Citizen Code Enfordement Board Regular Meeting
February 24, 1983
Minutes
Chairman Mason called the meeting to order at 7:04 p.m. ln the conference
area of the Community Center.
ROLL CALL
Members present: Mrs. Mason, Mrs. Kane, Mrs. Hoffman, Messrs. Prater,
Hamel, Whittet and Williams. Absent: *Mr. Wargo. Also present: Mrs.
Taylor, Secretary, and a member of the press.
Mr. Hamel motioned to have Mrs. Hoffman declared a full member to take
Mr. Wargo's place at this meeting. The motion was seconded by Mr. Prater
and CARRIED 7-0.
APPROVAL OF MINUTES
Mr. Prater and Mrs. Kane requested that the minutes of the January 27th
meeting be corrected as follows:
Delete: Mrs. Kane motioned to approve the December 30, 1982 minutes,
seconded by Mrs. Kane.
Add: Mrs. Kane motioned to approve the December 30, 1982 minutes, seconded
by Mr. Prater.
With that correction, Mr. Prater motioned to approve the minutes of the
January 27th meeting, seconded by Mrs. Kane. The motion CARRIED 7-0.
*Mr. Wargo arrived to the meeting at 7:10 p.m.
Chairman Mason brought the Board up to date on her findings concerning
hearings and the procedure which the Board must follow. She explained
that she had spent the afternoon with Mr. Alvarez, City Attorney. He
told her that he was under the impression that the previous City Attorney
had changed the forms used to comply with the new State Statutes and the
Code. She also noted that the person who signs the complaint has to come
before the Board to present the case. She said that a set of the forms
to be used would be given to each member to review. When the case comes
to the Code Enforcement Board the Statement of Violation is filed, with
any previous correspondence to the violator. If they have not complied
within the time specified on the Statement of Violation, the Notice of
Hearing and subpoena will be sent. She went on to explain that Findings
of Fact must be given in writing. If they have not complied in the time
specified by the Board, an Order to Impose a Penalty and lien on the
property is filed.
Some discussion was had concerning the conditions on the Thomas King property
at 2614 Pine Tree Drive, noting that the violations still existed. It was
agreed that the Board could do nothing on th~s case until the Chief filed
the proper forms with the Board.
Mrs. Mason was advised by the City Attorney that Board members can abstain
from voting on an issue which presents a conflict of interest. His presence
at a meeting is counted to make a quorum, but he may abstain and then file
a Conflict of Interest form.
There was some discussion of the Perry Barrett CPonderosa Homes) case. This
matter must be put on hold until the proper forms are filed.
Mrs. Mason asked the Secretary to make copies of the forms for all members.
