89-O-21ORDINANCE NO. 89-0-21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE - WATER, FLORIDA, AMENDING APPENDIX A, ZONING, SECTION 200.00 "INTERPRETATIONS OF CERTAIN TERMS AND WORDS" BY REMOVING THE REQUIREMENT THAT MINIWAREHOUSES BE ALLOWED ONLY ALONG THE FEC TRACES FROM 20TH TO 30TH STREETS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, at a regularly scheduled meeting of the Land Development and Regulatory Agency held on the llth day of May, 1989, a recommendation was made to amend Section 200.00 of the Code of Ordinances of the City of Edgewater, Florida, and WHEREAS, at a regularly scheduled meeting of the City Council of the City of Edgewater, held on the 17th day of July, 1989, the Council considered these recommendations and directed the City Attorney to prepare an Ordinance on the subject. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Appendix A, Zoning, Section 200.00 of the Code of Ordinances of the City of Edgewater, Florida, be amended as follows:* APPENDIX A Y&INW1 C1 Section 200.00. Interpretations of certain terms and words. Miniwarehouse: A structure or part of a structure, not ex- ceeding ten (10) feet in height, ten (10) feet in width, or twen- ty (20) feet in length, or a total cubic capacity of two thousand (2000) cubic feet. To be used solely for storage purposes. The retail or wholesale of any goods, wares, or merchandise or any type of service business of whatever description is absolutely prohibited. May be converted into a commercial permitted use if restrooms and parking are adequate. Must submit new site plan for approval by the L.D.R.A. To be a€€awed only in that area of land aieng the Florida East Eeast Railroad Traeks from 90th to 39th Streets in the eity- *Deleted language has been lined threagh and new language underscored. SECTION 2. That all ordinances or parts of ordinances and all resolutions in conflict herewith, be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. SECTION 4. This Ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law. This Ordinance was introduced by Councilman Fish This Ordinance was read on first reading and passed by a vote of the City Council of the City of Edgewater, Florida, and approval as provided by law, at a regular meeting of said Council held on the 7th day of August 1989.
