01-28-1988 C/ o o CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD January 28, 1988 7:00 p.m. CITY HALL MINUTES The meeting was called to order by the Vice Chairman, Phillip Williams, the Chairman having been excused from the meeting. Mr. Williams called upon the secretary to read the By Laws of Procedure, which included the introduction of all Board members, Building Official/Code Enforcement Officer Dennis Fischer, and Assistant Code Enforcement Officer/Safety Director Pat DiLeva. ROLL CALL Members present were: Ella Adle, Lois Kane, Delores Cucanich, Paul Biggerstaff, Phil Williams, Janice McGhee; Mary Ciccarello was excused. Also present were Dennis Fischer, Building Official/ Code Enforcement Officer and Assistant Code Enforcement Officer/ Safety Director Pat DiLeva. Mr. Williams asked anyone who wished to speak at this meeting to stand and be sworn in, which was done. HENRY ELBERS - 87-CC-48, 308 Ocean Avenue, Unsafe Building, Section 101.6 and Section 103.2, Standard Housing Code, and Section 10-43, Weeds. Mr. Dennis Fischer explained to the Board what had been done subsequent to Mr. Elbers' appearance before the Board in October, referring to a letter sent to Mr. Elbers in November of 1987, asking Mr. Elbers to have the grass cut and repair some deterioration of the building. Mr. Fischer explained there was no response to the letter; that he had taken pictures (which he showed to the Board) revealing nothing had been done aside from water being shut off and the doors and windows being secured. He explained the weed situation has now grown up again and the only deterioration is in the carport overhang. Mr. Fischer also stated this property was purchased years ago by Mr. Elbers' mother, along with other parcels, and the mother has been declared incompetent. Having never recorded any of the deeds, some people have legal rights to some buildings, due to their agreement with Mrs. Elbers. Mrs. Kane stated Mr. Elbers wouldn't want to pay. out too much money not knowing if he would end up with the property. Mrs. Cucanich asked how much would be involved and Mr. Fischer said the roof tile would have to be removed; there is frame damage above the carport; the soffit is deteriorating. Mr. Fischer continued the wall systems in the house are not hurt and would not have to be torn down. Mr. Elbers arrived at 7:10, and Mr. Fischer reviewed the meeting to this point for Mr. Elbers. Mr. Elbers told the Board he has a grandson who could restore this property and move in; that he has not paid the taxes and doesn't want to throw the money away unless he can get title to the property. \ . After a lengthy discussion, Mr. Williams asked Mr. Elbers if he thinks he could get this taken care of within the next sixty days and Mr. Elbers answered yes, if he could buy another sixty days he would try to get it in shape. He also added if he found he was having trouble near the sixty days, he would call. Mr. Elbers also stated he could come back in the next couple of weeks and get the carport repaired. Mrs. Kane then moved Mr. Elbers be given fourteen days to shore up the house, repair the carport, board up the air conditioner and have the weeds cut, seconded by Mrs. Adle. Motion CARRIED 6-0. o o o ARTHUR PINE - 88-CC-l, 2304 Kumquat Drive, Accumulation of trash, weeds, Section 10-44. Mr. DiLeva stated Mr. Pine has had an accumulation of trash and a water heater at the side of his house and the water heater has been removed. He asked Mr. pine how much time he needs to clean up. Mr. pine said he doesn't know what else he has to do. Mr. DiLeva told him the cans have to be picked up and all the buckets against the wall will have to be picked up, as the man who is going to cut the grass will not be able to do so. Mr. Pine said he has two fifteen gallon cans filled with gasoline for a generator and Mr. DiLeva asked if theyvere in red cans and Mr. pine said no, but he could spray them red. Mr. DiLeva asked Mr. pine how much more time he will need and Mr. pine asked for fifteen more days. Mrs. McGhee moved that within fifteen days the grass be mowed and all the trash in the yard picked up, seconded by Mrs. Cucanich. Motion CARRIED 6-0. CHARLES CLARK - 88-CC-2, 3110 India Palm Drive, Section 10-43, Accumulation of trash and Debris. Mr. DiLeva told the Board Mr. Clark had a tremendous amount of trash and he worked vigorously. Mr. Clark told the Board he had left the day before the notice was sent to him and did not get back_in town until January 7th. He stated he has taken two or three loads of ,trash to Tomoka, which is a long way, and about three more weeks would be sufficient. Mrs. Adle moved Mr. Clark be given three weeks to come into compliance, seconded by Mrs. McGh~e. Motion CARRIED 6-0. STEVE CAMPBELL ~. 88-CC-3, 206 S. Ridgewood, 103.2 Southern Building Code, Unsafe Building and City Ordinance 10-43, Accumulation of w~eds. Mr. Fischer stated Mr. Jones had handled this but could not .~ttend the meeting this evening. He also stated Mrs. Lambert, owner of this property, authorized Mr. Campbell to be her representative. She also had Perra Excavating remove the two story house in the rear and another old building back there. Mr. Campbell said he has to replace a board on the back of the building; he has cut all the weeds, and has about three patches on the roof to repair. Mr. Williams asked him how much time he would need and Mr. Campbell said about two more weeks to get everything together. Mrs. Cucanich moved Mr. Campbell be given two weeks, seconded by Mrs. McGhee. Motion CARRIED 6-0. JOHN GROSS - 87-CC-57, 621 N. Riverside Drive, Section 18-4, Oversize boat illegally parked and Section 712, Parking and Storage of drag line in residential area. Mr. Gross was sworn in by Mr. DiLeva and first stated the boat has been there several years, and the drag line less than a year. Mr. DiLeva stated he had talked with Mr. Gross about this for quite a while and explained Mr. Gross is in the process of building a big home. Mr. DiLeva also said Mr. Gross has made several attempts to have the drag line removed. Mr. Gross said he brought the drag line there to move the canal a co~ple of hundred feet North and was also supposed to dredge out 1500 feet by order of the City, which would cost more than the house. He continued, when he went to have the drag line moved, the tread was cracked and he has tried to get a dozen or so people over there to fix it. Mr. Gross stated there is a man coming down tomorrow to have it fixed and he will then use the drag line to move the dock and dig a swimming pool. He also added he has to have about 100 piles pulled out. Mr. DiLeva said the pool is going to take quite a while, and if he gets the drag line working and gets it back out of sight it would appease the people. After discussion, Mrs. Cucanich moved Mr. Gross be given sixty days to remove the drag line and the duck, seconded by Mrs. McGhee. Motion CARRIED 6-0. Mr. Williams then turned to the memo from City Attorney Jose' Alvarez regarding Enforcement procedures of the Code Board, stating it hasn I t changed too much,. and that the new words are underlined and asked the Board to read same. Mr. Williams determined the minutes of the November 19, 1987 meeting had notbeen approved. Mrs. Cucanich moved the minutes be accepted, seconded by Mrs. Adle. Motion CARRIED 4-2, Mr. Biggerstaff and Mrs. Kane having been absent at the November 17th meeting. Before adjournment, Mrs. Cucanich asked if there was going to be anything in the Code Book about skate board ramps, and Mr. DiLeva said Mr. Fischer has been looking into that, writing to various cities, etc. Mr. Fischer added he has had several responses, including Ormond Beach, who do not allow them any- where. Mrs. Cucanich then asked if anyone in Edgewater had secured a permit to build one, as there are plenty of them around here. Mr. Fischer said the City has torn down the one built by the kids on public property and Ormond will not ~llow one at all. Mr. Fischer stated he had recommended City Attorney Alvarez give an opinion. Mr. Williams asked if they could build one on private property and Mr. Fischer said he cannot stop them from constructing one as it is not a building, no more than a swing set, and he cannot stop them from constructing one. He stated the only thing is, if we get into regulation of them it means we approve them, and what we have to do is find the cities who have passed ordinances and have them send it to the Florida League Of Cities so other cities can benefit from it. Mr. Fischer continued they do not last long, as over a period of time the sun and water rays warp them and the life expectancy is not very long. He said it is the same as the popularity of the satellite dishes which were so famous, and an ordinance was passed but scrambling took care of that. There being no further business before the Board, Mrs. Adle moved the meeting adjourn, seconded by Mrs. Cucanich. The meeting adjourned at 7:55 p.m. Respectfully submitted by Dorothy C.
