AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, AMENDING APPENDIX A, ZONING,
ARTICLE II, DEFINITIONS, SECTION 200.00; SECTION
606.02 (a) (d); SECTION 606.04 (c), BY CREATING A
DEFINITION OF OUTDOOR DISPLAY; ESTABLISHING INTENT AND
REGULATIONS FOR OUTDOOR STORAGE AS A SPECIAL
EXCEPTION; CONTAINING A REPEALER PROVISION, A
SEVRRABILITIY CLAUSE AND PROVIDING FOR AN EFFECTIVE
WHEREAS, the Planning and Zoning Board and the Board of
Adjustment of the City of Edgewater, Florida, recommended amend-
ments to the zoning ordinance.
WHEREAS, the City Council of the City of Edgewater con-
sidered these recommendations and directed the City Attorney to
prepare an Ordinance on the subject.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA:
SECTION 1. Appendix A, Zoning, Article II, Definitions,
Section 200.00, of the Code of Ordinances of the City of Edge-
water, Florida, be amended as follows:*
ARTICLE II - DEFINITIONS
Section 200.00. Interpretation of certain terms and words.
Outdoor Display: Any item, article, living or not, to be
sold, rented to or viewed by the public. Outdoor shall mean not
under _roof whether permanent or temporary as defined by a struc-
ture.
SECTION 2. Appendix A, Zoning, Section 606.02 (a) of
the Code of Ordinances of the City of Edgewater, Florida be amend-
ed as follows:

(a) Intent:
The Highway
Service Business
district is inten-
ded for application along highways carrying large volumes of traf-
fic, where establishments may locate to serve large sections of
the city and the persons traveling in vehicles.
*Deleted language has been lined threegh and new language
underscored.
(1) For reasons of esthetics, and in the interest of the
c safety. health and welfare of the citizens of the Citv of
Edgewater, no outdoor display will be allowed throughout the Dis-
trict. This prohibition shall aDDly to all existing, as well as
future businesses. This prohibition shall not be applicable to
dealerships of operative vehicles, mobile homes, boats, and vend-
ing machines for the convenience of the public.
SECTION 3. Appendix A, Zoning, Section 606.02 (d) of
the Code of Ordinances of the City of Edgewater, Florida, be
amended as follows:

(d) Special exceptions:

when incidental to or in conjunction with the main commercial
use located in the same premises, provided that:
(A) The storage area shall not be located in any of the re-
quired setbacks.
(B) Outdoor storage of equipment or materials shall be
located behind a six (6) foot high fence that will keep
the stored merchandise from plain view.
(C) The stored merchandise shall not protrude above the
height of the enclosing walls, fence or buildings.
SECTION 4. Appendix A, Zoning, Section 606.04 (c) of the
Code of Ordinances of the City of Edgewater, be amended as fol-
lows:

(c) Permitted Accessory Uses: Any accessory use customari-
ly accessory to permitted uses. heweaers the storage; sales;
services and display outside of baildings shall net be permitted

SECTION 5. That all ordinances or parts of ordinances
and all resolutions in conflict herewith, be and the same are
hereby repealed.
SECTION 6. If any section, part of a section, para-
graph, clause, phrase or word of this ordinance is declared in-
valid, the remaining provisions of this Ordinance shall not be
affected.,
SECTION 7. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

This Ordinance was read on first reading and passed by a
vote of the City Council of the City of Edgewater, Florida, and
approval as provided by law, at a regular meeting of
said Council held on the 15th day of May 1989.
The second reading of this Ordinance to be at a regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the 5th day of June , 1989.
