CITIZEN CODE ENFORCEMENT BOARD
November 20, 1986 7:00 p.m.
OONFERENCE ROOM
MINUTES
The Citizen Code Enforcement Board meeting was called to order by the
Chairman, Phillip Williams, at 7:00 p.m. in the Conference Room of
City Hall.
ROLL CALL
Members present were: Phillip Williams, Chairman, Roberta Moses,
Delores Cucanich, Paul Biggerstaff, Vince Turano. Lois Kane and
Mary Ciccarello were excused. Also present were David Morris,
Walter Race, Cecelia Battersby, Assistant Code Enforcement Officer
Pat Di Leva and Assistant Code Enforcement Officer David Jones.
Mr. Williams asked for any person who will testify to please stand
and be sworn in. The secretary then swore in Mr. Morris and Mr. Race.
Mr. Williams then asked the Board to turn to the first case to be
heard.
86-CC-43 - David Morris - Oversize Boat
Mr. Williams asked Mr. Di Leva to explain what happened in this case.
Mr. Di Leva stated he had written to Mr. Morris about two months back,
and told him he would give him a certain amount of time to move the
boat, as the boat was oversized. He stated Mr. Fischer accompanied
him to Mr. Morris' home to see this boat, which is over 26 feet. Mr.
Di Leva stated it is a tremendous job to refinish this boat and Mr.
Morris has been working on it, but he does need more time, but it is
now out of the hands of Mr. Di Leva and should be determined by the
Board. Mr. Morris stated he has been working on it and as soon as it
is completed he will put it in the water, which should be about February
the way it looks now. Mr. Di Leva added it is not imposing on anyone
at this time and if Mr. Morris can promise a date, Mr. Di Leva reco-
mmends he be allowed to finish that boat. Mr. Williams asked the
Board if there were any questions, and Mr. Biggerstaff said he didn't
think the Board should grant this, that it should go before another
board but the Board determined that would not be the right step to
take. Mr. Jones asked Mr. Morris why he couldn't work on his boat on
Hibiscus, and Mr. Morris said it would be very expensive to move it
and he just wants to work on it until he can get it into the water.
Mr. Di Leva asked Mr. Morris if he had the facilities to move it and
Mr. Morris answered yes. Mr. Biggerstaff suggested he could go to
Council but Mr. Turano stated the length of the boat is the problem
and he doesn't think this is a Council problem. Mr. Di Leva asked
Mr. Morris how much it would be to have it moved to Hibiscus, just
about one mile, and Mr. Morris said $400.00. After further discussion,
Mrs. Cucanich moved the Board give Mr. Morris thirty days and if not
in a proper storage or zoning area, he will be fined $15.00 per day
to commence December 20, 1986. The motion was seconded by Mrs. Moses
and CARRIED 5-0.
86-CC-42 - Wally Race - Accumulation of trash, tires, broken building
blocks and travel trailer.
Mr. Williams asked Mr. Di Leva to speak and Mr. Di Leva explainted the
facts of this case and distributed pictures to the Board he had taken
the first day he visited these premises and pictures taken just today.
He pointed out the things that are still there and Mr. Race said the
building block is for an addition he was planning, along with valuable
cedar wood. Mr. Race then stated he will be gone Monday, that the
house is sold. Mrs.Cucanich asked him if he intended leaving the

property as it is and Mr. Race said no, he was not leaving that
behind; it will all be done by Monday. Mr. Williams then asked
if the Board had any questions and Mrs. Moses asked if there would
be a problem if it is not done by Monday. Mr. Race answered it will
all be on his truck by Monday. Mr. Williams asked if Mr. Race was
aware the Board can put a line on his property and Mr. Race again
said it will be gone by Monday, that he will take it out of there
and take it to his new property. Mr. Williams stated Mr. Race is
the first person to corne before this Board to state he will be gone
by Monday, and that leaves the Board in a bind. Mr. Race then stated
he is telling the Board he is going. to move it. Mrs. Moses then moved
the Board give him until Sunday, November 23rd and have Mr. Di Leva
check it out to be sure he is in complianre and if not, a fine of
$15.00 per day will commence on Monday, November 24th and continue
until the property is cleared. Motion was seconded by Mrs. Cucanich
and CARRIED 5-0.
86-CC-44 - Lundy, John and Marian - Grass aver two feet high
Mr. Di Leva reported Mr. Frank Hall had spoken with Mr. Lundy and
the grass will be cut this Saturday. Mr. Williams asked the secretary
to not mail an In Compliance letter to Mr. Lundy until Mr. Di Leva
checks this out.
86-CC-David Taylor - Dead Tree Debris
Mr. Jones explained to the Board that Mr. Taylor had been notified
originally to clean out the dead trees and tall weeds. Mr. Taylor
did have the weeds cut down and the dead trees by a Mr. Henderson,
but the trees were left in piles. Mr. Taylor understood he could
burn, but the fire department would not issue a permit. The trees
stayed there for quite a while, so Mr. Jones sent Mr. Taylor another
letter, at which time Mr. Taylor again hired Mr. Henderson. Mr.
Henderson contacted Mr. Jones this day and asked for a few more days
stating it will take about 40 loads and will cost around $2,000.00.
Mr. Jones then suggested Mr. Taylor be given at least ten days and
Mr. Williams agreed. Mr. Turano then moved the Board give Mr. Taylor
ten days to remove the trees from the property and if not removed, a
fine of $10 .00 per day will commence from December 1, 1986. Mr.
Biggerstaff seconded the motion and the motion CARRIED 5-0.
Mr. Williams then called for approval of the minutes of September 25,
1986, and Mrs. Cucanich moved they be accepted, seconded by Mr. ~urano.
Upon roll call, it was discovered Mr. Biggerstaff and Mr. Williams
had been excused from the September 25th meeting and could not vote
for approval. The number of members present this evening did not
comprise a quorum, so Mr. Williams determined they be approved at
the next meeting. There being no further business, Mr. Turano moved
the meeting be adjourned, seconded by Mr. Biggerstaff. The meeting
then adjourned at 8:05 p.m.
