09-30-1982 4 o o CITY OF EDGEWATER Citizen Code Enforcement Board September 30, 1982 Minutes Chairman Mason called the meeting to order at 7:05 p.m. in the conference area of the Community Center. ROLL CALL Members present: Mrs. Mason, Mrs. Kane, Messrs. Prater, Hamel and Williams. Excused: Mr. Holahan and Mr. Whittet. Absent: Mr. Hall. Also present: Mrs. Taylor, Secretary, and one member of the press. APPROVAL OF MINUTES It was agreed to postpone approval of the August 26, 1982 minutes, as Mr. Prater and Mrs. Kane were not present for that meeting. OLD BUSINESS Case #82-CC-20 - S. Kumar and C. Skalski, U. S. 1 (the lot north of 328 Ridgewood, Re. Section 717.03 Mrs. Mason recalled that Mrs. Kumar was given until August 26 to remedy the situation. The letters submitted by Mrs. Susan Wadsworth, Deputy City Clerk, indicated that Stanley Kumar and Clara Skalski were advised on August 20 and again on September 13 the names of contractors whom Mrs. Wadsworth had contacted in order to help them clear this property. On September 29 the property was still uncleared. Mr. Hamel moved to have Douglas Cole remove the two dead oak trees and clear the loti he withdrew his motion to ask the question of whether the City advances the contractor the fees, or would the contractor have to put a lien on the property. Mrs. Mason suggested that the City attorney's opinion be sought. If it is determined that the contractor cannot do that, then let the City do it, and put the lien against the property. Moved by Mr. Prater, seconded by Mr. Williams, and CARRIED 5-0, to contact the City Attorney to determine which way to go to put a lien against the property. Mrs. Mason said that if it was determined to be proper then they would go ahead and have Doug Cole clear the property. This should be done right away. Mr. Prater reworded the motion as follows: within the next five (5) days the Chairman will check with the City Attorney and find out the legalities as far as :having this cleared and placing a lien against the property, either by Doug Cole or by the City. Seconded by Mr. Williams. The Motion was APPROVED 5-0. NEW.BUSINESS - Case #82-CC-21 - Robert Voschell - Permitting litter on premises at 805 S. Ridgewood Avenue It was noted that Chief Earl Baugh had filed an Affidavit of Compliance on Case #82-CC-21 on September 13, 1982. Moved by Mr. Prater, seconded by Mrs. Kane, and CARRIED 5-0 to send a letter of compliance to Mr. Voschell. Mrs. Mason said that the Ken Winters (Paul Roche and Associates) case will apparently come to an agreeable conclusion. It is now in the hands of the Planning Commission. Mrs. Mason said she had sent a letter to the Mayor and City Council about Section 5D in the Code Enforcement Board Ordinance, which was objected to Mr. Mr. Holahan at the last meeting. She will follow up on this. Some discussion was had on terms of office of Board members. This . o information will be provided to the Chairman.
