03-25-1982 , , Q Q CITY OF EDGEWATER Citizen Code Enforcement Board Public Hearing and Regular Meeting Minutes March 25, 1982 Chairman Prater called the meeting to order at 7:08 PM in the conference area of the Community Center. ROLL CALL Members presenb: Messrs. Prater, Hamel, Williams, Richardson, Holahan, Hall, Mrs. Kane. Also present: Chief Baugh, Building Inspector, Mr. Murphy, Mrs. Henderson (Legal Counsel), Mrs. Winks. Case 81-CC-15, John Hughes, 123 Magnolia - Re: Ordinance 604, Section 712 Mr. John Hughes and Mr. and Mrs. Lippold were present to discuss their case. Mr. Hughes, Mr. and Mrs. Lippold and Chief Baugh were sworn in by the secre- tary. Chief Baugh stated that Mr. Hughes is in violation of keeping a junk car on his premises and not in an enclosed building. Mr. Hughes testified that this car has been sold and will be moved from his property within the next few days. Moved by Mr. Williams, seconded by Mr. Holahan, and UNANIMOUSLY CARRIED, to require Mr. Hughes to have the car moved by March 29, or a $25 per day fine will be issued. Case 82-CC-3, Jack Sparks, 2716 Mango Tree - Re: Section 7-325 Mr. Jack Sparks was not present to discuss his case. Mr. Murphy was sworn in by the secretary. Mr. Murphy testified that Mr. Sparks is in violation of not enclosing his swimming pool, and he has been told several times and has disregarded the warnings. The concensus of the Board is that there is definitely a danger to life and health with this situation. Moved by Mr. Richardson, seconded by Mr. Williams, and UNANIMOUSLY CARRIED, to give Mr. Sparks until April 2, 1982 to comply with this ordinance to the satisfaction of the Building Inspector, and if it is not in compliance at that time an initial fine of $50 be levied with an additional $25 per day thereafter that it remains in non-compliance. Regular Meeting APPROVAL OF MINUTES Moved by Mr. Richardson, seconded by Mrs. Kane, and UNANIMOUSLY CARRIED, to approved the minutes of February 25, 1982, as read by the secretary. OLD BUSINESS Case 82-CC-2, Nancy Verduzco, 2509 Tamarind - Re: Ordinance 604, Section 712 Chief Baugh stated that the vehicle was towed away by the owner on March 15, 1982. Moved by Mr. Williams, seconded by Mr. Hamel, and UNANIMOUSLY CARRIED, to close Case 82-CC-2. NEW BUSINESS Case 82-CC-4, Ma Grundy's, 1401 S. Ridgewood - Re: Section 800.02, .03, .04 Mr. Murphy explained his letter to the Board stating that he had contacted the owners of Ma Grundy's asking them to file for a permit, they did and paid a double fee. Mr. Murphy stated that they had only changed the decor of the restaurant, and no additional electrical service was provided. Mr. Hamel questioned Mr. Opal regarding his complaint against Mr. Murphy. Mrs. Henderson stated that the complaint is against a City Official who in exercising his duty must use discretionary powers. In making his deci- sion on this building permit, he felt one was not necessary as the changes were cosmetic. Mrs. Henderson felt that this case should be dismissed because this Board does not hear complaints against City Officials. l (.,) u Moved by Mr. Holahan, seconded by Mr. Williams, and CARRIED 5";'0, \ 'to dispose of this case on the advise received by legal counsel present. Mr. Hamel abstained. Moved by Mr. Holahan, seconded by Mr. Williams, and CARRIED 5-0, to inform the complaintant that this case was not under the jurisdiction of the Citizen Code Enforcement Board per legal advice.
