2024-O-05 - Prohibition on Direct Potable Reuse of Reclaimed BlackwaterORDINANCE NO. 2024-0-55 AN ORDINANCE GRANTING A CHANGE IN ZONING CLASSIFICATION FROM VOLUSIA COUNTY RC AND RCW TO MIXED USE PLANNED UNIT DEVELOPMENT (MUPUD) FOR 0.683± ACRES OF CERTAIN REAL PROPERTY GENERALLY LOCATED EAST OF SOUTH RIDGEWOOD AVENUE, NORTH OF JONES FISH CAMP ROAD (PARCEL IDENTIFICATION NUMBERS 8538-01-00-0220 AND 8538-01-00-0221), AND AMENDING THE EDGEWATER RIVER OAKS MIXED USE PLANNED UNIT DEVELOPMENT (MUPUD) AGREEMENT, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF EDGEWATER; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR AN EFFECTIVE DATE, RECORDING AND ADOPTION. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following findings of fact and determinations: Mark A. Watts, is the applicant on behalf of Indian River Shoreline, LLC, and Indian River Shoreline LLC, owners of property located east of South Ridgewood Avenue, north of Jones Fish Camp Road, and west of the Indian River, Parcel ID's 8538-01-00-0220 and 8538-01- 00-0221 within Volusia County, Florida. Subject property contains approximately 0.683 ± acres. 2. The applicant has submitted an application for a change in zoning classification from Volusia County R6 -W and RCW to MUPUD (Mixed Use Planned Unit Development) for the property described herein. 3. On November 13, 2024, the Local Planning Agency (Planning and Zoning Board) considered the application for change in zoning classification and recommended approve. 4. The proposed change in zoning classification is consistent with all relevant goals, objectives and policies of the Edgewater Comprehensive Plan. 5.
