11-19-1987 q Q o CITY OF EDG~WATER CITIZEN CODE ENFORCEMENT BOARD November 19, 1987 7:00 p.m. CITY HALL MINUTES CALL TO ORDER/ROLL CALL The meeting was called to order by the Chairman, Mary I,. Ciccarello, at 7:00 p.m. in the City Hall of Edgewater. Members present were: Ella Adle, Mary Ciccarello, Delores Cucanich, phil Williams and Janice McGhee. Lois Kane was excused and Paul Biggerstaff was absent. Also present were Building Official/Code Enforcement Officer Dennis Fischer, Assistant Code Enforcement Officer/Safety Director Pat DiLeva, and the secretary, Dorothy C. Garrity. APPROVAL OF MINUTES The Chairman called for approval of the mihutes of the October 25th, 1987, meeting. Mrs. Adle moved the minutes be approved, seconded by Mrs. McGhee. Motion CARRIED 5-0. Mrs. Ciccarello stated under Old Business, the f:irst caRe would be 87-CC-48, HENRY ELBERS, Unsafe Building. Mr. DiLeva asked the Chairman if 87-CC-56 could be moved up as the first case, as the defendant is the only defendant to appear this evening, and he wouldn't have to sit t~rough the whole mcpting. The Chairman asked for any objections and there being none, agreed. The Chairman first read her statement as to the duties of the Board and introduced all members of the Board; Mr. Fischer, Mr. DiLeva, and the secretary, to the audience. 87-CC-56 - RICHARD CLARK, 2751 Guava Drive, Expired Tag, Light Green Ford Van, License #HTR-183-FL. Mr. Clark was sworn in and Mr. DiLeva explained'he had cited Mr. Clark last month on November 14th, had given him the ten days required and when still in violation, had a subpoena served stating Mr. Clark was to appear at this meeting. Mr. DiLeva said he checked again just this day and the car was still there. ~lr. Clark said he thought it had been towed away, as he had been working in Ormond Beachr this van was used for storing tools, , etc.; it was being towed bacL and forth to and from jobs. He also stated it was an oversight on his part, as he believed the men working with him had taken it away. Mr. Clark said it will be gone by tomorrow. Mrs. Ciccarello then asked if there was any further testimony and there being none, Mrs. Cucanich moved ~lr. Clark be given until Monday, November 23rd, or a $25.00 fine will ensue. The motion was seconded by Mrs. Adle and CARRIED 5-0. The Chairman then moved back to Old Business: 87-CC-48, HBNRY E~BERS, Unsafe Building. Mr. Dennis Fischer then spoke of this case, reminding the Board Mr. Elbers had come before this Board before. lIe continued Mr. Elbers did spray paint the exterior, cut the grass, and temporarily shored up a few rafters and was given an Affidavit of Compliance. However, Mr. Fischer stated the property is slipping back into disorder; the grass is approaching 24 inches; a she0 door is hanging~ Rdditional damage has been done to the soffit and fascia and the garage area. Mr. Fischer suggested a letter be sent to Mr. Elbers asking he maintain the property, at least keep it safe, or he will have to appear at the next Board meeting. At this point, Mrs. Ciccarello asked if the Board had ever received guidance as to any power of condemnation the Board might have and Mr. Fischer replied we have still not received .this. Mr. rischer said this case is a very sticky one, as it is a salvagable structure; it will take a lot of money to get it in condition, but it can be done. Mrs. McGhee then moved a letter be sent to ~1r. Elbers to bring his building up to standard by the next Board meeting which will be December 17, 1987. Mrs. Cucanich seconded the motion and it CARRIED 5-0. o ~ 9 o ; Mrs. Ciccarello then moved on to the next two cases, 87-CC-53, MR. SMITH, No Tag,.and 87-CC-54, ROBERT RIPP , No Tag" stating these two cases are now in compliance. MRS. Ciccarello also announced that case No. 87-CC-47 ,FRANK MORRIS, Lien filed November 3, 1987, by Attorney Jose' Alvarez, was for the Board's information. There being no further 5usiness before the Board, 11rs. Adle moved the meeting be adjourned, seconded by Mrs. Cucanich. The meeting then adjourned at 7:16 p.m. Minutes submitted by Dorothy C.
