM, CITY HALL
7:00 P.M.
Chairwoman, Delores Cucanich called to order a regular meeting of The Citizens
Code Enforcement Board at 7:00 p.m., Thursday, June 29, 1989, in the Conference
Room of City Hall.
Members present were Mr. Don Bennington, Mr.Paul Biggerstaff, Mrs. Maureen Borner,
Mrs. Delores Cucanich - Chairwoman, Mrs. Ella Ledger-Adle, Mrs. Joan Strong.
Mr. Richard Kozlowski was absent. Also present were Mr. Pat Di Leva, Code Enforc-
ement Officer/ Safety Director and Sondra Meager-Pengov, Secretary.
APPROVAL OF MINUTES: The minutes of May 25, 1989 were presented for approval.
Mrs. Adle made a motion to accept the minutes as presented, seconded by Mrs. Borner.
Motion CARRIED 6-0.
NEW BUSINESS:
CASE 89-CC-64
Robert Forster
Housing Code.
- Mr. Di Leva reported case # 89-CC-64 on behalf of the City.
is in violation of the Southern Building Code and the Standard
Requested demolition of dwelling (Section 103.2)
Mr. Forster, owner of the dwelling is an elderly man who has been in the hospital
numerous times, which is apparently why the violation still exists. Mr. Di Leva
passed pictures to the Board showing the present condition of the dwelling.
Pictures show it is a safety hazard, fire hazard and danger to children, if they
should play in it.
On April 26, 1988, Fire Inspector, David Jones sited Mr. Forster, then turned the
case over to Mr. Di Leva when he became Code Enforcement Officer. Mr. Di Leva
spoke to Mr. Forster's daughter, Carol Swan on two different occasions - March
21, 1989 and April 11, 1989, after learning Mr. Forster was again in the hospital.
The daughter claimed she would speak to her father in the hospital about the
dwelling, but she never reported back to Mr. Di Leva. After Mr. Di Leva reinspected
the dwelling and found it to still be in violation, he sent a subpoena. Nine
days later Carol Swan called saying she would acquire a permit to demolish the
dwelling. Mr. Di Leva submitted a copy of the permit to the Board.
Mr. Bennington made a motion to write a letter

CASE 89-CC-66 - Untagged vehicle and trash around dwelling (Section 10-66 and
717.00.) Mr. Di Leva stated the occupant, Mr. Carl Baugh, had first been notified
on May 11, 1989. There being no change in the property, Mr. Di Leva had a
subpoena served on June 19, 1989. As of this date, after a reinspection, no change
had been made to the property. The junk car and trash are still around the house.
Mr. Bennington made a motion to send a letter to Mr. Baugh stating he has until
July 14, 1989 in which to bring the property into compliance. If not in compliance
by July 14, 1989 a fine of $250.00~ill be imposed starting July 15, 1989. Seconded

Request Permission to Cut Grass at Corner of Live Oak and Yelkca Terr: Mr. Di Leva
stated this same problem occurred last year and a letter was sent to the owner
in California. As there was no reply Mr. Di Leva received authorization to have the
grass cut. The bill was sent to the owner for payment. Mrs. Adle made a motion
to have the grass cut, that is in excess of two feet, be cut by the City and send
the bill to the owner. Seconded by Mr. Biggerstaff. Motion CARRIED 6-0.

Mr. Di Leva requested the Board support when imposing a time eliment for an
offense to be brought into compliance, as long as the time frame is reasonable.
Mr. Bennington made a motion giving the Boards support to Mr. Di Leva when
determining a reasonable time (based on the Code Enforcement Officer's experience)
in which to have a violation brought into compliance. Seconded by Mr. Biggerstaff.
Motion CARRIED 6-0.
Elect Chairman and Vice Chairman: Mrs. Cucanich elected Mr. Bennington as
Chairman. Mr. Bennington declined. Mrs. Adle nominated Mrs. Borner. Seconded
by Mrs. Strong. Mr. Bennington moved to close nominations for Chairman. Motion
CARRIED 6-0.
Mr. Biggerstaff renominated Mr. Bennington as Vice Chairman, seconded by Mrs.
Strong. Motion CARRIED 6-0.
Accept Revised By-Laws: Mrs. Adle made a motion to accept revised By-Laws. Seconded
by Mrs. Borner. Motion CARRIED 6-0.
UNFINISHED BUSINESS:
Date Change of Board Meetings: ~he date change of the board meetings was reaffirmed.
Meetings will now be on the third Thursday of the month in the Community Center.
ADJOURNMENT: Mrs. Cucanich made a motion to adjourn. Seconded by Mrs. Adle.
