CITIZEN CODE ENFORCEMENT BOARD
July 31, 1986 7:00 p.m.
Cornnunity Center
The meeting was called to order by the Chairman, Phillip Williams, at 7:00 p.m.
in the Cornnuni ty Ceoter of Edgewater.
ROLL CArL
Members present were: Lois Kane, Mary Ciccarello, Delores CUcanich, Vince Turano,
Paul Biggerstaff, Phillip Williams. Roberta Moses was excused. Also present were
Pat Di Leva; Assistant Code Enforcement Officer, and Cathy Vaughn, reporter.
APPROVAL OF MINUI'ES
Mr. Williams asked for approval of the minutes of June 21, 1986 meeting. Mrs.
Ciccarello rroved the minutes be accepted, seconded by Mr. Biggerstaff. Motion
CARRIED 6-0.
OID BUSINESS
86-CC-15 - Ross Kotakes (Prestige Car Care Center)
Mr. Williams asked for any remarks concerning this action, and the secretary
stated Mr. Dennis Fischer, Code Enforcement Officer, had asked her to read a
letter received from Mr. Kotakes stating he had hired a contractor to draw
up new site plans. Mr. Fischer wanted the Board to know the contractor is not
registered with the City of Edgewater. The Board discussed the fact that Mr.
Kotakes was given ninety days to be in compliance, and Mr. Kotakes had really
tried to comply with the Board's Order by submitting a site plan. The Board
determined to wait until our next meeting for a final decision on this matter.
86-CC-18 - Joseph Kopec (Pappy's Place)
Mr. Williams asked for any remarks concerning this action and the secretary
announced Mr. Fischer had asked her to inform the Board that Pappy's Place had
nON been closed down, and although the sign is still standing, to let this pass
for now, as the City has been informed a permit is not to be issued to Mr Kopec
again until all violations have been corrected.
86-CC-27 - Harold and Sheila Lloyd
Mr. Williams asked for discussion of this action and Mr. Pat Di Leva, Assistant
Code Enforcement Officer, asked if we could at this time go on to the next case
and come back to the Lloyd case. Mr. Williams agreed to this and stated the Board
would now hear the next case.
86-CC-28 - Chris Mundell (Bric-a-Brac)
Mr. Di Leva announced that as of this afternoon, Mr. Mundell is in compliance.
Mr. Williams then stated we would now hear the case of Harold and Sheila Lloyd.
Mr. Di Leva informed the Board that Mrs. Lloyd had called the Board secretary and
informed her the Lloyds would be out of town at the time of the hearing. Mr .
Di Leva stated he had no authority to excuse them and ~ha.d the secretary inform
Mrs. Lloyd to send a letter to the Board stating the -I,loyds would be out of town.
J.IIlr. Di Leva had the secretary read the letter and also informed the Board this had
never happened before (that the respondents would be out of town) and Mr. Di Leva
did not have the authority to excuse them. Mr. Di Leva continued that he and Mr.
Dennis Fischer, Code Enforcement Officer, visited the property next to the Lloyd's
and found a truck parked on Lloyd's property with an up-to-date license plate, but
the license plate had been assigned to a trailer, as reported by. the Police. Mrs.
Kane asked if this hasn't been going on since May, and Mr. Di Leva answered yes,
and they are still not in compliance. Mr. Turano asked the date originally notifying
the Lloyds and was informed it was May 20, 1986. Mr. Di Leva stated he did go there

again on June 2nd and there was, progress, so he didn't bring them before the
Board but in July, upon another visit, it was just as bad as it was before and
Mr. Di Leva then decided to bring the Lloyds before the Board. Mr. Turano said
he doesn't believe the letter they sent told him anything and Mr. Di Leva answered
the reason he asked Mrs. Lloyd to write the letter was, a phone call was not good
enough to bring to the Board. Mrs. Kane stated you do not send a letter to a judge
stating you will be out of town, to which the Board agreed. Mrs. Kane also stated
she believed two rronths was enough time and Mrs. Cucanich added perhaps these are
the kind of people who must be given so much time then fine them and perhaps we
will get results. Mr. Turano then noved that we fine the Lloyds within fifteen
(15) days, or whatever we can do without carrying this to the next meeting. The
secretary then read the steps to be taken according to the Code Book and the Board
discussed this in detail. Mr. Turano then changed his original notion of fifteen
days and noved we fine these people after the ten days' notice and stated the Board
should decide what the fine should _Us. Ciccarello seconded the notion and
added the Board fine the Lloyds~ .Dollars per day until in compliance.
Mr. Di Leva asked if this means he has to check them every day until they are in
compliance and the Board said no, the Lloyds will have to notify the Code Enforce-
ment Officer when they are in complaince.' The Board then asked the secretary to
add to the Order that the respondents must notify the Code Officer when they are in
compliance. Motion CARRIED 6-0. The Board then asked the secretary to contact
City Attorney Jose' Alvarez for approval of the issuance of the Findings of Fact,
Conclusions of Law and Order.
Mr. Di Leva then informed the Board of a non-compliance respondent now living in
Belgium. He stated the respondent could not be located for quite a while, but
he eventually located her and sent his usual ten day notice. He reported a letter
has now been received by Mr. Di Leva wherein a check in the amount of $450.00 was
enclosed, apologizing for the delay in sending this overdue noney. Mr. Williams
then corrmented the Code Enforcement Officers have been doing a very fine job.
Mrs. Ciccarella then asked to discuss the subject of West Park Avenue hazards
for pedestrians and bike riders and noved that a merro be sent to Council askinq
the possibility of putting paved shoulders on that road for safety 'and that we
await their reply. Mrs. CUcanich seconded the notion after discussion by the Board.
Motion CARRIED 6-0.
ElECTION OF OFFICERS
Mr. Williams armounced an election is to be held this evening for Chairman and
Vice Chairman. Mr. Turano noved for Mr. Williams' nomination as Chairman for a
second term, seconded by Mr. Biggerstaff. Motion CARRIED 6-0. Mr. Kane noved
for Mr. Turano's nomination as Vice Chairman for a second term, seconded by Mrs.
Ciccarello. Motion CARRIED 6-0.
There being no further business, Mrs. Ciccarello noved the meeting adjourn,
seconded by Mr. Turano. Motion CARRIED 6-0 and the meeting adjourned at 7:40 p.m.
