CITIZEN CODE ENFORCEMENT BOARD
February 25, 1988 7:00 p.m.
CITY HALL
MINUTES
The meeting was called to order by the Chairman, Mary L. Ciccarello,
at 7:00 p.m. in the Conference Room of City Hall of Edgewater.
ROLL CALL
Members present were: Ella Adle, Mary Ciccarello, Delores Cucanich,
Phil Williams and Janice McGhee. Lois Kane was excused and Paul
Biggerstaff was absent.
The Chairman opened the meeting by reading the outline of procedures
to be followed at each meeting.and she then introduced each Board
member, the secretary, and David Jones, Fires Safety Inspector and
Pat DiLeva, Assistant Code Enforcement Officer/Safety Director.
APPROVAL OF MINUTES
The Chairman asked for approval of January 28, 1988 minutes. Mrs.
Adle moved the minutes be accepted, seconded by Mrs. McGhee. Motion
CARRIED 4-1, Mrs. Ciccarello having been absent from that meeting.
CAMPBELL, STEVE 88-CC-3, 206 S. Ridgewood Avenue - Sec. 103.2,
Unsafe Building and Section 10-41, Accumulation of Weeds. Mr.
Campbell was sworn in and Mr. Jones stated he had gone by this
property this day and could find no change in the structure, although
Mr. Campbell did clean a lot of the debris and cut the weeds. Mr.
Jones also 'explained Mr. Campbell is not the owner, but a nephew
of the owner who gave Mr. Campbell permission to do any work that
had to be done, although Mr. Campbell has not secured any permits.
Mr. Jones continued as far as the structure is concerned on the
inside, it is in very poor condition and suggested Mr. Campbell
obtain permits ,for maintenance of any kind and asked the Board
to act on this.
The Chairman then announced the meeting is closed and now open for
discussion by the Board. Mr. Williams asked if the property was bad
enough for condemnation and Mr. Jones said yes, Mr. Fischer could get
a condemnation, but a major roof job could save the structure. After
an in-depth discussion Mrs. McGhee moved Mr. Campbell be given thirty
days to repair the roof, install smoke alarms and have all electrical
repairs completed. The Board also asked that the letter to be sent to
Mr. Campbell contain instructions if the property is not in compliance
within thirty days, steps will be taken to start condemnation pro-
ceedings. Motion seconded by Mrs. Adle and CARRIED 5-0.
TIFFANY, HARRIS, 88-CC-4, 1428 S. Riverside Drive, Section 714.00,
Storing of building materials in residential zone. Mr. Tiffany was
sworn in by Mr. DiLeva. Mr. Jones then explained to the Board a
complaint had been received February 1, 1988 in regard to Mr. Tiffany
storing telephone poles on his property located on Riverside Drive
and that the creosote coating was causing health problems for the
complainant. Mr. Tiffany stated he was going to possibly use the
poles for docks or landscaping. Mr. Jones continued Mr. Tiffany had
sent him a letter giving his intentions for the poles, so Mr. Jones
decided to bring this before the Board. Mr. Jones then read to the
Board the City Codes in regard to storage' on residential properties.
When questioned by the Board,' Mr. Tiffany stated he couldn't say how
many poles there are, and that they are about 25 feet long. Mr. Jones
said he cannot dispute the fact this is affecting the complainant's
sinus; he added it very well could be, but he doesn't know. Mr.
Tiffany interrupted and asked to speak. Mrs. Ciccarello asked him
to please wait until it was his turn. Mr. Jones explained this is
riverfront land and logs are an eyesore and he himself would be
afraid of rodents, and that is all he has to say.

Mr. Tiffany then spoke on his own behalf, stating he received a
letter on February 5, and the logs were delivered February 4th,
so the word "storage" is mighty short for one day. He continued,
Mrs. Martin is activating the City unduly, and he believes he is
being put on the defensive. Mr. Tiffany also stated it was never
mentioned the condition of his yard being created by the Martin's
air conditioner water draining onto his property.
Mr. Tiffany continued he had inquired into the use of the logs in the
water and was told creosote "logs are not regulated and can be used .~~.
a~o Giteqinstances where police had been called because of the way
he was mowing his grass and blowing leaves, etc., over his neighbor's
property. He concluded by saying he feels threatened that he cannot
take care of his own land and asked what is more precious, his logs
on his own lot or his neighbor's water draining on his lot. Mrs.
Ciccarello asked for any closing statements, and there being none,
announced the meeting was now open for discussion by the Board
members.
Mr. Williams asked how soon Mr. Tiffany planned to use the poles and
Mr. Tiffany answered he is very busy with the Scouts, has two
children's graduations and cannot possibly get to this until July.
He continued he is planning a modest dock, similar to a neighbor, if
he builds one. Mrs. Ciccarello then stated she.didn't think rats
are attracted to creosote, but as far as the logs go, she could
understand as to their appearance being "haphazard; she thought if
they were stacked and covered it might allay the neighbor's feelings.
Mr. Williams stated since Mr. Tiffany is building a dock, or whatever,
a person has a right to build or landscape, and if he uses a log now
and then and shows some progress, he has a right to do that. Mr.
Williams added, however, if they lay there for two or three years,
that is a different situation. Mr. Williams then moved to dismiss
the case, seconded by Mrs. Adle. Motion CARRIED 5-0.
ANGELL, MARGUERITE, 88-CC-5, Section 717. Junk doors, tires and
litter at side of house.Mr. DiLeva informed the Board Mrs. Angell is
now in compliance.
There being no further business before the Board, Mrs. Adle moved
the meeting be adjourned, seconded by Mrs. Cucanich. Meeting was
adjourned at 7:43 p.m.
