Citizen Code Enforcement Board Meeting
Minutes
February 25, 1982
Chairman Prater called the meeting to order at 7:07 PM in the conference
area of the Community Center.
ROLL CALL
Members present: Messrs. Prater, Hamel, Williams, Richardson, Holahan,
Hall. Absent: Mrs. Kane. Also present: Debbie Winks, Secretary,
Mr. John Hughes.
APPROVAL OF MINUTES
Moved by Mr. Holahan, seconded by Mr. Richardson, and tJNMUMOUSLY CARRIED,
to approve the minutes of the 1/28/82 meeting as read by the secretary.
Moved by Mr. Hamel, s~conded by Mr. Williams, and UNANIMOUSLY CARRIED, to
table swearing in Mr. Ed Hall until the next meeting.
OLD BUSINESS
8l-CC-15 - John Hughes, 123 Magnolia Ave - Re: Ordinance 604, Section 712
Mr. Hughes was present to discuss his case. Mr. Holahan questioned the
absence of Chief Baugh. It was felt he was not present as the defendant
was not subpoened and carne to the meeting of his own accord. Mr. Hughes
presented his certificate of registration (NO. N26453 dated 2/18/82) for
the homemade trailer. An informal discussion followed as to what should
be done. It was the concensus of all that the Ordinance was very clear
that the car cannot be stored on the trailer.
.Moved by Mr. Hamel, seconded by Mr. Richardson, and UNANIMOUSLY CARRIED,
to table 8l-CC-15 until the next meeting, thereby giving Mr. Hughes a
chance to sell or dispose of the car.
82-CC-l - Lester Miller, 3328 Unity Tree Drive - Re: Ordinance 604,
Section 712 - An Affidavit of Compliance was filed by Chief Baugh.
Moved by Mr. Holahan, seconded by Mr. Hamel, and UNANIMOUSLY CARRIED, to
close the case and send the approy;ecl lettter.
82-CC-2 - Nancy Verduzco, 2509 Tamarind - Re: Ordinance 604, Section 712
The Board members noted that this car is not on her property, it is on
the street. It was questioned if the Chief has the right to tow this
car away being that it is on the City right-of-way. The Board felt that
it wasn't under their jurisdiction because it was not on residential
property.
Moved by Mr. Holahan, seconded by Mr. Hamel, and UNANIMOUSLY CARRIED, to
notify the Chief that the Board feels this is under his jurisdiction and
he should take appropriate action to have the car removed.
NEW BUSINESS
82-CC-3 - Jack Sparks, 2716 Mango Tree - Re: Section 7-325 - Mr. Sparks
was sent a Notification of Ordinance Violation Warning by Certified
Return Receipt Mail, that he is in violation of not completely enclosing
his swimming pool.
Moved by Mr. Holahan, seconded by Mr. Williams, and UNANIMOUSLY CARRIED,
to have Mr. Murphy check this prior to our next meeting and if not in
compliance, to issue necessary papers for a hearing.
Chairman Prater passed around the letter from Mr. Mitchell suggesting
Form CCEB 81-1, Notification of Ordinance Violation Warning, be changed.
Moved by Mr.Holahan, seconded by Mr. Richardson, and UNANIMOUSLY CARRIED,
to keep the existing CCEB 81-1 unless there is a legal reason for the
change.
The meeting was adjourned at 8:25 PM.
