AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EFGE-
WATER, FLORIDA, AMENDING CHAPTER 2, ADMINISTRATION,
SECTION 2-10, "DISHONORED CHECK POLICY" BY INCREASING
THE SERVICE FEE FOR DISHONORED CHECKS FROM TEN DOLLARS
TO FIFTEEN DOLLARS AND ELIMINATING THE MAXIMUM $25.00
SERVICE FEE; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN. EFFECTIVE DATE
WHEREAS, Section 166.251, Florida Statutes, allows cities
to increase the service fee for dishonored checks.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That Chapter 2, Administration, of the Code of
Ordinances of the City of Edgewater, Florida, be amended as fol-
lows:*
CHAPTER 2
ADMINISTRATION
Section 2-10. Dishonored check policy.
(a) The following penalties shall be imposed for dishnored
checks, drafts or other payment of money in accordance with
Florida Statute 166.251:
(1) There shall be collected as a service fee for the col-
lection of the first dishonored check, draft or other order, for
the payment of money to an official or agency of the City of Edge-
water, the sum of ten fifteen dollars E019799+ ($15.00)
or five (5) percent of the face amount of the check, draft or
order, whichever is greater_ up to a maximum fee e€ twenty-five
deltars E$2570837 This service fee shall be in addition to all
other penalties imposed by law. In addition, a written warning
will be issued by registered mail to the consumer, giving notice
that in the event a second dishonored check is received, the ac-
count will be marked "Do Not Accept Personal Checks."
(2) There shall be collected as a service fee for the col-
lection of a second dishonored check, draft or other order, by
the same customer, for the payment of money to an official, or

agency of the City of Edgewater, the sum of ten fifteen
dollars E$197093 ($15.00) or five percent of the face amount
of the check, draft or order, whichever is greater up to e
maximum fee of twenty-five del€ats E$95:003 and the account
will be marked "Do Not Accept Personal Checks" and the necessaery
steps taken for collection of said dishonored check.
SECTION 2. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 3. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 4. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

approval as provided by law, at a Regular meeting of
said Council held on the 6th day of November 1989.
The second reading of this Ordinance to be at a Regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the 20th day of November , 1989.
