CITIZEN CODE ENFORCEMENT BOARD
October 27, 1983, Regular Meeting
Minutes
Chairman Prater called the meeting to order at 7 p.m. in the Shuffleboard
Clubhouse.
ROLL CALL
Members present: Mrs. Kane, Messrs. Prater, Richardson, Rotundo, Rosa,
Williams and Turano. Also present: Chief Baugh and Mrs. Tay~or, Secretary
Chairman Prater suggested that the public hearings under New Business be
moved ahead of the Old Business. Chief Baugh was expected to arrive to
the meeting at 7:30 p.m. It is necessary that he be present for those
hearings which were tabled at the last meeting on September 29.
APPROVAL OF MINUTES
Mr. Rotundo motioned to approve the minutes of the September 29, 1983 meeting.
Mr. Richardson seconded the motion, which CARRIED 7-0.
NEW BUSINESS - Public Hearings
The secretary read the Notification of Violation for each case, citing the
violations. Mrs. Kane pointed out that the subpoenas to the violators stated
that the hearing would be in the Community Center. She wondered if some of the
people could be waiting there, not knowing the meeting had been moved to the
Shuffleboard Court. The meeting was briefly recessed for the secretary to
post a sign at the Community Center advising of the change of location.
83-CC-8 - Jackie R. Kidd,1812 Royal Palm, Violation of Sec. 712 - Expired
tags on Red Mazda, Ford Thunderbird and a Mercury.
The Chairman explained that there is now an Affidavit of Compliance signed by
Chief Baugh and dated October 27, 1983. Mr. Rosa motioned to drop the case
and send the In-Compliance form to the respondent, Jackie R. Kidd. The motion
was seconded by Mr. Williams and CARRIED 7-0.
83-CC-9 - John Menard/Fred Johnson, 2632 Yule Tree Drive, Edgewater, violation
of Sec. 712 - Truck too large for the residential area.
Mr. Peter Menard was sworn in by the secretary. Mr. Menard, who presently lives
at 2632 Yule Tree Drive, said that he has been transferred to Ocala and will
be moving the truck in the next 24 hours. Mr. Rotundo motioned to give Mr.
Menard ten days to move the truck. Mr. Williams seconded the motion, which
CARRIED 7-0. Mr. Prater said the Chief would check it out, after which an
In-Compliance form will be filed.
83-CC-13 - Thomas Witter, 223 Fl"agler Avenue, violation of Sec. 712 - no tag
on Monte Carlo.
Mr. Witter was sworn in by the secretary. The letter from his father, Mr.
Thomas L. Witter, with a copy of the registration certificate for the car
attached, was circulated around to the Board members to read. Mr. Prater
noted that there is an Affidavit of Compliance signed by Chief Baugh, who
had checked the car on 10/27/83, and found it to be tagged. Mr. Richardson
motioned to drop the case; the motion was seconded by Mr. Rotundo and PASSED

7-0.
Mrs. Dolores Smith, Case 83-CC-10, was present in the audience. She had
received a subpoena to appear; the Chief had advised that she was in compliance,
but she had not received the notice to date. She was advised that her case
was not on the agenda and that she could leave. Mr. Prater thanked her for
coming in.
83-CC-6 - GOVernment Builders/Check Realty- Junk tractor on lot at 1822
Hibiscus Drive.
The members questioned if this could be considered a junk tractor. Th~y-also
pointed out that it is sitting in a business zone. They suggested that the
tractor was used for the purpose of cleaning up around houses, etc., and they
did not view it as junk, and did not believe that a tag is necessary.

It was pointed out that the original complaint was for high grass, junked
cars, tractor, etc. The high grass and junked cars have been eliminated.
They did not feel the tractor was a problem. Mr. Williams made a motion
that the case be dropped. The motion was seconded by Mr. Richardson and
CARRIED 7-0. The members felt there was no need to send them a letter
on the matter.
83-CC-7 - Phoebe' pyevacand Zora Pyevac, 206 S. Ridgewood Avenue, violation
of Sec. 717.03 - rubbish on property.
The secretary advised that the subpoena and Notice of Hearing had been
reissued and was received by Phoebe pyevac on October 20, 1983. They
have not contacted the City regarding the matter. Mr. Richardson suggested
that the owners be notified to have the property cleared and if it was
not done, it would be cleared off at the owner's expense and unless it is
paid, there will be an attachment put on the property for the bill. Mr.
Turano asked how long this has been going on, and was advised that they
received the first notice on July 20, 1983. Mr. Richardson made a motion
that the property owner be given 20 days to clean the property up. If
he doesn't clean it up, the City will do so and bill them for the cost.
If the bill is not paid the City will place a lien on the property. Chief
Baugh said the property is still a mess and he would back the Board 100 per-
cent on whatever they want to do. Mr. Rosa recommended giving the property
owner 30 days to clear the property, but the majority of the members felt
he had been given ample time to clean up the property. Mr. Turano asked
that another copy of the Code Board ordinance be given to the owner. Mr.
Prater said that it should be stated that there was a hearing and this was
a decision of the Board. Mr. Turano seconded the motion. The motion
CARRIED 7-0.
Chief Baugh advised that all the cases mentioned under Miscellaneous were
checked and are in compliance.
Mr. Frank Opal, in the audience, asked if the Board had received a case
on Tiffany Terrace at U. S. 1 and Connecticut Avenue. The secretary
advised that it had not come to the Board to date.
UNFINISHED BUSINESS
Review draft of Amended Ordinance for recommendation to Council.
Mr. Prater pointed out that one reference to the alternate on page 3 (4)
needed to be taken out. Mrs. Kane motioned that the Ordinance, as
prepared, with the one change mentioned on page 3, be sent to Council
for adoption. Mr. williams seconded the motion ~Ht,...TuxanQ_ reiterated
that he believed the Board should have an alternate. It is his belief
that the people of Edgewater should get more involved in what goes on.
Having more people on Boards does just that, and more people can see
what is going on in the City and can do something about it. The motion
CARRIED 7-0.
Review and approve Rules and Regulations of the Board
The members pointed out that the Rules call for the meetings to be held
in City Hall and they wondered why they were not there for this meeting.
Mrs. Kane made a motion that a letter be sent to City Council advising
that the Code Enforcement Board, which serves with no compensation, holds
public hearings, and they request that their meetings be held in the
Community Center. The motion was seconded by Mr. Williams and CARRIED 7-0.
Mr. Williams asked which members of the Board were serving three years,
two years and one year. The secretary said she would provide this infor-
mation to them. Mr. Prater went through the Rules, pointing out the changes.
Mr. Rotundo made a motion that the Board accept the Rules and Regulations
as prepared. The motion was seconded by Mrs. Kane, which CARRIED 7-0.
The members signed the original Rules and Regulations.
MISCELLANEOUS
Mr. Prater noted that all the cases mentioned under Miscellaneous are now
in compliance, according to Chief Baugh. Mr. Richardson made a motion to

drop the cases listed, ie. 83-CC-IO, 83-CC-ll, 83-CC-12 and 83-CC-14.
The motion was seconded by Mr. Williams and CARRIED 7-0.
Future meeting dates
Mr. Prater advised the members that the November meeting will be held on
Thursday, November 17. The December meeting will be held on Thursday,
December 15, 1983.
Mr. Turano asked what happens at City Hall when someone calls in and
reports a violation. Mr. Prater said that they would be asked to come
in and sign a violation form. The secretary advised that the form is
turned over to the proper code enforcement officer, either the Building
Official or the Police Chief. They check out the report. If it is
determined to be a violation, the violator is given a period of time
to remedy the situation. If this is not done, then it is turned over
to the Code Enforcement Board.
The meeting was adjourned at 8:25 p.m.
