UJI<JACOJll[, FlLOlIU][)A October 25, 1947 Edgewat8r Tovm Council Edgewater, Florida Gentlemen: The petition signed by the business man of Edgewater protesting the 1947 occupational licenses has been referred to me. As stated in my Opinion dated Sept- ember 26, 1947 to Mayor Lohman, the Tovm Council had a leg~ right to levy licenses in the amounts set forth in Ordinance No. l~ approved September 10, 1947. You \rlll recall that months ago a substantially higher schedule of licenses was recommended by a citizens committee appointed by the Town Council. These recom- mendations were considered by t he Council and feeling that they were too high were lOV'Tared to the amounts contained in the September 10th Ordinance. It now appears that the business men of Edgewater feel very definitely that the licenses are too high, as is evidenced by their petition, and one of the members of the citizens committee which recommended even highter licenses has now joined in signing the petition protest- ing the 1947 licenses as excessive. The Town Council acted in good faith upon the committee's recommendation in adopting a license schedule higher than 1946 licenses but lower than the committee recommended, but in view of the fact that the business men who pay the licenses now feel that the schedule adopted is excessive, and are opposed to this method of raising revenue, I feel that the Tovm Council vrould be justified in repealing the 1947 licenses, thus reverting to the same license taxes as were charged last year, and that the difference be re- funded those who have already paid, and I recommend that this action be taken.
