WHEREAS, LARRY CARSON, NANCY CARSON AND DAVID HALL, are
the owners in fee simple of certain real property located in
Volusie County, Florida, more particularly described below, and
WHEREAS, LARRY CARSON, NANCY CARSON AND DAVID HALL, have
petitioned the City of Edgewater for voluntary annexation under
Florida Statute 171.044, and
WHEREAS, at a meeting of the Land Development and Regula-
tory Agency on January 26, 1989, the Land Development and Regul-
story Agency reviewed said Petition and recommended that said
property be annexed into the City Limits under the R-4 Single -
Family Residential Zoning District.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY -OF
EDGEWATER, FLORIDA:
SECTION 1. The following described parcel of land lying
and being in the County of Volusia and contiguous to the boundary
lines of the City of Edgewater, is hereby pursuant to Section
171.044, Florida Statutes, annexed and made part of the City of
Edgewater, Florida, and shall be subject to the jurisdiction,
obligations, benefits and privileges of the municipality, to wit:
See Appendix "A", attached hereto and by reference
incorporated herein with full force and effect as if
herein set forth.
SECTION 2. The boundaries of the City of Edgewater are
hereby changed and redefined so as to include the land described
in Section 1 above in accordance with the legal description con-
tained therein.
SECTION 3. That upon adoption of this ordinance, the ap-
propriate Sections of the Code of Ordinances of the City of Edge-
water, shall be amended by redefining the boundaries of the City

to include the land described in Section 1 above.
SECTION 4. That the City Clerk is hereby directed to ad-
vertise this ordinance once a week for four consecutive weeks in
a newspaper of general circulation setting a date for a public
hearing and final adoption.
SECTION 5. That upon adoption of this ordinance, certi-
fied copies shall be filed with the Clerk of the Circuit Court in
and for Volusia County, the Department of State in Tallahassee,
and the Charter Revision Department of the State within 30 days.
SECTION 6. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 7. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.,
SECTION 8. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

This Ordinance was read on first reading and passed by a
vote of the City Council of the City of Edgewater, Florida, and
approval as provided by law, at a regular meeting of
said Council held on the 15th day of February , 1989.
The second reading of this Ordinance to be at a regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the 17th day of April , 1989.
