ROLL CALL Members present: Messrs. Prater, Holahan, Hamel and Mrs. Mason. Excused: Mrs. Kane, Mr. Williams, Mr. Hall. Also present: Nancy Blazi, City Clerk, and one member of the press. APPROVAL OF MINUTES Moved by Mr. Hamel, seconded by Mr. Holahan to approve the minutes of the Dune 24th meeting. *3-1 vote did not carry. S e c t ion 71 2 An Affirlavit of Compliance was issued by Chief Baugh on July 9, 1982, stating that the Lloyds are now in compliance with Section 712. Moved by Mr. Holahan, seconded by Mrs. Mason, and UNANIMOUSLY CARRIED to send a letter of compliance to Mr. and Mrs. Lloyd, and close case 82-CC-11. Case 82-CC-14 - Paul Roche & Asso., Inc., 90~ So. ..RLd..gewooU.~enue ,__~~ .sectTo n -'.7T2-~"3 . -- - ---------- Mr. Prater called attention to the letter from Mr. Murphy dated July 12, 1982, withdrawing his complaints against Paul Roche & Asso., and to the Now-In- Compliance form signed by Mr. Murphy. Mr. Holahan asked that discussion on this case be continued after the other items on the Agenda were taken care of, and the other members agreed to do so. Case 82-CC-17 - Renter, Mrs. Day; Owner, Victor Paschevskv, 115 Merrimac, Re.-Sect(on--rl 2 .-"--.---------~ An Affidavit of Compliance was issued by Inspector David Barnhart on June 29, and the In-Compliance letter was sent to Mrs. Day. A copy of the In-Compliance form will be provided to the Board at the next meeting. NEW BUSINESS Case 82-CC-19 - Brent Batters~ 123 Rio Vista, Re: Section 717.03 and Section -iQ-=4-4-----.- --- _._- An Affidavit of Compliance was issued by Charles A,Murphy on July 12, 1982, stating that the property at 123 Rio Vista was now in compliance with Sections 717.03 and 10-44 of the Code. Moved by Mr. Holahan, seconded by Mrs. Mason, and UNANIMOUSLY CARRIED to send a letter of compliance to Mr. Battersby, and close case 82-CC-19. MISCELLANEOUS Mr. Prater reported that he had visited with Mr. Williams, and that he is doing fine and will be permitted to go back to work in two weeks. He will try to attend the next meeting. ~~~~2-CC-14 - Paul Roche !_As~~~_Inc~(See above) Mr. Holahan pointed out that a site plan is approved as submitted, or it is approved with stipulations for changes. He felt that if the Code Enforcement Board set a precedent on this case, the Planning Board would lose enthusiasm for getting good site plans and doing what is right for the City. ~ ,. o q Mr. Holahan noted that the approved site plan called for asphalt paving, therefore, it was in direct violation of the ordinance. There was some discussion about the procedure for submitting plans - first a site sketch is submitted, then preliminary plan, then the final site plan. Mr. Holahan said he felt the Board should not accept Mr. Murphy's letter withdrawing his complaints. He mentioned that Section 801 provided for a fine if a violation of the Code was found to have been committed. Mr. Hamel suggested sending the case back to the Planning Commission for review. He felt that the asphalt paving called for in the plan was not in conformity ~/ith the rustic appearance of the building, and mentioned that the removal of the trees now in the parking area would be undesirable. Mrs. Mason felt that they could suggest to Mr. Roche or Mr. Winter that they submit an Amended Site Plan and get it back to Planning for approval. Moved by Mr. Hamel to suggest to Mr. Roche and Mr. Winter that they return to the Planning Board to bring before them the question of the paving; aesthet- ically, the asphalt paving does not conform with the rustic appearance of the model home, and possibly in its place 9rave1 or shell could be used, and should be reflected in the Amended Site Plan. The case will be recon- sidered by this Board after it has gone before the Planning Board. Seconded by Mr. Holahan. The motion did not carry 3-1.
