AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE -
WATER, FLORIDA, AMENDING APPENDIX A, ZONING, SECTION
606.04, B-5, "PLANNED SHOPPING CENTER DISTRICT" (c)
PERMITTED ACCESSORY USES, BY ESTABLISHING GUIDELINES
FOR SPECIAL ACTIVITIES IN PARKING LOTS IN THE B-5
DISTRICT; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, at a regular scheduled meeting of the Land Devel-
opment and Regulatory Agency of the City of Edgewater held on the
llth day of May, 1989, recommendations were made regarding guide-
lines for special activities in parking lots in the B-5 District,
and
WHEREAS, at a regular scheduled meeting of the City Coun-
cil of the City of Edgewater, Florida, held on the 5th day of
June, 1989, said recommendations were considered and the City
Attorney was directed to prepare an ordinance on the subject.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That Appendix A, Zoning, Section 606.04, B-5
Planned Shopping Center District, (c) Permitted Accessory Uses,
of the Code of Ordinances of the City of Edgewater, Florida, be
amended as follows:*

ZONING
Section 606.04 B-5 Planned Shopping Center district.
(c) Permitted accessory uses: Any accessory use customari-
ly accessory to permitted uses, however, the storage, sales, ser-
vice and display outside of buildings shall not be permitted with-
out a permit to be granted by the city council which shall set
forth all terms and conditions applying to said storage, sales,
service and display for the individual business requesting the
permit. Terms and conditions set forth on the permit shall be
reasonable and designed to protect the health, safety and welfare
of the citizens of the City of Edgewater. However, the following
guidelines for special activities shall apply:
1. $150.00 per day fee to cover administrative costs, not
to exceed a nine (9) day period, and Council authori-
zation for a temporary permit.
*Deleted language has been lined through and new language
underscored.
2. Possible deposit for police services (overtime).
3. Insurance policy or bond to protect the City from
liability.
4. There shall be no more than two (2) activities a month
per location.
5. No driveways or driving lanes to be blocked.
6. No signage for advertising of event to be placed on
highway right-of-ways.
7. Provide sanitary facilities adequate for expected
attendance.
8. No electrical cords to be run across driveways or
driving lanes.
9. No overnight camping.
SECTION 2. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 3. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 4. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

This Ordinance was read on first reading and passed by a
vote of the City Council of the City of Edgewater, Florida, and
approval as provided by law, at a regular meeting of
said Council held on the 19th day of June , 1989.
The second reading of this Ordinance to be at a regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the 17th day of July , 1989.
