03-31-1988 (.) o (J CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD March 31, 1988 7:00 p.m. CONFERENCE ROOM MINUTES The meeting of the Citizen Code Enforcement Board of the City of Edgewater was called to order at 7:00 p.m. by the Chairman, Mary Ciccarello in the Conference Room of City Hall. ROLL CALL Members present were: Ella Adle, Lois Kane, Mary Ciccarello, Delores Cucanich, Paul Biggerstaff, Phil Williams and Janice McGhee. Also present were Dennis Fischer, Code Enforcement Officer/Building Official and Pat DiLeva, Assistant Code Enforcement Officer/Safety Director. The Chairman read from the Rules of Procedure of the Citizen Code Enforcement Board and introduced the Board members and Mr. Fischer, Mr. DiLeva and Mrs. Garrity, Secretary, to those present. APPROVAL OF MINUTES Mrs. Ciccarello asked for approval of the minutes of the February 25th 1988 meeting. Mrs. Adle moved for acceptance, seconded by Mr. Williams. Minutes were then approved 5-2, Mrs. Kane and Mr. Biggerstaff having been absent from the last meeting. OLD BUSINESS 88-CC-3, STEVE CAMPBELL, 206 S. Ridgewood Avenue - Unsafe Residence and Weeds (Given thirty days at last meeting). Mr. Fischer informed the Board he had just been to this house today and Mr. Campbell has done everything he has been required to do, including wiring, and Mr. Fischer considers Mr. Campbell to be in compliance. Mr. DiLeva then asked if the Board would mind moving on to 88-CC-8, TOM CASADEVALL, 2730 India Palm Drive, No License - Green Chevy Pick- up Truck. Mr. Casadevall was sworn in and Mr. DiLeva stated he had cited Mr. Casadevall for two trucks, one of which has been removed and asked Mr. Casadevall to explain why the other truck has not been removed. Mr. Casadevall stated it is not a registered truck; it is not used on the roads; it is used for hunting only; that he has not used it in over a year. The Chairman announced this case is now open for discussion and Mr. DiLeva informed Mr. Casadevall that any truck within the City of Edgewater ~ust have a license plate or stored in the garage. After a brief period of questioning, Mrs. Kane moved Mr. Casadevall be given until Monday to remove the truck or have it put in the garage. Motion seconded by Mrs. Adle and CARRIED 7-0. The Chairman announced the Board would now move back to "Old Business", 88-CC-57 - JOHN GROSS, 621 N. Riverside Drive - Illegal Drag Line and Oversize BOat (Given sixty days at last meeting). Mr. DiLeva explained to the Board what has been happening to date on the problems of Mr. Gross, which included the replacing of a valve, which is proving to be very difficult due to the age of the vehicle. Mr. DiLeva explained Mr. Gross has been trying to have the drag line moved and Mr. Cole, a heavy duty I equipment contractor, has been helping Mr. Gross. and is supposed to be forwarding a letter to that effect to the Board. After discussion, Mrs. Cucanich moved the Board table this action until the next meeting on suggestion of Mr. Fischer. Motion was seconded by Mrs. McGhee and CARRIED 7-0. NEW BUSINESS 88-CC-6 - STEVE McGUIRE - 805 S. Ridgewood Avenue, Trailer #7 - No rear wheels on car and No License. Mr. DiLeva announced the car has been towed away and Mr. McGuire is now in compliance. .~ o ~ 88-CC-7 - OCCUPANT - 4 wildwood Blvd., No License on Blue Chevy Flat Bed Truck. Mr. DiLeva announced the truck has been moved and this case is now in compliance. Mrs. Ciccarello announced we would handle 88-CC-9 and 88-CC-17 together, SAM COMERATE, Personal Touch - 502 Ridgewood - Failure to obtain Occupational Retail License. Mr. Fischer stated Mr. Comerate has the Personal Touch grass cutting service and has been located in . three different locations. Mr. Fischer also said the building Mr. Comerate is in now does not comply with commercial status requirements and the owner of the building, ATP Mortgage Company, was presented with a list of requirements to bring the building up to status but has not done so. Mr. Comerate decided to sell plants and foliage along the roadside in conjunction with grass cutting, but did not transfer his lawn care service due to the building not being up to commercial status, and he did not obtain "a ~etail sales license for the plants, and subsequently has been operating his business without a current license in two manners. Mr. Comerate has agreed to cease retail sale of plants, so 88-CC-17 is in compliance. Mr. Fischer continued the lawn care service of transfer license has not been transferred as a commercial license and is being changed to a home occupational license; Mr. Comerate has moved into the building as a residential building and is allowed home occupation as long as no more than 20% of the property is used for commercial, there are no coming and going of customers and the house must look like the neighbors, no signs there is a business there. Mr. Fischer concluded by saying any lawn mowers, or anything used in the business must be stored out of sight and as of today, he believes a home occupation license has been issued to Mr. Comerate and these two cases are now in compliance. Mrs. Ciccarello announced the Board would take the following cases together: 88-CC-10, 88-CC-ll, 88-CC-13 and 88-CC-16, all of which are now in compliance and the only case remaining is 88-CC-12 - JOHN GLANDORF - 2020 Lime Tree Drive - Failure to Obtain Occupational License. Mr. Fischer explained to the Board that Mrs. Susan Wadsworth, Acting City Clerk, presents a print out of all occupational licenses from last year that have not been renewed and it was about seven or eight computer pages long, but Mr. Fischer and Mr. David Jones, Fire Safety Inspector, started calling everyone and discovered some have been carried on the books for years but have failed to renew, and Mr. Glandorf is one who wants to keeph~ license but has not renewed. Mr. Fischer said Mr. Glandorf is not an active sub-contractor to his knowledge and may be out of business, and this may fall on the Building Trades and Regulatory Board. After discussion, Mrs. Kane moved a letter be sent to Mr. Glandorf stating if he continues to operate and does not secure a licen~e, he will be in violation-of the City Code and may be subject to a fine, abd must contact the Building Department. Motion was seconded by Mrs. Cucanich and CARRIED 7-0. There was a short discussion as to how occupational licenses are handled such as reminder letters, etc., a computer mail-out, as explained by Mr. Fischer. There being no further business before the Board, Mrs. McGhee moved the meeting adjourn, seconded by Mrs. Cucanich. The meeting adjourned at 7:59. Minutes respectfully submitted by Dorothy C.
