MINUTES
The meeting of the Citizen Code Enforcement Board of the City of
Edgewater waw called to order by the Vice Chairman, Phillip
Williams, the Chairman, Mary Ciccarello, being excused from
the meeting, in the Conference Room of City Hall.
ROLL CALL
Members present were: Ella Adle, Lois Kane, Delores Cucanich, Phillip
Williams and Janice McGhee. Mary Ciccarello and Paul Biggerstaff were
excused. Also present were Dennis Fischer, Code Enforcement Officer/
Building Official, and Pat DiLeva, Assistant Code Enforcement Officer/
Safety Director.
Mr. Williams announced the Board would go right to New Business,
FRANK MORRIS, 88-CC-19, 1814 Evergreen Drive - Back yard to be
cleaned and Car removed - Sections 717.03 and 10-63. Mr. Williams
announced he would like this meeting conducted in an orderly manner
and there is to be no yelling, as this is a Code Enforcement Board
hearing and the Board is for the City, and Code, as well as the
people of Edgewater, and it is up to the Board to decide what
can be done. Mr. DiLeva sa,id he would speak, and when Mr. Clark
asked if he could speak, Mr. Williams said Mr. Clark was not
subpeonaed and he, therefore, could not speak, but Mr. Clark would
have to go through Mr. DiLeva. Mr. DiLeva swore in Mr. Frank Morris
and continued by giving the background of this case to the Board.
Mr. DiLeva explained he had given Mr. Morris the usual ten day
notice and at the conclusion of the ten days, it was not in
compliance and he sent a subpoena, dated April 25th, date of
reinspection. Mr. DiLeva also said he went by, as he usually
does, on the day of the meeting and took pictures of the premises.
Mr. Fischer then said he had received a petition and would read:~
it into the record, dated April 27, 1988, "We the undersigned
neighbors of the 1800 block Evergreen Drive, Florida Shores, do
protest the continuous build up of trash and debris, giving the
appearance of a city dump on property at 1814 Evergreen Drive.
This being the ongoing condition for sometime, we petition the
Code Board to take corrective measures to clean up this neighbor-
hood nuisance." Mr. Fischer said this petition has the names and
addresses of thirteen people, all in the 1800 block of Evergreen.

~r. DiLeva then said Mr. Morris had called his office today and
asked Mr. DiLeva if he could pile his stuff and have the City crew
pick it up, which would be sometime next month, around the 17th.
vMr. DiLeva explained he had no authority, as once the subpoena is
issued it is out of his hands and it is up to th~ 'Code'~oara;. Mr.
DiLeva added Mr. Morris accused him of harassing him, and Mr. DiLeva
hung up. He said Mr. Morris called back and Mr. DiLeva turned him
over to his boss, Mr. Fischer. t Mr. Fischer then said he spoke with
Mr. Morris, who wanted to know the dates of spring clean up, which
Mr. Fischer secured from Public Works. Public Works explained to
Mr. Fischer they will pick up such items as household items, but
will not pick up any building materials or supplies, and not before
the 16th of May; all will be picked up without charge. Mr. Fischer
said it is up to the Board as to whether Mr. Morris can remove this
amount of material immediately or grant him an extension to the City's
spring clean up day which is in approximately two weeks. Mrs. Kane
asked about the car and Mr. Fischer said there is an untitled vehicle
in the rear yard.

Mr. Morris then informed the Board he has been out of the house
for a number of months, just came back into it in February, and
had renters in there. He said the automobile has always been there;
it is on a trailer and the trailer has a license, that the title to
the vehicle is being researched in Massachusetts at this time. He
added when he moved back into the house he told his neighbor it was
going to take him sometime to get the house into order; that he had
a garage sale; that some of his materials are $2500 worth of carpet
machines. He said he did clean out the shed so as to move it, .
and Mr. Fischer had given him permission to move the shed. He added
he hoped to have everything cleaned up and out of there by the spring
cleaning date. Mrs. Cucanich then asked just what the City will take
away and Mr. Fischer answered they will pick up any household goods,
etc. and Mr. Morris could contact the City to get it out of their
now as a special pick up, but that is up to the Board. Mr. Morris
said he can't possibly get it out of there:in that time as he works
long hours.
Mr. Williams asked for the Board's opinion, and Mrs. Kane said it
doesn't solve the problem of the car, no matter what, and Mr. DiLeva
said the car has to be gone or in a garage. Mrs. Kane said yes, uhe car
has to be tagged or put in a garage. Mr. Morris then asked if the
Board would please give him until the sixteenth. Mrs. Adle asked ~
if Mr. Morris could take the trash to a county dump and Mr. Fischer~
said yes, to Tomoka. Mrs. Cucanich then stated she thinks the Board
has been more than lenient and moved the Board give Mr. Morris until
the first of Mayor a $100.00 per day fine, and also get a plate on
the car. Mrs. Kane asked the motion be revised, ~o ma~e it.

until the second of May, which would give Mr. Morris Saturday and
Sunday to work on it. Mrs. Cucanich agreed to the revision and the
motion was seconded by Mrs. Kane. Mr. Morris interrupted and said
he would like Mrs. Cucanich to be disbarred from this whole thing
as she was talking outside the meeting with the one gentleman in
the audience. Mr. Williams said o.k., but could the Motion be
read agaIn which was done by the secretary and the motion CARRIED
5-0.
JOHN GLANDORF - 88-CC-12 - 2020 Lime Tree Drive - Failure to secure
occupational license, Section 11-1. Mr. Fischer spoke on behalf of
Mr. Glandorf, saying he had this at the last meeting and Mr. Fischer
had to do some searching for this fellow but did get someone from
.his family. Mr. Fischer also stated he had talked with several
people who were to go in business with Mr. Glandorf which fell
through but that Mr. Glandorf now works for the Home Fashion Center
out of Ormond Beach and does installation for them ~nd he is not
wo~king. out.of his. residence. Mr. Fischer said it seems he is
no longer in business for himself and therefore there is no delinquent
occupational license, since he is ~o'long~r in business.~ Mr. Williams
said alright, there is no reason to even vote on this.
GERALD L. COCHRAN - 88-CC-18 - 1204 Bond Street - Expired license,
1975 Chevy pickup, Section 10-63. Mr. DiLeva stated the owner of
the property lives in Oak Hill and a police officer was sent there
with a subpoena at the place where the truck is parked. The officer
stated the owner lives in Oak Hill and the truck will be picked up
in about a week. The secretary was asked to read this into the
record from the police report which she did, with Mr. DiLeva saying
he will have a report for the next meeting. Mrs. Adle then moved
this case be tabled until the next meeting, seconded by Mrs. McGhee.
Motion CARRIED 5-0.
JOHN GROSS - 87-CC-57 - 621 N. Riverside Drive - Section 712, Illegal
Drag Line and Section 18-4, Oversize Boat. Mr. DiLeva stated Mr. Gross
is not entirely in compliance but has certainly tried and it has been
moved, but not the boat. Mr. DiLeva then had the Board view a taped
film he had made just this day showing the progress Mr. Gross has made.

After discussion of the tape viewed, Mrs. McGhee moved Mr. Gross
be given thirty more days, seconded by Mrs. Cucanich. Motion was
CARRIED 5-0.
Mrs. Adle then moved the minutes of March 31, 1988 be approved,
seconded by Mrs. Cucanich. Motion CARRIED 5-0.
Mrs. Cucanich then asked Mr. Fischer a question as to how many
cars can be parked at a residence and Mr~ Fischer replied there
is no law, even though the neighbors may not approve, as long as
they have current tags on them and parked properly. He added you
can park in your yard, although some subdivisions have a law you
cannot park on your lawns. Mr. Fischer suggested if things seem
to be out of hand, to call Code Enforcement and it can be forwarded
to the police department if necessary.
There being no further business before the Board, Mrs. Adle moved
the meeting adjourn, seconded by Mrs. Kane. The meeting adjourned
at 7:42 p.m.
