08-28-1986 ~ ~ ( , o o , I I CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD August 28, 1986 7:00 p.m. CITY HALL MINUI'ES The meeting was called to order by the Chairman, Phillip Williams, in the City Hall of Edgewater at 7:00 p.m. ROU, CALL Msnbers present were: Phillip Williams, Paul Biggerstaff, Vince Turano, Delores CUcanich and Mary Ciccarello. Roberta Moses arrived at 7: 18 and Lois Kane was excused. Also present: Pat Di Leva and David Jones, Assistant Code Enforcement Officers, and two interested citizens. APPROVAL OF MINUI'ES Mr. Williams asked for any corrections to the minutes of July 31, 1986 and Mrs. Ciccarello moved that on page two, the fine should read $25.00 per day, instead of $10.00 Per day, although the respondents cannot be fined the original $25.00 Per day. The Motion was seconded by Mr. Turano and motion CARRIED 5-0. OID BUSINESS 86-CC-15 - Kotakes (Prestige Car Care Center) - Failure to File New Site Plan Mr. Williams asked for any staterrents on this case and Mr. Jones stated he had contacted Mr. Kotakis last Friday and there was no reason to do a fire inspection as the business had been closed. Mr. Williams then said no further action is re- quired on the part of the Board if the business is closed down. Mr. Turano suggested the Board leave the case open should a business ever want to start up there again in the future and the Board agreed. Mr. Williams announced we \\Duld come back to the next case, 86-CC-27 - Lloyd - as no one had arrived as yet. 86-CC-29 - Finnerty - High Grass Mr. Williams then asked for comnents from Mr. Di Leva for this case, and Mr. Di Leva stated the grass has not been cut as of now and the owners are out of town. Mr . Di Leva also explaind the grass had been cut before by the City and when the Finnertys did not respond to the SubPOena, Mr. Di Leva spoke~ with the City and the Board secretary was told to turn this case over to Mrs. Wadsworth, Deputy City Clerk, who will have the City cut the grass. Mr. Biggerstaff then moved the BOard secretary turn this case over to Mrs. Wadsworth, seconded by Mrs. Ciccarello. Motion CARRIED 5-0. 86-CC-30 - James Smith (Starcade Arcade) - Fire Safety and Electrical.Violations After the announcement by Mr. Williams of the above case, Mr. Jones stated Mr. Smith is now in compliance and a letter has been sent to the respondent, notifying him of the same. Mr. Williams then said the enforcement officers are doing gcx:x1 on) these cases; either comply or close them up. 86-CC-31 - Coats & Coats Auto Body - Accumulation of Trash I Mr. Jones announced Coats & Coats are also now in compliance, adding that it looks like a new place of business. The secretary stated a ~etter of comp~iance has been mailed to Coats & Coats. Mrs. Moses then arrived at 7:18. 86-CC-32 - Felix E. and Treva Evington - High Grass Mr. Di Leva stated these PeOple are out of to.vn and have not responded to a Subpoena and said we should handle it the same way as Finnerty. Mrs. Ciccarello then moved we sem this case to Mrs. WadS\\Drth, seconded by Mr. Biggerstaff. Motion CARRIED 6-0. o o 86-CC-27 - Lloyd -Unlawful Vehicles and Trash Mr. Di Leva stated it was difficult to serve thse people by mail, as the newspaPerS had it headlined that the Lloyd' s were being fined, so Mr. Lloyd would never pick up his mail of notification. Mr. Di Leva then had. a duplicate served on Mr. Lloyd by Sergeant Lenz, who hand delivered it. Mr. Di Leva then took ten days from that delivery date, starting the fine on August 25th of $10.00 Per day. Mr. Di Leva continued that Mr. Lloyd did start to clear his property, all but the sheds. Mr. Lloyd told Mr. De Leva he couldn' t get anyone to help him rrove the sheds, so Mr. Di Leva and Mr. Fischer talked with Mr. Copeland and Mr. Tenney at Public Works and they agreed to speak with someone from the County. Mr. Di Leva said he explained this to Mr. Lloyd, that it is his responsibility to get this cleared up, and Mr. . Lloyd said he will try by putting an ad in the paper, etc. for things that are too heavy for him to rrove himself. After further discussion by the Board, Mrs. Ciccarello rroved that the Lloyds be given notification that their fine has started and will continue until such time as they are in canpliance, and it is Mr. Lloyd's responsibility to notify the Code Officer when it has been done. The rrotion was seconded by Mrs. Cucanich and CARRIED 6-0. MISCELIANEDUS Mrs. Ciccarello announced to the Board that at the last meeting, she had rroved and it was seconded that the Board send a merro to City Council regarding paving of shoulders on West Park Avenue; that the Board secretary, in preparing the merro, discovered that somehow or other the bike path is going through, so Mrs. Ciccarello asked the secretary to simply not write the merro, and is withdrawing her rrotion. There being no further business, Mrs. Ciccarello rroved the meeting be adjourned, seconded by Mr. Biggerstaff.
