Citizen Code Enforcement Board Public Hearings
and Regular Meeting Minutes
April 29, 1982, 7:00 PM
Chairman Prater called the Public Hearing to order at 7:03 PM in the conference
area of the Community Center.
ROLL CALL
Members present: Messrs. Prater, Hamel, Williams, Richardson, Holahan,
Mrs. Kane. Excused: Mr. Ed Hall. Also present: Lt. Rickelman, Mr. Murphy,
Mrs. Winks.
Public Hearings
Case 82-CC-7 - E. E. Gano, 917 Flagler Avenue, RE: Ordinance 81-0-17,
Section 717.03
Mr. Murphy and Lt. Rickelman were sworn in by the secretary. Lt. Rickelman
noted that Mrs. Gano was in violation of keeping litter on their premises,
and that Mrs. Gano had called and said she could not attend this evenings
meeting due to an illness in the family. An officer inspected the property
and reported that it was now in compliance.
Moved by Mr. Holahan, seconded by Mrs. Kane, and UNANIMOUSLY CARRIED, to
close Case 82-CC-7 and send a letter of compliance to Mrs. Gano.
Case 82-CC-9 - Barbara Marr, 128 Old County Road, RE: Ordinance 81-0-17,
Section 717.03
Mr. Holahan asked to be disqualified concerning this case as he has recently
been in contact with Mrs. Marr relative to his business. Chairman Prater
accepted his disqualification. Lt. Rickelman noted that Mrs. Marr was in
violation of keeping litter on their premises, and that it is now_about 75%
in compliance. Mrs. Marr has requested a one month extension to finish
cleaning up the premises, as her husband is ill.
Moved by Mr. Hamel, seconded by Mr. Williams, and UNANIMOUSLY CARRIED, to
give Mrs. Marr an extension to June 24, 1982 to comply, and if the property
is not in compliance at that time, a fine will be immediately imposed. A
letter will be sent to Mrs. Marr to this effect.
The Public Hearing was closed at 7:17 PM and the Regular Meeting called to
order.
Regular Heeting
APPROVAL OF MINUTES
Moved by Mr. Holahan, seconded by Mr. Hamel, and UNANIMOUSLY CARRIED, to
approve the minutes of March 25, 1982 as submitted.
OLD BUSINESS
Case 82-CC-3 - Jack Sparks, 2716 Mango Tree, RE: Section 7-325
The secretary noted that Hr. Sparks was in violation of not enclosing his
swimming pool, and on April 2, 1982, the date on which a fine was to be
levied, Mr. Sp~nks called to say he was now in compliance. Mr. Murphy
inspected the fence on April 27 and filled out a non-compliance form as
there was a section of fence not completed. Mr. Murphy inspected the pro-
perty again on April 29, the fence'was completed but Mr. Murphy felt that
the fence was not as sturdy as it should be, but we have no Ordinance to
go by stipulating the actual construction of the fence.
Moved by Mr. Holahan, seconded by Mr. Hamel, to send a letter of compliance
to Mr. Sparks, and recommend to Council to look into the possibility of
adopting the Southern Building Code Swimming Pool Code. Mr. Holahan withdrew
his motion after discussion that Mr. Sparks would not have to change his
fence if this Code were adopted at a later date.

Moved by Mr. Holahan, seconded by Mr. Hamel, and UNANIMOUSLY CARRIED, to
table Case 82-CC-3 until the next regular meeting for consideration at that
time, and recommend to Council to look into the possibility of adopting the
Swimming Pool Section of the Southern Building Code, and put the fine on
Mr. Sparks in abeyance.
NEW BUSINESS
Case 82-CC-5 - Harold Swiney, 1905 Lime Tree, RE: Ordinance 81-0-17, Section
717.03
An Affidavit of Compliance was issued by Chief Baugh on April 1, 1982, that
Mr. Swiney has removed the bee hives and litter in his yard and carport.
Moved by Mr. Richardson, seconded by Mr. Hamel, and UNANIMOUSLY CARRIED to
send a letter of compliance to Mr. Swiney and close Case 82-CC-5.
Case 82-CC-6, Thomas King, 2614 Pine Tree, RE: Ordinance 81-0-17, Section
717.03
An Affidavit of Compliance was issued by Chief Baugh on April 1, 1982, that
Mr. King has cleaned up the litter in his yard and carport.
Moved by Mr. Richardson, seconded by Mr. Holahan, and UNANIMOUSLY CARRIED to
send a letter of compliance to Mr. King and close Case 82-CC-6.
Case 82-CC-8, Raymond Eye (Owner), John Wooten (Renter), 216 W. Knapp,
RE: Ordinance 604, Section 712.00
An Affidavit of Compliance was issued by Chief Baugh on April 13, 1982, that
Mr. Hooten has removed the two stock cars that were on his premises.
Moved by Mr. Richardson, seconded by Mr. Holahan, and UNANIMOUSLY CARRIED to
send a letter of compliance to Messrs. Eye and Wooten and close Case 82-CC-8.
Case 82-CC-IO, Charles McDonald, 436 Perdita, RE: Ordinance 604, Section 712.00
An Affidavit of Compliance was issued by Chief Baugh on April 14, 1982, that
Mr. McDonald has removed the stock car that was on his premises.
Moved by Mr. Richardson, seconded by Mr. Holahan, and UNANI~10USLY CARRIED, to
send a letter of compliance to Mr. McDonald and close Case 82-CC-IO.
Mr. Richardson noted that he will be submitting a letter of resignation as
he is moving out of the city.
Moved by Mr. Holahan, seconded by Mr. Prater, and UNANIMOUSLY CARRIED, to
send Mr. Richardson a letter thanking him for his service to the Citizens
Code Enforcement Board.
The meeting was adjourned at 7:43 PM.
